HomeMy WebLinkAboutPC Res 92-37 - 1992-10-07 , RESOLUTION NUMBER 92-37 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING HEIGHT VARIATION 92-20, A REQUEST TO PERMIT AN EXISTING COVERED, ROOF-ACCESS STRUCTURE AT 242 FOURTEENTH STREET, SEAL BEACH, CA THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE. WHEREAS, on July 16, 1992, Earl L. Shea submItted an appllcatJon for HeIght VanatJon 92- 20 to the Department of Development ServIces, and WHEREAS, the appllcatJon requests after-the-fact approval of a heIght vanatIon for an eXIstJng covered roof access structure (CRAS) at 242 Fourteenth Street. The eXIstJng CRAS has an area of approxImately 143 square feet; and WHEREAS, thIS applicatJon was submItted to comply WIth the reqUIrements of CIty OrdIDance 1322 WhICh set forth new standards for the constructJon and maintenance of CRAS's wlthlD the CIty. OrdInance 1322 reqUIres a property owner of an eXlstJng CRAS apply to the CIty for a HeIght VarIatJon If theIr eXIstJng CRAS does not conform to the new standards, and WHEREAS, the eXlstJng CRAS at 242 Fourteenth Street exceeds the mImmum dImenSIons necessary to cover the staIrwell, and WHEREAS, the subJect property IS legally descnbed as Lot 42, Block 221 of Tract 10; and WHEREAS, the subJect property IS surrounded on all SIdes by a mIXture of smgle famIly and multJ-famlly reSIdences m the ResIdentJal MedIUm DenSity wne, (RMD), and WHEREAS, a duly notJced public heanng was held on October 7, 1992, to conSIder HeIght VanatJon 92-20; and WHEREAS, dunng the Public Heanng on HeIght VanatJon 92-20 there was no OpposItJon, eIther wntten or verbal, to the grantJng of thIS request; and WHEREAS, the Planmng ComnusslOn makes the followlDg findIDgs: 1. The eXlstJng CRAS IS archItecturally m keepmg WIth the remaInder of the structure, WIth the roofing matenals and sIdmg matchIDg those of the remainder of the structure, 2 The eXIstIng CRAS IS m keepmg WIth the character and mtegrity of the surroundIng neIghborhood where numerous covered roof-access structures have been constructed ID close proXImIty to the subJect property, 3 The eXIstJng CRAS was constructed In accordance WIth the plans approved m October of 1986, WIth final IDspectJon on Apnl 9, 1987; 4 The eXIstJng CRAS exceeds the nummum honzontal dImenSIOns necessary to cover the staIrwell, however, due to the configuratJon of the staIrwell, no habItable liVIng space IS proVIded wIthm the structure, and 5 Due to the flat terraID m the vIcImty of the proposed structure, It does not sIgmficantly Impair the pnmary vIew of any property located WIthID 300 feet of the subJect property. , , Page 2 of2 ResolutJon No. 92-37 HeIght VanatJon #92-20 6. There was no opposItIon of any land expressed dunng the publIc heanng on HeIght VanatIon 92-20. NOW, THEREFORE BE IT RESOLVED that the Planmng CommIssIon of the CIty of Seal Beach does hereby approve of HeIght VanatJon 92-20 permIttIDg an eXIstIDg covered roof-access structure at 242 Fourteenth Street, Seal Beach, as constructed In accordance WIth plans approved ID October 1986, WIth final mspectJon on Apnl 9, 1987. PASSED, APPROVED AND ADOPTED by the Planmng CommIssIon of the CIty of Seal Beach at a meetJng thereof held on the 7th day of October, 1992, by the followlDg vote. A YES: CommIssIoners Shafll.
