A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF SEAL BEACH APPROVING HEIGHT VARIATION
92-24, A REQUEST TO PERMIT AN EXISTING COVERED,
ROOF-ACCESS STRUCTURE AT B-17 SURFSIDE
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE
WHEREAS, on September 10, 1992, Joint M Artukovich subnutted an apphcatlOn for HeIght
VanatlOn 92-24 to the Department of Development SerVIces, and
WHEREAS, the apphcatlOn requests after-the-fact approval ofa height vanatlon for an eXIstmg
covered roof access structure (CRAS) at B-17 Surf sIde The eXIstmg CRAS has
an area of approXImately 84 2 square feet, and
WHEREAS, tins apphcatlon was subnutted to comply With t1te reqUIrements of CIty Ordmance
1322 winch set forth new standards for the constructIon and mamtenance of
CRAS's Wltlnn the CIty Ordmance 1322 requires that a property owner of an
eXIstmg CRAS apply to the CIty for a Height VanatlOn If their eXIstmg CRAS does
not conform to the new standards, and
WHEREAS, the eXIstmg CRAS at B-17 Surf side exceeds the maXImum area of 62 25 square
feet necessary to cover the rectangular staIrwell, and
WHEREAS, the subJect property IS legally descnbed as Orange County Assessor's Parcel
Number 178-491-18, and
WHEREAS, the subJect property IS surrounded on three SIdes by smgle farmly reSidences m the
ReSidential Low DenSity zone (RLD) of Surf sIde and Pacific Coast Highway to the
north, and
WHEREAS, a duly noticed pubhc heanng was held on November 4, 1992, to conSIder HeIght
VanatlOn 92-24, and
WHEREAS, dunng the pubhc heanng on HeIght Vanatlon 92-24 there was no OppOSItIOn,
eIther wntten or verbal, to the grantmg of thIS request, and
WHEREAS, the Planmng ComnusslOn makes the followmg findmgs

structure, WIth the roofing matenals and sldmg matclnng those of the
remlUnder of the structure,
2 The exlstmg CRAS IS m keepmg WIth the character and mtegnty oftlte
surroundmg neighborhood where numerous covered roof-access structures
have been constructed m close proXInuty to the subject property,
3 The eXlstmg CRAS was constructed m accordance WIth the plans approved
through Bulldmg Permit 2474, Issued on February 20, 1987,
4 The exlstmg CRAS exceeds the nummum honzontal dimenSIOns necessary
to cover the staIrwell, however, due to the configuration of the stairwell,
no habitable IIvmg space IS proVIded Wltlnn the structure, and
5 Due to the flat terrlUn m the Vlclmty ofthe proposed structure, It does not
slgmficantly ImplUr the pnmary VIew of any property located Wltlnn 300
feet of the subJect property
6 There was no oppOSItion of any kmd expressed dunng the public heanng
on HeIght Variation 92-24
NOW, THEREFORE BE IT RESOLVED that the Planmng ComnusslOn of the CIty of Seal
Beach does hereby approve of HeIght Vanatlon 92-24 permittmg an exlstmg covered roof-access
structure at B-17 Surf sIde, Seal Beach, as approved through Bulldmg PermIt 2474 Issued on
February 20, 1987
PASSED, APPROVED AND ADOPTED by the Planmng ComnusslOn of the City of Seal Beach
at a meetmg thereof held on the 4th day of November, 1992, by the followmg vote
