HomeMy WebLinkAboutPC Res 92-31 - 1992-10-07 RESOLUTION NUMBER 92-31 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING HEIGHT VARIATION 92-14, A REQUEST TO PERMIT AN EXISTING COVERED, ROOF-ACCESS STRUCTURE AT 116 13TH STREET THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE WHEREAS, on July 17, 1992, James M and MlUJory A Yeager submItted an applIcation for HeIght Vanatlon 92-14 to the Department of Development SelVlces, and WHEREAS, the applIcation requests after-the-fact approval of a height vanatlon for an eXlstmg covered roof access structure (CRAS) at 116 13th Street The eXlstmg CRAS has an area ofapproXlmately 68 square feet, and WHEREAS, thiS applIcation was submItted to comply With the reqUIrements of CIty Ordnance 1322 winch set forth new standards for the constructIon and mamtenance of CRAS's wltlnn the CIty Ordmance 1322 requires that a property owner of an eXlstmg CRAS apply to the City for a Height Vanatlon If theIr eXlstmg CRAS does not conform to the new standards, and WHEREAS, the eXIstmg CRAS at 116 13th Street exceeds the nummum dimenSIons necessary to cover the stauwell, and WHEREAS, the subject property IS legally descnbed as Orange County Assessor's Parcel Number 199-081-15, and WHEREAS, the subject property IS surrounded on all Sides by a mIXture of smgle fanuly and multi-family reSidences m the ReSIdential High DenSity zone, (RHO), and WHEREAS, a duly noticed publIc heanng was held on October 7, 1992, to conSider Height Vanatlon 92-14, and WHEREAS, dunng the publIc heanng on HeIght Vanatlon 92-14 there was no OppOSitIon, either written or verbal, to the grantmg of tins request, and WHEREAS, the Planmng Comnusslon makes the followmg findmgs 1 The eXlstmg CRAS IS architecturally m keepmg With the remamder of the structure, WIth the roofing matenals and sldmg matchmg those of the remamder of the structure, C\AMIPRO\DOCS\MPK\R9214 BCCbc , Planmng Comnusslon Resoluuon 92-14 October 7,1992 ~ 2 The eXlstmg CRAS IS m keepmg WIth the character and mtegnty of the surroundmg neighborhood where numerous covered roof-access structures have been constructed m close proXImity to the subject property, 3 The eXlstmg CRAS was constructed m accordance WIth the plans approved through BUlldmg PermIt 1309, Issued on January 5, 1989, 4 The exIstmg CRAS exceeds the 1JI1IUmum honzontal dImensIOns necessary to cover the stlllrwell, however, due to the configuratIon of the starrwell, no habItable hvmg space IS prOVIded Wltlun the structure, and 5 Due to the flat terrllln m the Vlclmty of the proposed structure, It does not slgmficantly ImpaIr the primary VIew of any property located Wltlun 300 feet of the subject property 6 There was no opposItIOn of any kmd expressed dunng the pubhc hearing on Height VanatlOn 92-14 NOW, THEREFORE BE IT RESOLVED that the Planmng C01l1lT11sslOn of the CIty of Seal Beach does hereby approve ofHetght Vanatlon 92-14 penmttmg an exlstmg covered roof-access structure at 1 I 6 13th Street, Seal Beach, as approved through Buddmg Penmt 1309 Issued on January 5, 1989 PASSED, APPROVED AND ADOPTED by the Planmng C01l1lT11sslOn of the CIty of Seal Beach at a meetmg thereof held on the 7th day of October, 1992, by the follOWIng vote AYES Comnussloners Shw:p.
