HomeMy WebLinkAboutPC Res 92-01 - 1992-02-05 . l RESOLUTION NUMBER 92-1 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DENYING VARIANCE 8-91, A REQUEST FOR THE AFTER-THE-FACT APPROVAL OF A NON-PERMITTED 144 SQUARE FOOT ADDITION TO AN EXISTING MULTI-TENANT COMMERCIAL BUILDING LOCATED AT 320 MAIN STREET, SUITE D THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE WHEREAS, on August 9, 1991 Buddmg Inspector Chuck Feenstra Issued a Stop Work Order for 320 Mam Street, SUite D The Stop Work Order was Issued for a non-perrmtted enclosure of an open atnum which constituted a 144 square foot addition to the buddmg, and WHEREAS, on December II, 1991, Laura Webb submitted an application on behalf of Tanning by Tiffany for Vanance 8-91 requesnng after-the-fact applOval of the non-permitted 144 square foot addition, and WHEREAS, speCifically, the applicant has constructed a 12' x 12' room Wlthm the second floor's open atnum Accordmg to the applicant the room IS mtended to be used by hiS daughter for her manlcunng busmess The room presently used for manlcunng, at the rear of the SUite, will be used for storage Staff has adVised the applicant that recent vanance requests for 323 MaID Street and 101 Mam Street which requested additIOns of storage areas were denied based on a findmg that storage space should be conSidered the same as retad space for parkmg purposes, and WHEREAS, the subject property IS legally descnbed as Lot 20 and the northerly 1924 feet of Lot 18, Block 209, Bay View Tract, Seal Beach and IS located on the easterly Side of Mam Street, approximately 450 feet southerly of the center of the mtersectlOn of Mam Street and PaCific Coast Highway, and WHEREAS, the subject property measures approximately 44 24' x 117 5' WIth an area of approximately 5198 2 square feet, and WHEREAS, the subject property received Vanance 11-84 allowmg the construction of a 5,295 square foot mixed use commercial buddmg WIth 26 m-lIeu parkmg spaces Based upon thiS vanance, the subject property nunlmally met all proVIsions of the zoning code, and WHEREAS, the surroundmg land uses and zoning are as follows NORTH, SOUTH & WEST A mixture of commercial uses m the Service Commercial zone, (C-1) EAST A mixture of smgle-famlly and mu1n-famlly dwellmgs m the Resldenna1 High DenSity zone, (RHD) WHEREAS, the Planning CommiSSion makes the follOWIng findmgs 1 There are no speCial circumstances applicable to the property at 320 Mam Street, SUite D WhiCh, through the Strict application of the zOning code, depnve the property of pnvlleges enjoyed by other properties m the same VICInity and zone C IAMIPROIDOCS\VAR\R91-8 BCC be .. Plannmg Commission Resolution 92- I Vanance 8-91 Specifically, the subJect property IS permitted 300 square feet of gross floor area per each parkmg space as are all other properties m the same VICInity and zone 2 The grantmg ofVanance request 8-91 would constitute the grannng ofa special pnvdege mconslstent with other limitatIOns upon other propemes m the same vicmlty and zone Specifically, other propernes m the same VICInity and zone are allowed 300 square feet of gross floor area per each parkmg space NOW, THEREFORE BE IT RESOLVED that the Planning Commlsslon of the City of Seal Beach does hereby deny Vanance request 8-91 PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal Beach at a meetmg thereof held on the 5th day of February, 1992, by the follOWIng vote AYES Commlssloners Flfe.
