RESOLUTION NUMBER 92-34 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING HEIGHT VARIATION 92-17, A REQUEST TO PERMIT AN EXISTING COVERED, ROOF-ACCESS STRUCTURE AT 120 FIRST STREET THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE WHEREAS, on July 19, 1992, DaVId W WerkheIser subnutted an apphcatlOn for Height Vanatlon 92-17 to the Department of Development SeTVIces, and WHEREAS, the apphcatIon requests after-the-fact approval ofa hetght vanatIon for an eXlstmg covered roof access structure (CRAS) at 120 FIrst Street The exJstmg CRAS has an area of approxImately 127 square feet, and WHEREAS, tins apphcatlon was subnutted to comply WIth the reqUIrements of City Ordnance 1322 which set forth new standards for the constructIOn and mamtenance of CRAS's Wlthm the City Ordmance 1322 requires that a property owner of an exlstmg CRAS apply to the CIty for a Height Vanatlon Ifthetr eXIstmg CRAS does not conform to the new standards, and WHEREAS, the exlstmg CRAS at 120 FlTst Street exceeds the nummum dImenSIons necessary to cover the stlUrwell, and WHEREAS, the subJect property IS legally descnbed as Orange County Assessor's Parcel Number 199-145-4, and WHEREAS, the subJect property IS surrounded on three Sides by a nuxture of smgle family and multi-family reSIdences m the ReSIdentIal High DenSity zone (RHO) and the vacant DWP property located m the DWP Specdic Plan area to the west, and WHEREAS, a duly notIced public heanng was held on October 7, 1992, to consIder HeIght VarIatIon 92-17, and WHEREAS, dunng the public heanng on Height VanatJon 92-17 the owner spoke m favor of tins request There was no OppositIOn, eIther wntten or verbal, to the grantmg of tins request, and WHEREAS, the Planmng ComnusslOn makes the follOWIng findings I The extenor of the eXlstmg CRAS IS arclntecturally m keepmg With the remainder of the structure WIth the sldmg matclnng that of the remlUnder of the structure 2 The roofing matenal of the CRAS IS not m keepmg WIth the roofing matenal of the remamder of the structure However, due to the distance the CRAS IS located from the street and alley, the dark color of the CRAS's roof IS slnuIar m color to the dark color of the remlUnder of the structure's roofing and the presence of two-story structures on both SIdes of the existing CRAS, the roofing matenalls not easily VISIble from the street, the alley or adJacent properties Based on the above, the Plarmmg ComnusslOn believes the roofing matenal of the eXlstmg CRAS IS suffiCIently m keepmg WIth the roofing matenal of the remaInder of the structure, 3 The eXIstmg CRAS IS In keepmg WIth the character and mtegnty oftlte surroundmg neighborhood where numerous covered roof-access structures have been constructed m close proXInuty to the subject property, C\AMIPRO\DOCS\MPR\R9217 BCCbc Plannmg ComnusslOn ResoluUon 92-17 October 7, 1992 4 The eXlstmg CRAS was constructed m accordance WIth the plans approved through BUlldmg Permit 1629, Issued on May 11, 1989, 5 The eXlstmg CRAS exceeds the mlmmum honzontal dimensIOns necessary to cover the stairwell, however, due to the configuratIon of the staIrwell, no habitable IIvmg space IS provided Wlt1un the structure, and 6 Due to the flat terrain m the Vlcimty of the proposed structure, It does not slgmficantly ImplUr the pnmary view of any property located Wltlnn 300 feet of the subJect property 7 There was no oppOSitIOn of any kmd expressed dunng the pubhc heanng on HeIght Vanatlon 92-17 NOW, THEREFORE BE IT RESOLVED that the Planmng CommiSSIon of the CIty of Seal Beach does hereby approve of Height Vanatlon 92-17 permlttmg an eXlstmg covered roof-access structure at 120 FlTst Street, Seal Beach, as approved through Buildmg Pemut 1629 Issued on May 11, 1989 PASSED, APPROVED AND ADOPTED by the Planmng CommiSSIon of the City of Seal Beach at a meetmg thereof held on the 7th day of October, 1992, by the followmg vote A YES Commissioners Shafll.
