A RESOLUTION OF TIIE PLANNING
COMMISSION OF THE CITY OF SEAL BEACH
RECOMMENDING TO TIIE CITY COUNCIL
APPROVAL OF ZONING TEXT AMENDMENT
92-4, AMENDING SECTIONS 28-1l55(b)(4),
AMENDING TIlE MINIMUM REISDENTIAL
SIDE YARD SETBACK TO THREE (3) FEET
WITHIN TIlE LIMITED COMMERCIAL ZONE
(L-C)
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH
DOES HEREBY RESOLVE:

on December 9, 1991, the City Councll approved General Plan
Amendments 2A-91 and 2B-91, Zone Text Amendment 4-91 and
Zone Change 2-91, creatmg the Lumted Commercial Zone, and
the Limited Commercial zone permitted seTVlce type commercial uses
on the first and second floors With reSidential uses permitted on the
second and thud floors, and
the required reSidential Side yard setback was ten percent (10%) of
the lot Width, and
the first development plan reViewed by the Planmng Commission
proposed 3' Side yards, and the Code reqUired 6 25' Side yard setbacks,
and
a request was made by the project proponent for the Planmng
Commission to reconsider the adopted reSidential Side yard setback
requuement, and
the subject zone text amendment would apply to all properties WIthm
the City which are currently zoned or would be zoned m the future as
"LlDllted Commercial" withm the Gty; and
the proposed Zone Text Amendment IS WIthm the scope of NegatIve
Declaration 8-91, which was approved by the City Council on
December 9, 1991, and
a duly noticed public heanng was held by the Plannmg Commission
on July 1, 1992 to consider Zone Text Amendment 92-4; and
the said CommISSion held saId aforementioned Public Hearing, and
at said public heanng there was oral and wntten testimony and
eVidence received by the Plannmg Commission, and
the Planning Commission makes the followmg findmgs
1 The proposed Zone Text Amendment will amend the
reSidential Side yard setback requirement WIthm the Limited
Commercial zone (L-C), from 10% of the lot WIdth to three
feet (3')
2. This proposal WIll not result many slgmficant adverse Impacts

3. ThIs proposal IS within the scope of Negative DeclaratIOn 8-91,
whIch was approved by the City CouncJi on December 9, 1991
4 The proposed amendment will proVIde adequate hght and
vntJiatlon, separatIon, and privacy.
5 Due to the umque CIrcumstances of the Lmuted CommerCial
zone, with resIdences allowed to be located only on the second
and third floors, the proposed resIdentIal side yard setback IS
III accordance WIth commumty standards for dwellIng umts in
the adjacent reSIdentIal areas
NOW, THEREFORE, BE IT RESOLVED that the Planning CommIssIon
of the CIty of Seal Beach does hereby recommend approval of Zone Text Amendment 92.4
to the City CouncIl, as attached hereto as "ExhibIt A".
PASSED, APPROVED AND ADOPTED by the Planning CommISSion of
the CIty of Seal Beach at a meeting thereof held on the ftrst day of July, 1992, by the
followmg vote.
