RESOLUTION NUMBER 92-33 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING HEIGHT VARIATION 92-16, A REQUEST TO PERMIT AN EXISTING COVERED, ROOF-ACCESS STRUCTURE AT 206 ELEVENTH STREET, SEAL BEACH, CA THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE' WHEREAS, on July 20, 1992, Roger L EllIott submItted an appllcatJon for HeIght VanatlOn 92-16 to the Department of Development ServIces; and WHEREAS, the applicatJon requests after-the-fact approval of a heIght vanatlOn for an eXlstJng covered roof access structure (CRAS) at 206 Eleventh Street The eXlstmg CRAS has an area of apprOXImately 120 square feet; and WHEREAS, thIs appllcatJon was submItted to comply WIth the requirements of CIty Ordmance 1322 whIch set forth new standards for the constructJon and mamtenance of CRAS's wlthm the CIty. Ordmance 1322 reqUIres a property owner of an eXlstJng CRAS apply to the CIty for a HeIght VanatJon If theIr eXlstJng CRAS does not conform to the new standards; and WHEREAS, the eXlstJng CRAS at 206 Eleventh Street exceeds the mlmmum dImenSIOns necessary to cover the staIrwell; and WHEREAS, the subject property IS legally descnbed as Lot 6, Block 111 of Bay CIty Tract; and WHEREAS, the subject property IS surrounded on all SIdes by a mIxture of smgle family and multJ-family resIdences m the ResIdentJal HIgh DenSIty rone, (RHD); and WHEREAS, a duly notJced public heanng was held on October 7, 1992, to conSIder HeIght VanatJon 92-16; and WHEREAS, dunng the Public Heanng on HeIght VanatlOn 92-16 there was no OpposltJon, eIther wntten or verbal, to the grantJng of thIS request, and WHEREAS, the Planmng CommIssIon makes the followmg findmgs 1. The eXIstJng CRAS IS archItecturally m keepmg WIth the remaInder of the structure, WIth the roofing matenals and sIdmg matchIng those of the remaInder of the structure; 2. The eXIstJng CRAS IS m keepmg WIth the character and Integnty of the surroundmg neIghborhood where numerous covered roof-access structures have been constructed m close proxImIty to the subject property, 3 The eXIstIng CRAS was constructed m accordance WIth the plans approved m August 1989, WIth final mspectlOn on May 21, 1990; 4. The eXlstJng CRAS exceeds the mImmum honzontal dImenSIOns necessary to cover the staIrwell, however, due to the configuratJon of the staIrwell, no habItable lIvmg space IS proVIded wIthm the structure; and 5 Due to the flat terraIn m the vIcImty of the proposed structure, It does not slgmficantly ImpaIr the pnmary VIew of any property located wIthm 300 feet of the subject property , Page 2 of2 ResolutIon No. 92-33 HeIght VanatIon #92-16 6. There was no oppoSltJon of any kInd expressed dunng the public heanng on HeIght VanatJon 92-16 NOW, THEREFORE BE IT RESOLVED that the Planmng CommIssIon of the CIty of Seal Beach does hereby approve of Height VanatJon 92-16 penmttJng an eXlsnng covered roof-access structure at 206 Eleventh Street, Seal Beach, as constructed In accordance WIth plans approved In August 1989, WIth final mspectJon on May 21, 1990 PASSED, APPROVED AND ADOPTED by the Planmng CommIssIon of the CIty of Seal Beach at a meenng thereof held on the 7th day of October, 1992, by the follOWIng vote.
