HomeMy WebLinkAboutPC Res 92-35 - 1992-10-07 RESOLUTION NUMBER 92-35 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING HEIGHT VARIATION 92-18, A REQUEST TO PERMIT AN EXISTING COVERED, ROOF-ACCESS STRUCTURE AT 101 OCEAN AVENUE, SEAL BEACH, CA THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, on July 22, 1992, DavId L. Abell submItted an applicatJon for HeIght VanatJon 92-18 to the Department of Development ServIces; and WHEREAS, the appllcatJon requests after-the-fact approval of a heIght vanatIon for an eXlstJng covered roof access structure (CRAS) at 101 Ocean Avenue The eXlstJng CRAS has an area of apprOXImately 105 square feet, and WHEREAS, thIS applicatJon was submItted to comply WIth the reqUIrements of CIty OrdInance 1322 whIch set forth new standards for the constructJon and maIntenance of CRAS's wlt1un the CIty. Ordmance 1322 reqUIres a property owner of an eXIstJng CRAS apply to the CIty for a HeIght VanatJon If theIr eXIstJng CRAS does not conform to the new standards; and WHEREAS, the eXlstJng CRAS at 101 Ocean Avenue exceeds the mlmmum dImenSIOns necessary to cover the staIrwell; and WHEREAS, the subJect property IS legally descnbed as Lot 2, Block 1 of Bay CIty Tract; and WHEREAS, the subJect property IS surrounded on all SIdes by a mIxture of smgle famIly and multI-family resIdences m the ResidentJal Low DenSIty wne (RLD) ReSIdentIal HIgh DenSIty wne, (RHD), and WHEREAS, a duly notJced public heanng was held on October 7, 1992, to conSIder HeIght VanatJon 92-18; and WHEREAS, dunng the Public Heanng on HeIght Vanatlon 92-18 there was no opposltJon, eIther wntten or verbal, to the grantIng of thIS request, and WHEREAS, the Planmng CommIssIon makes the followmg findmgs. 1 The eXlstJng CRAS IS archItecturally m keepIng WIth the remlUnder of the structure, WIth the roofing matenals and SIdIng matchmg those of the remlUnder of the structure, 2 The eXlstmg CRAS IS In keepIng WIth the character and Integnty of the surroundmg neIghborhood where numerous covered roof-access structures have been constructed ID close prOXImIty to the subJect property; 3. The eXIstJng CRAS was constructed m accordance WIth the plans approved m November of 1983, ISSUed on November 14, 1983, 4. The eXlstmg CRAS exceeds the mlmmum honwntal dImenSIOns necessary to cover the staIrwell, however, due to the configuratJon of the staIrwell, no habItable liVIng space IS proVIded wlthm the structure; and 5. Due to the flat terraID m the VlcImty of the proposed structure, It does not SIgmficantly Impair the pnmary vIew of any property located wIthm 300 feet of the subJect property , Page 2 of 2 ResolutJon No 92-35 HeIght VanatIon #92-18 6 There was no opposItIOn of any kmd expressed dunng the public heanng on HeIght VanatJon 92-18 NOW, THEREFORE BE IT RESOLVED that the Planmng CommIssIon of the CIty of Seal Beach does hereby approve of HeIght VanatJon 92-18 permItting an eXlstJng covered roof-access structure at 101 Ocean Avenue, Seal Beach, as constructed m accordance WIth plans ISSUed on November 13, 1993 PASSED, APPROVED AND ADOPTED by the Planmng CommIssIon of the CIty of Seal Beach at a meetJng thereof held on the 7th day of October, 1992, by the followmg vote: A YES.
