RESOLUTION NUMBER 92-51
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF SEAL BEACH APPROVING HEIGHT VARIATION
92-25, A REQUEST TO PERMIT AN EXISTING COVERED,
ROOF-ACCESS STRUCTURE AT B-26 SURFSIDE
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE
WHEREAS, on September 10, 1992, Joint M ArtukoVlch subnutted an applicatIOn for Height
Vanatlon 92-25 to the Department of Development SeTVIces, and
WHEREAS, the apphcatlon requests after-the-fact approval ofa height vanatlon for an eXIstmg
covered roof access structure (CRAS) at B-26 Surf sIde The exlstmg CRAS has
an area of approXImately 84 2 square feet, and
WHEREAS, tins apphcatlon was submitted to comply WIth the reqUIrements of CIty Ordmance
1322 which set forth new standards for the constructIOn and maIntenance of
CRAS's wltlnn the City Ordmance 1322 requIres that a property owner ofan
eXIstmg CRAS apply to the City for a HeIght Vanatlon If theIr eXlstmg CRAS does
not conform to the new standards, and
WHEREAS, the existmg CRAS at B-26 Surf side exceeds the maxImum area of 62 25 square
feet necessary to cover t1te rectangular stlUrwell, and
WHEREAS, the subJect property IS legally descnbed as Orange County Assessor's Parcel
Number 178-491-51, and
WHEREAS, the subJect property IS surrounded on three Sides by sIDgle fanuly reSIdences m the
ReSIdential Low DenSity wne (RLD) of Surf sIde and PacIfic Coast Highway to the
north, and
WHEREAS, a duly noticed pubhc heanng was held on November 4, 1992, to consIder Height
Vanatlon 92-25, and
WHEREAS, dunng the pubhc heanng on Height VanatlOn 92-25 there was no OppOSItIOn,
either written or verbal, to the grantmg of tins request, and
WHEREAS, the Planmng CommiSSion makes the follOWIng findmgs

1 The eXlstmg CRAS IS arclntecturally m keepmg WIth t1te remainder ofthe
structure, WIth the roofing matenals and sidmg matclnng those of the
remainder of the structure,
2 The eXIstmg CRAS IS m keepmg WIth the character and mtegnty of the
surroundmg neIghborhood where numerous covered roof-access structures
have been constructed m close proXlnuty to the subJect property,
3 The exlstmg CRAS was constructed m accordance WIth t1te plans approved
through BUlldmg Permit 3133, ISSUed on October 19, 1989,
4 The existing CRAS exceeds the nummum honzontal dimenSIOns necessary
to cover the staIrwell, however, due to the configuration of the staIrwell,
no habItable hVlng space IS proVIded Wlthm the structure, and
5 Due to the flat terraIn m the Vlclmty of the proposed structure, It does not
slgmficantly Impair the pnmary VIew of any property located wltlnn 300
feet of the subJect property
6 There was no opposItIon of any kIDd expressed dunng the pubhc heanng
on Height VanatlOn 92-25
NOW, THEREFORE BE IT RESOLVED that the Planmng ComnusslOn of the CIty of Seal
Beach does hereby approve of HeIght VanatlOn 92-25 pemuttmg an existIng covered roof-access
structure at B-26 Surf side, Seal Beach, as approved through Buddmg Penmt 3133 Issued on
October 19, 1989
PASSED, APPROVED AND ADOPTED by the Planmng Comnussion of the City of Seal Beach
at a meetmg thereof held on the 4th day of November, 1992, by the follOWIng vote
