RESOLUTION NUMBER 92-36 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING HEIGHT VARIATION 92-19, A REQUEST TO PERMIT AN EXISTING COVERED, ROOF-ACCESS STRUCTURE AT 103 OCEAN A VENUE, SEAL BEACH, CA THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, on July 22, 1992, C Edward and Kathenne Dllkes subnutted an appl1catJon for HeIght VanatJon 92-19 to the Department of Development ServIces; and WHEREAS, the applicatIon requests after-the-fact approval of a heIght vanatlOn for an eXIstJng covered roof access structure (CRAS) at 103 Ocean Avenue The eXistIng CRAS has an area of approXImately 105 square feet, and WHEREAS, thIS applicatIon was submItted to comply WIth the reqUIrements of CIty OrdIDance 1322 WhICh set forth new standards for the constructJon and maintenance of CRAS's wIthm the CIty. OrdIDance 1322 reqUIres a property owner of an eXIsting CRAS apply to the CIty for a HeIght VanatJon If theIr eXIstIDg CRAS does not conform to the new standards, and WHEREAS, the eXlstJng CRAS at 103 Ocean Avenue exceeds the nummum dImensIOns necessary to cover the staIrwell; and WHEREAS, the subJect property IS legally descnbed as Lot 3, Block 1 of Bay CIty Tract, and WHEREAS, the subject property IS surrounded on all SIdes by a mixture of smgle family and multI-famlly reSIdences ID the ResIdentJal Low DenSIty zone (RLD) and the ResldentJal HIgh DenSIty wne, (RHD), and WHEREAS, a duly noticed public heanng was held on October 7, 1992, to conSIder HeIght VanatJon 92-19, and WHEREAS, dUTlng the Public Heanng on HeIght VanatIOn 92-19 there was no oppoSltJon, eIther wntten or verbal, to the grantmg of thIS request, and WHEREAS, the Planmng CommIssIon makes the followmg findIDgs: 1 The eXlstJng CRAS IS archItecturally In keepmg WIth the remamder of the structure, WIth the roofing matenals and sIdIDg matchmg those of the remlUnder of the structure, 2. The eXIstJng CRAS IS ID keepIDg WIth the character and mtegnty of the surroundIDg neIghborhood where numerous covered roof-access structures have been constructed m close prOXImIty to the subJect property, 3. The eXIstIng CRAS was constructed m accordance WIth the plans approved m November of 1983, WIth final mspectIon on March 29, 1984, 4 The eXIstJng CRAS exceeds the mImmum honzontal dImenSIOns necessary to cover the staIrwell, however, due to the configuratJon of the staIrwell, no habItable IivIDg space is proVIded WIthIn the structure; and 5. Due to the flat terraIn m the vlclmty of the proposed structure, It does not sIgmficantly Impair the pnmary VIew of any property located wIthm 300 feet of the subJect property , , Page 2 of2 ResolutJon No 92-36 HeIght VanatIon #92-19 6. There was no oppoSItJon of any kInd expressed dunng the public heanng on HeIght VanatJon 92-19 NOW, THEREFORE BE IT RESOLVED that the Planmng CommIssIon of the CIty of Seal Beach does hereby approve of HeIght VanatIon 92-19 permlttJng an eXIstIng covered roof-access structure at 103 Ocean Avenue, Seal Beach, as constructed ID accordance WIth plans approved m November 1983, and WIth final mspectJon on March 29, 1984 PASSED, APPROVED AND ADOPTED by the Planmng CommISSIon of the CIty of Seal Beach at a meetJng thereof held on the 7th day of October, 1992, by the followmg vote.
