HomeMy WebLinkAboutPC Res 92-11 - 1992-07-01 , . , RESOLUTION No. 92-11 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING CUP #12-89, A REQUEST TO INDEFINITELY EXTEND PLACEMENT OF TWELVE COIN-OPERATED AMUSEMENT MACHINES WITHIN THE LOBBY OF THE SUPER SAVER CINEMA SEVEN AT 12343 SEAL BEACH BOULEVARD, SEAL BEACH, CA. THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, the Super Saver C1nema Seven Theaters, Inc. is owned by Associated Theaters, Inc. and Lyco Financial, Inc. of EI Paso, Texas; and WHEREAS, the subject property is located within the Rossmoor Business Center; and WHEREAS, the surrounding land uses and zoning are as follows: NORTH SOUTH EAST EST Gould Music Rodger Dunn Golf Shop Rossmoor Center shops Montecito Road parking lot and condominiums about 200' away; and WHEREAS, the Super Saver Cinema Seven possesses a valid city business license for operation of a theater; and WHEREAS, on September 20, 1989, the Planning Commission held a duly noticed Public Hearing to consider CUP #12-89. The Commission approved the request for a period of six months through the adoption of Resolution 1555 subject to revisions; and WHEREAS, on October 4, 1989, the Planning Commiss1on reviewed and adopted the revis10ns to Resolution No. 1555; and WHEREAS, on October 3, 1990, the Planning Commission held a duly noticed Pubic Hearing and extended CUP #12-89 an additional six months by the adoption of Resolution 1592. In conjunction w1th this review, the Commiss1on requested a review of the escalating police problems associated with the theater; and WHEREAS, on April 3, 1991 the Planning Commission held a duly noticed Public Hearing and granted a six month extension of CUP #12-89 subject to conditions by the adoption of Reso1ut1on No. 1592. Staff mistakenly scheduled this matter for a twelve month review; and WHEREAS, on May 20, 1992, the Planning Comm1ssion cont1nued the hearing on CUP #12-89 to June 17, 1992; and WHEREAS, on June 17, 1992, the Plann1ng Commission meeting was canceled due to lack of a quorum, and was held on July 1, 1992; and; WHEREAS, the Planning commission made the following find1ngs: 1. The extension of CUP #12-89 is consistent with the provisions of the City's General Plan which 1ndicates the SUbJect property is to be used for general commercial purposes. 2. The subject property is adequate in size, shape, topography and location to meet the needs of the proposed use of the property. Page 2 ~ Plannlng Commlss1on Resolutlon No. 92-11 only through the purchase of a theater admission to ensure proper usage of the v1deo gaming area. 3. Required adherence to applicable bU1lding and f1re codes ensure there will be adequate water supply and utilities for the proposed use. 4. Required adherence to the conditions of approval, as well as the "video area control method", will ensure proper usage of the video gaming area. NOW, THEREFORE BE IT RESOLVED that the Planning Comm1ssion of the C1ty of Seal Beach does hereby approve CUP #12-89 subject to the following Conditions of Approval: 1. CUP #12-89 is extended indefinitely for the placement of up to twelve (12) coin operated amusement devices at an existing theater at 12343 Seal Beach Boulevard (Super Saver Cinema Seven). 2. Persons shall be allowed to play the mach1nes only after the purchase of a theater adm1ssion ticket. 3. The video game machines shall be turned off upon the closing of the ticket booth for the final shows of the evening, at approximately 10:30 p.m. 4. The on-duty manager of the theater shall monitor the video game area to prevent the loitering of ind1viduals in the lobby. 5. The business license fee for the coin-operated amusement devices be paid to complete the application. 6. With the applicant's consent, the hours of operation shall be between 12:00 p.m. (noon) and 12:00 a.m. (midnight) for the public and between 9:00 a.m. and 12:00 a.m. (midnight) for theater employees 7. No person shall be permitted to play the coin-operated amusement devices during hours when any public or private school is in regular session 1n the c1ties of Seal Beach, Los Alami tos or the unincorporated area known as Rossmoor unless such person I s age is 18 years of more. The theater manager shall require proper identification in cases of doubt. 8 . A sign, not less than three ( 3 ) square feet 1n area, shall be clearly posted at the video game machine area stating that use of the machines is limited to holders of tickets for a theater performance on the premises. 9. A s1gn, not less than six (6) square feet 1n area, shall be clearly posted at the video game machine area stating that use of the machines 1S not permitted by persons under the age of 18 years dur1ng hours when any public or pr1vate school is 1n regular seSS10n in the c1ties of Seal Beach, Los Alamitos or the unincorporated area known as Rossmoor unless such persons I s age is 18 years or more. The theater manager shall require proper 1dentification in cases of doubt. 10. This Conditional Use Perm1t shall not become effective for any purpose unless an Acceptance of Conditions has been completed and returned to the C1ty's Planning Department. J.
