A RESOLUTION OF THE PLANNING
COMMISSION OF THE CITY OF SEAL BEACH
RECOMMENDING TO THE CITY COUNCIL
APPROVAL OF ZONE TEXT AMENDMENT 92-
3, AMENDING SECTIONS 28-300(2)(k), 28-2000
AND 28-2002(1), RENAMING THE PUBLIC
LAND USE ZONE TO THE PUBLIC LAND
USE/RECREATION ZONE AND AMENDING
THE PERMITTED USES OF SAID ZONE
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH
DOES HEREBY RESOLVE:

the CIty Councd requested that SectIOn 2002(1) of the Code of the
CIty of Seal Beach be amended to mclude open space and parks as
permItted uses, and
on December 4, 1991, the Plannmg CommIssIon conSIdered thIS
proposal as part of Zone Text Amendment 91-5 and recommended
approval of the subject request; and
on January 13, 1992, the CIty Councd conSIdered the recommendatIon
of the Plannmg CommIssion relatmg to ZTA 91-5, and determmed to
request further amendments to the Pubhc Land Use Zone, refernng
that portIon back to the Plannmg Comnnsslon for further
consideratIon and amendment, and
the CIty is proposing to rename the Pubhc Land Use (PLU) zone to
the Public Land UselRecreatIon (PLUIR) zone and amend the
permItted uses to mclude open space and parks, and
the subject zone text amendment would apply to all propertIes Wlthm
the City whIch are currently zoned or would be zoned m the future as
"Pubhc Land UselRecreatIon" within the CIty, and
the proposed Zone Text Amendment is Categoncally Exempt from
the prOVISIons of the CalIforma EnVIronmental Quahty Act (CEQA)
pursuant to SectIon 15305, and
a duly notIced public heanng was held by the Planmng CommiSSion
on July 1, 1992 to conSIder Zone Text Amendment 92-3, and
the saId CommISSIon held saId aforementioned PublIc Heanng, and
at saId publIc heanng there was no oral or wntten testImony or
evidence received by the Plannmg CommIssIon, and
the Planmng CommISSIon makes the followmg fmdmgs
1. The proposed Zone Text Amendment WIll clarify that
recreatIonal and open space uses are permItted wlthm the
PublIc Land UselRecreation zone
2 ThIs proposal wdl result ID c1anfIcatIon by both amendmg the
name of the Pubhc Land Use zone and the permItted uses to

clearly IOdlcate the recreation and open space are also deSIred
and allowable land uses wlthm the subject zone
3. ThIs proposal IS CategorIcally Exempt from the proVisIons of
the CalIforma Environmental QualIty Act (CEQA) pursuant to
Sectton 15305
NOW, THEREFORE BE IT RESOLVED that the Plannmg CommIssIon
of the CIty of Seal Beach does hereby recommend approval of Zomng Text Amendment
92-3 to the City CouncIl, as attached hereto as "ExhibIt A"
PASSED, APPROVED AND ADOPTED by the Planmng CommissIOn of
the CIty of Seal Beach at a meettng thereof held on the first day of July, 1992, by the
followmg vote'

SectIon 1 Sectton 28-300(2)(k) of the Code of the Cily of Seal Beach IS amended to
read as follows.
"(k) PLU!R Pubhc Land Use!Recreatlon zone,"
Section 2 "Article 20 Pubhc Land UselRecreatIon Zone"

follows.
Section 28-2000 of the Code of the Cd)' of Seal Beach IS amended to read as
"SectIon 28-2000 Preamble In order to proVIde the protectIon of open space
lands and publIcly used lands WIthIn the Cily, a deSIgnatIon of Public Land
Use/RecreatIon (PLUIR) IS deemed necessary"

SectIon 28-2002(1) of the Code of the Cily of Seal Beach IS amended to read
"Section 28-2002.(1) PublIc parks, parks, open space, green belts, beaches,
pIers, wIldlIfe refuges, tIdal marshlands, bIcycle traIls, nature traIls, flood control
baSInS, flood-control channels, parkIng lots or faCIlItIes, and earthquake buffer
zones;1I
