HomeMy WebLinkAboutPC Res 92-49 - 1992-11-04 RESOLUTION NUMBER 92-49 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING HEIGHT VARIATION 92-23, A REQUEST TO PERMIT AN EXISTING COVERED, ROOF-ACCESS STRUCTURE ATB-7 SURFSIDE THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE WHEREAS, on September 10, 1992, Joint M Artukovlch subnutted an apphcatlon for Height Vanatlon 92-23 to the Department of Development Services, and WHEREAS, the apphcatlon requests after-the-fact approval ofa heIght vanatlon for an eXIstmg covered roof access structure (CRAS) at B-7 Surf side The eXIstIDg CRAS has an area of approXImately 84 2 square feet, and WHEREAS, this apphcatlOn was submitted to comply WIth the reqUIrements of City Ordmance 13 22 winch set forth new standards for the constructIOn and maintenance of CRAS's wlthm the City Ordmance 1322 reqUIres that a property owner of an exlstmg CRAS apply to the City for a HeIght Vanatlon If their eXlstmg CRAS does not conform to the new standards, and WHEREAS, the eXlstmg CRAS at B-7 Surf side exceeds the maXImum area of 62 25 square feet necessary to cover the rectangular stalTWell, and WHEREAS, the subJect property IS legally descnbed as Orange County Assessor's Parcel Number 178-502-7, and WHEREAS, the subJect property IS surrounded on three SIdes by smgle farmly reSIdences m the ReSidentIal Low DenSIty zone (RLD) of Surf sIde and PacIfic Coast HIghway to the north, and WHEREAS, a duly noticed pubhc heanng was held on November 4, 1992, to conSider HeIght Vanatlon 92-23, and WHEREAS, dunng the pubhc heanng on HeIght Vanatlon 92-23 there was no OppOSItIOn, either wntten or verbal, to the grantmg of tins request, and WHEREAS, the Planmng CommISSion makes the following findmgs C \AMIPRlJ\DOC&\MPR\R92-23 BCC be , Planmng COmnuSSIOD Reso1uUon 92-49 November 5. 1992 1 The eXlstmg eRAS IS arclntecturally m keepmg WIth the remlUnder of the structure, WIth the roofing matenals and sldmg matclnng those of the remamder of the structure, 2 The exlstmg CRAS IS m keepmg WIth the character and mtegnty of the surroundmg neighborhood where numerous covered roof-access structures have been constructed m close proXInuty to the subJect property, 3 The eXIstmg CRAS was constructed m accordance WIth the plans approved through Bulldmg Pemut 7891, ISSUed on March 18, 1988, 4 The exlstmg CRAS exceeds the mlmmum honzontal dimenSions necessary to cover the stlUrwell, however, due to the configuratIon of the stlUTWe1l, no habItable lIVIng space IS proVIded Wltlnn the structure, and 5 Due to the flat terram m the Vlcmlty of the proposed structure, It does not slgmficantly Impair the pnmary view of any property located wlthm 300 feet of the subJect property 6 There was no oppOSitIOn of any kmd expressed dunng the publIC heanng on Height Vanatlon 92-23 NOW, THEREFORE BE IT RESOLVED that the Planmng ComnusslOn of the CIty of Seal Beach does hereby approve of Height Vanatlon 92-23 permlttmg an eXlstmg covered roof-access structure at B-7 Surf side, Seal Beach, as approved through BUlldmg Permit 7891 Issued on March 18, 1988 PASSED, APPROVED AND ADOPTED by the Planmng Commission of the CIty of Seal Beach at a meetIDg thereof held on the 4th day of November, 1992, by the follOWIng vote AYES Comnussloners Shafll.
