A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF SEAL BEACH APPROVING HEIGHT VARIATION
92-9, A REQUEST TO CONSTRUCT A COVERED,
ROOF-ACCESS STRUCTURE AT 105 SURF PLACE
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE
WHEREAS, on Apn1 20, 1992, Jerry L Greer submitted an applicatIOn for Height Variation
92-9 to the DepartJnent of Development Services on behalf of Thomas E Dutton,
and
WHEREAS, the applicatIOn requests approval of a height vanatlOn for constructIOn of a
covered roof access structure (CRAS) In conJunction With a second story addltJon
to a Single famJly dwelling at 105 Surf Place The proposed CRAS would have
an area of approxJnlately 60 square feet, and
WHEREAS, the subJect property lS legalIy descnbed as Orange County Assessor's Parcel
Number 199-121-32, and
WHEREAS, the subject property IS surrounded to the north, east and south by Single famJly
residences In the Residential Low DenSity zone, (RLD) and the vacant HelIman
Ranch property In the SpeCific Plan Regulatory zone to the west, and
WHEREAS, a duly noticed public heanng was held on May 6, 1992, to conSider Height
VanatJon 92-9, and
WHEREAS, the Planning Commission makes the folIoWlng findings
1 archltecturalIy m keeping WIth the remainder of the structure;
2 In keeping WIth the character and mtegnty of the surrounding
nelghborhood,
3 IS limited to the minimum Size, both vertically and honzontalIy, necessary
to cover the stalfcase, and
4 due to the flat terram In the VICInity of the proposed structure, does not
Significantly lmpalr the pnmary view of any property located Within 300
feet of the subject property
NOW, THEREFORE BE IT RESOLVED that the Planmng CommiSSIOn of the CIty of Seal
Beach does hereby approve of Height Vanatlon 92-9 subJect to the folIoWlng condltJons
1 Height Vanatlon 92-9 IS approved for constructJon of a covered roof-access structure In
excess of the height limit at 105 Surf Place, Seal Beach
2 All constructIOn shall be In substantial compliance WIth the plans approved through
Height VanatJon 92-9
3 ThlS height vanatlon shall not become effectJve for any purpose until the ten (10) day
appeal penod has elapsed
