HomeMy WebLinkAboutPC Res 92-24 - 1992-07-15 , . r RESOLUTION NUMBER 92-24 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH RECOMMENDING TO THE CITY COUNCIL APPROVAL OF ZONING TEXT AMENDMENT 92- 5, AMENDING SECTIONS 28-2407 AND 28-210, RELATING TO THE EXPANSION OF NON- CONFORMING STRUCTURES WITHIN THE CITY OF SEAL BEACH THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE. WHEREAS, on November 7, 1990, the Planmng CommIssIon conSIdered a Staff Report whIch discussed the followmg Issues; Processmg of Development ApplicatIons, Standard of ReView for Mmor Plan ReViews, and General History of City Policy re ExpanSIon of Non-Confonmng ReSidential Structures, and WHEREAS, on November 7, 1990, the Planmng Commission requested directIon of the City Council regardmg several Issues of concern relatIve to the Mmor Plan ReView process, and WHEREAS, on November 13, 1990, the CIty Council conSidered the request of the Planmng Commission, receiVed comments from city staff relatIve to thiS Issue, and adopted Ordmance No. 1319, which prohIbited the processmg of development applicatIons for the expansion of non-conformmg residentIal structures as an urgency measure, and WHEREAS, on November 28, 1990, the Planmng Commission receiVed and filed a staff report regardmg the City CounCil actIons of November 13, and WHEREAS, on December 5, 1990, the City Council conSidered an extension of Ordmance No. 1319 and determmed to adopt Ordmance No. 1321, extendmg the urgency ordmance untIl October, 1991; and WHEREAS, on February 20, 1991, the Planmng CommIssion conducted a Study Session to receive cItIzen mput regardmg the Issue of expansion of non- C IWPSlIREM>IZ'rA92-S PCRILWI07-IO-92 WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, Planning Comml.S1on Resolunon No 92 - 2 4 Zone Text Amendment 92-5 conformmg uses, receiVed public comments from five persons, and determmed to schedule an additional study sessIOn; and on March 6, 1991, the Planmng Comnusslon conducted a Study SesSlon to further consider the issue, receiVed a staff proposal which would establish separate standards for smgle family/duplex structures and for tnplex or larger structures, receIVed public comments from five persons, and continued the study session to March 20, 1991; and on March 20, 1991, the Planmng Commission continued the Study SesSion, received additional public comments from seven persons, and requested the Department of Development Services to distill the public and Commission comments and prepare a report for the Commission as time allows; and on May 15, 1991, the Planmng Commission conducted a Study SessIOn regardmg the enlargement of non-conformmg reSldentIaI structures, considered additional mformatlOn prepared by staff, received public comments from five persons, and mstructed staff to prepare two to three alternatives for consideration by the City CounCil and Planmng Commission at a Jomt Study SesSIOn, and on December 19, 1991, the Planmng Commission conducted a Study Session, received proposals submitted by staff, and requested the City Council to schedule a Jomt Study Session to diSCUSS thiS Issue; and on January 13, 1992, the CIty CounCil considered the request of the Plannmg Commission for a Jomt Study SessIOn, and determmed to schedule February 19, 1992, for that purpose, and on February 19, 1992, the City Council and Planmng CommissIOn conducted the Jomt Study SeSSIOn, conSidered two alternative proposals from staff, receiVed public comments from mne persons, and proVided direction to staff for additional provIsions to be mcluded m the necessary zone text amendment proposal for public heanng, and C IWPSIIRESOIZTA92-5 PCRILWl07-IO-92 2 '. Text ,u,.,ndmenl 92-5 the City IS proposmg to establish new reqUirements and cnteria for the enlargement or structural alteration of non-confomllng resIdential structures, and the subject zone text amendment would apply to all non-confonmng resIdential structures wlthm the City; and the proposed Zone Text Amendment IS Categoncally Exempt from the proViSions of the California Environmental Quality Act (CEQA> pursuant to Section 15301(a), (d) and (e), and Section 15305; and a duly noticed public heanng was held on July 15, 1992 to conSider Zone Text Amendment 92-5; and the Sllld Commission held Sllld aforementioned Public Heanng; and at Sllld public heanng there was oral and wntten testimony and eVidence received by the Planning Commission, and the Planning Commission makes the followmg findmgs 1 The proposed Zone Text Amendment Will allow for less rntenslve expansion of non-conformmg structures than IS presently allowed under current regulations. 2. This proposal Will result m completion of a city study which was Initiated m November, 1990, but not finalized until adopoon of the proposed Zone Text Amendment 3 ThiS proposal Will allow for the expansIOn of non-confonmng structures, subject to more restnctlve conditions and reqUirements than currently eXist. 4 Tlu.s proposal Will lllmt and discourage proposals for major expansIOn of multIple-family non-conformmg reSidentIal structures by requmng the provIsion of a minimum of one off-street parkmg space per dwelling Unit.
