HomeMy WebLinkAboutPC Res 92-42 - 1992-10-21 RESOLUTION NUMBER 92-42 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING CONDITIONAL USE PERMIT 92-14, A REQUEST FOR AN ON SALE BEER LICENSE AND AN ON-SALE GENERAL LIQUOR LICENSE IN CONJUNCTION WITH AN EXISTING TENNIS CLUB AND AN EXISTING COUNTRY CLUB, RESPECTIVELY, LOCATED AT 3900 AND 3901 LAMPSON AVENUE (OLD RANCH) THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE WHEREAS, on September 14, 1992, Ronald Bradshaw submitted an apphcatlon for CUP 92-14 WIth the Department of Development Services on behalf of the BIxby Ranch Company, and WHEREAS, CUP 92-14 requests contmuatlon ofan on-sale beer hcense m conJunction WIth an eXIstmg tenms club and an on-sale general hquor hcense m conjunction With an eXIstmg country club located at 3900 and 3901 Lampson Avenue, respectively (BIxby Old Ranch) ThiS apphcatlOn has been filed m response to City Ordmance 1448 which reqUired all eXlstmg busmesses which are lackmg a reqUired use permit to apply to the CIty for such a use permit Wltlnn SIX (6) months of approval of said ordmance, and WHEREAS, the subJect property consists of a pnvate tenms club located on the southwesterly corner of the mtersectlon of Lampson Avenue and Basswood Avenue and a pnvate country club located at the northeasterly corner of the mtersectlOn of Seal Beach Boulevard and Lampson Avenue, and WHEREAS, the tenms club possesses a "type 40" ABC hcense whIch permits the on-sale seTVIce of beer to members of the pnvate club, the service of beer IS techmcally open to the pubhc Beer IS served from a snack/pro shop located roughly m the center of the property The snack/pro shop IS open dady from 9 00 a m to 9 30 pm, and WHEREAS, the country club possesses a "type 57" ABC hcense winch permIts the on-sale service of general hquor to members of the pnvate club Beer, WIne and distilled spmts are served wlthm the country club's restaurant/lounge as well as from a smaller service bar located WIthin the club's banquet room The restaurant/lounge IS open between the follOWIng hours Tuesday, Thursday and Saturday Wednesday Fnday Sunday Monday 6am t07pm 6amt02am 6 a m to 12 30 am 6am tolOpm closed The seTVIce of alcohohc beverages beginS at 10 30 a m dally, except Saturday and Sunday when service begms at 10 00 am, and WHEREAS, the surroundmg land use and wmng are as follows NORTH The Los Alamltos Armed Forces Reserve Center located m the City of Los Alanutos SOUTH A mixture of Single family dwelhngs and condos located ID College Park East m the ReSidential Low DenSIty zone, (RLD), the Old Ranch Tenms Club m the General Commercial zone, (C-2) and the San Diego Freeway (1-405) C \AMlPR.O\DOCS\CUP\R92 14 BCC be . Planmng CommiSSion Resolution 92-42 WEST Rossmoor Center ID the General Commercial wne, (C-2) and smgle family dwelhngs located In the umncorporated area of Rossmoor EAST A nuxture of single family dwellings and condos located m College Park East m the ResIdential Low DensIty wne, (RLD), and WHEREAS, the country club received ItS hquor hcense m 1966, while the tenms club receIved Its beer hcense In 1970 Neither use has ever received a conditIonal use permit for the sale of beer, WIne or distilled spmts, and WHEREAS, Chief ofPohce Bill Stearns has reviewed thiS request and has no concerns regardmg the granting of thiS request, and WHEREAS, a duly noticed pubhc heanng was held on October 21, 1992 to conSider CUP 92-14, and WHEREAS, the Planmng CommIssIon makes the follOWIng findmgs I Staffmspected the subJect property on October 13, 1992, and found that the country club and the temlls club meet all reqUIrements of the Code and presently meet all normal conditIOns of approval for estabhshments servmg on-sale general hquor and on-sale beer 2 The grantmg of CUP 92-14 IS consIstent WIth the proVISIons of the General Plan which mdlcate the subJect property IS to be used for general commercIal and recreatIOnal golf purposes, whIch both Include on-sale service of alcohohc beverages 3 The bUilding and property at 3900 and 3901 Lampson Avenue are adequate In Size, shape, topography and locatIOn to meet the needs of the proposed use of the property 4 ReqUired adherence to apphcable bUlldmg and fire codes ensure there WIll be adequate water supply and utlhtles for the proposed use 5 The Old Ranch Tenms Club and Old Ranch Country Club have been In continuous operation servmg alcohohc beverages for over 20 years With no record of slgmficant pohce or other problems 6 The on-premises sale of beer, WIne and distilled spmts IS appropnate for a country club and a tenms club Adherence to condItions of approval placed on the use by both the CIty of Seal Beach and the Department of Alcohohc Beverage Control should nutlgate any negative Impacts to nelghbonng reSidentIal propertIes 7 The Seal Beach Pohce Department has reViewed the eXisting records of both the country club and the temlls club and has no reservatIons regardmg the requested hcense NOW, THEREFORE BE IT RESOLVED that the Plamllng Commission of the City of Seal Beach does hereby approve of ConditIOnal Use Permit 92-14 subject to the follOWing conditions I CUP 92-14 IS approved for an on-sale general hquor hcense at 3901 Lampson Avenue (Old Ranch Country Club) and for an on-sale beer hcense at 3900 Lampson Avenue (Old Ranch Tenms Club and IS Issued to the Bixby Ranch Company 2 All alcohohc beverages shall be consumed on the prermses, and none shall be sold as take out C \AMIPRO\DOCS\CUP\R92 14 BCC be Page 2 . Planmng CommiSSion RcsoluUolI 92-42 3 The apphcant shall comply with all restnctlOns placed on the hcense by the California Department of Alcohohc Beverage Control 4 WIth the apphcant's consent, the hours of operatIOn dunng winch alcohohc beverages may be served at the country club shall be from 10 00 a m to 2 00 a m dlUly 5 With the apphcant's consent, the hours of operation for the tenms club shall be from 9 00 a m to 1000 P m dlUly 6 No VIdeo games or slnular amusements shall be pemutted on the premIses Without permits from the CIty 7 No hghted sIgns advertISIng alcoholic beverages shall be placed m the WIndow areas, nor shall any other SIgnS advertISing speCific brands of alcohohc beverages be pemutted ID the WIndow areas Intenor displays of alcohohc beverages winch are clearly VISible to the extenor shall constItute a Violation of this condition 8 CUP 92-14 IS non-transferrable 9 The apphcant shall, 1D a locatIOn acceptable to the Director of Development SeTVIces, prominently display the abovehsted conditIons ofapproval ID all areas where alcohohc beverages are sold 10 Tins condItIOnal use pemut shall not become effective for any purpose unless an "acceptance of conditIOns" form has been Signed by the apphcant and property owner, notanzed or Signed before a City staff member subJect to proper IdentificatiOn, and returned to the Department of Development SeTVIces, and until the ten (10) day appeal penod has elapsed II The Plarmmg ComnusslOn reserves the nght to revoke tins conditIOnal use permit If any VIOlatIOn of these condItions or the Code of the City of Seal Beach occurs 12 A new Conditional Use Permit shall be obtaIned when any of the followmg occur (a) transfer of ownership of the hcense IS proposed, (b) the estabhshment proposes to change ItS type of hquor hcense, (c) the estabhshment proposes to mod1f:y any of Its current conditions of approval, or (d) there IS a substantial change In the mode or character of operations of the estabhshment PASSED, APPROVED AND ADOPTED by the Planmng ComnusslOn of the CIty of Seal Beach at a meeting thereof held on the 21st day of October, 1992, by the follOWIng vote AYES ComnusslOners Shafll.
