HomeMy WebLinkAboutPC Res 92-38 - 1992-10-07 RESOLUTION NUMBER 92-38 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING HEIGHT V ARIA TION 92-21, A REQUEST TO PERMIT AN EXISTING COVERED, ROOF-ACCESS STRUCTURE AT 340 COASTLINE AVENUE, SEAL BEACH, CA THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, on July 15, 1992, LoUIS and Pat EllIano submItted an applicatJon for HeIght VanatJon 92-21 to the Department of Development SeTVIces, and WHEREAS, the applicatIon requests after-the-fact approval of a heIght vanatJon for an eXIstIng covered roof access structure (CRAS) at 340 CoastllDe Avenue The eXIstJng CRAS has an area of approXImately 104 square feet, and WHEREAS, t1us applicatJon was subnutted to comply WIth the reqUIrements of CIty OrdIDance 1322 WhICh set forth new standards for the constructJon and mlUntenance of CRAS's wIthm the CIty Ordmance 1322 requrres a property owner of an eXlstJng CRAS apply to the CIty for a HeIght VanatJon If therr eXIstIng CRAS does not conform to the new standards, and WHEREAS, the eXIstJng CRAS at 340 Coastlme Avenue exceeds the mmImum dImenSIOns necessary to cover the staIrwell, and WHEREAS, the subJect property IS legally descnbed as Lot 5, Tract 1817, Assessor's Parcel No. 199-121-3; and WHEREAS, the subJect property IS surrounded on all SIdes by smgle famIly resIdences ID the ResIdentJal Low DenSIty wne, (RLD), and WHEREAS, a duly notIced public hearIng was held on October 7, 1992, to conSIder HeIght VanatJon 92-21, and WHEREAS, dunng the Public HearIng on HeIght VanatJon 92-21 there was no OpposItJon, eIther wntten or verbal, to the grantmg of thIS request; and WHEREAS, the Planmng CommIssIOn makes the followmg findmgs. 1. The eXIstJng CRAS IS archItecturally m keepmg WIth the remamder of the structure, WIth the roofing matenals and sIdIDg matchIng those of the remainder of the structure, 2. The eXIstJng CRAS IS m keepmg WIth the character and mtegnty of the surroundIDg neIghborhood where numerous covered roof-access structures have been constructed m close proximIty to the subject property; 3 The eXIstJng CRAS was constructed ID accordance WIth the plans approved m November of 1989, WIth final mspectJon on Aprll13, 1990, 4 The eXIstJng CRAS exceeds the mImmum honwntal dImenSIOns necessary to cover the staIrwell, however, due to the configuratJon of the staIrwell, no habItable Iivmg space IS proVIded wlthlD the structure; and 5. Due to the flat terraID ID the vIcImty of the proposed structure, It does not slgmficantly Impair the pnmary vIew of any property located Wlthm 300 feet of the subject property. , , Page 2 of 2 ResolutJon No 92-38 HeIght VanatJon #92-21 6 There was no opposltJon of any kInd expressed dunng the publIc heanng on HeIght VanatIon 92-21. NOW, THEREFORE BE IT RESOLVED that the Planmng CommIssIon of the CIty of Seal Beach does hereby approve of HeIght VanatJon 92-21 pernuttJng an eXlstJng covered roof-access structure at 340 Coastlme Avenue, Seal Beach, as constructed In accordance WIth plans approved by the CIty In November 1989, WIth final IDspectJon on apnl13, 1990 PASSED, APPROVED AND ADOPTED by the Planmng CommIssIon of the City of Seal Beach at a meetIng thereof held on the 7th day of October, 1992, by the followmg vote: AYES.
