A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF SEAL BEACH APPROVING HEIGHT VARIATION
92-15, A REQUEST TO PERMIT AN EXISTING COVERED,
ROOF-ACCESS STRUCTURE AT 1215 SEAL WAY, SEAL
BEACH,CA
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE'
WHEREAS, on July 21, 1992, Joseph E. RIbal submitted an applicatIon for Height VanatIon
92-15 to the Department of Development Services; and
WHEREAS, the applicatIon requests after-the-fact approval of a height vanatIon for an eXIstIng
covered roof access structure (CRAS) at 1215 Seal Way. The eXistIng CRAS has
an area of approXImately 132 square feet, and
WHEREAS, thiS applicatIon was submitted to comply With the requirements of City Ordmance
1322 which set forth new standards for the constructIon and mwntenance of
CRAS's wlthm the City. Ordmance 1322 requires a property owner of an
eXistIng CRAS apply to the City for a Height VanatIon If their eXistIng CRAS
does not conform to the new standards; and
WHEREAS, the eXistIng CRAS at 1215 Seal Way exceeds the ffilmmum dimenSIOns necessary
to cover the stalfwell, and
WHEREAS, the subject property IS legally descnbed as Orange County Assessor's Parcel
Number 199-075-08; and
WHEREAS, the subject property IS surrounded on all Sides by a mixture of smgle family and
multI-fwmly restdences m the ReSidentIal High DenSity zone, (RHD); and
WHEREAS, a duly notIced public heanng was held on October 7, 1992, to conSider Height
VanatIon 92-15, and
WHEREAS, dunng the Public Heanng on Height VanatIon 92-15 there was no OppoSItIon,
either wntten or verbal, to the grantIng of thiS request; and
WHEREAS, the Planmng Commission makes the followmg findmgs:
1. The eXistIng eRAS IS architecturally m keepmg With the remamder of the
structure, WIth the roofing matenals and sldmg matchmg those of the
remwnder of the structure;
2. The eXistIng CRAS IS m keepIng With the character and mtegnty of the
surroundIng neighborhood where numerous covered roof-access structures
have been constructed In close proximity to the subject property;
3. On November 9, 1986, the Planmng Commission approved Plan ReView
#25-66, grantIng a MInor Height VanatIon for the subject CRAS At that
tIme the Commission conSidered the size of the proposed CRAS and
determIned It was appropnate for the character and Integnty of the
neighborhood
4. The eXistIng CRAS was constructed In accordance With the plans approved

5. The eXlstlng CRAS exceeds the mlDlmum honwntal dimensIOns necessary
to cover the stairwell, however, due to the configuratlon of the staIrwell,
no habitable hVlDg space IS provided wlthm the structure; and
6. Due to the flat teTraln m the VIClDlty of the proposed structure, It does not
slgmficantly ImplUr the pnmary view of any property located wlthm 300
feet of the subject property
7. There was no opposltlon of any land expressed dunng the publIc heanng
on Height Vanatlon 92-15.
NOW, THEREFORE BE IT RESOLVED that the Planmng CommISSIOn of the City of Seal
Beach does hereby approve of Height Vanaoon 92-15 permlttlng an eXlstlng covered roof-access
structure at 1215 Seal Way, Seal Beach, as approved by Plan ReView #26-86, WIth final
mspectlon on January 2, 1992.
PASSED, APPROVED AND ADOPTED by the Planmng Commission of the City of Seal Beach
at a meenng thereof held on the 7th day of October, 1992, by the followmg vote:
