AUTOMOBILE SERVICE STATION AT 12541 SEAL BEACH BOULEVARD, SEAL BEACH THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY FIND AND RESOL VB Section I On July 14, 1993, Robert FISCUS & ASSOCiates ("The Applicant") filed an applicatIOn for CUP 93-11 With the Department of Development SeTVlces The applicant seeks to remodel an eXIsting automobile service statIon at 12541 Seal Beach Boulevard, Seal Beach Remodel to consIst of relocatIon of eXIsting sales area to the mtenor and replacement of s]gnage The applicant IS proposmg to add approximately 170 square feet to the eXisting structure SectIOn 2 Pursuant to 14 Calif Code of Regs ~ 15025(a) and ~ II A of the City's Local CEQA GUIdelines, staff has detenmned as follows The application for CUP No 93-11 IS categoncally exempt from review pursuant to the California EnvlTonmental Quality Act pursuant to 14 Calif Code of Regs ~ 15301 (Exlstmg Uses), because the applicatIon IS for an exlstmg use wluch IS not expandmg m excess of 50% of the floor area of the structure before the additIOn, or 2,500 square feet, and, pursuant to ~ I 5061 (b)(3), because It can be seen With certamty that there ]S no pOSSibility that the approval may have a SIgnificant effect on the environment SectIon 3 A duly notIced public heanng was held before the Planning CommISSion on August 18, 1993 to conSider the application for CUP No 93-11 The applicant spoke m favor of thIs request with no persons speakmg In oppOSItIon SectIon 4 The record of the heanng on August 18, 1993 mdlcates the followmg (a) On July 14, 1993, Robert FISCUS & ASSOCiates filed an applicatIon for CUP 93-11 WIth the Department of Development Services (b) SpeCifically, the applicant IS proposing to remodel an eXlstmg automobile service station at 12541 Seal Beach Boulevard, Seal Beach The proposed remodel WIll consIst of relocatIOn of eXlstmg sales area to the mtenor and replacement of slgnage The applicant IS proposmg to add approximately 170 square feet to the eXlstmg structure (c) The City of Seal Beach has adopted speCific servIce statIOn performance standards to apply to new or remodeled seTVlce stations (Sec 28-2318) These standards attempt to cover the speCIfic actIVItIes mherent With an automobIle operatIon and minimIZe the adverse effect on surroundmg properties (d) The subJect property IS legally descnbed as Orange County Assessor's Parcel Number 086-492-13 (e) The subJect property IS a rectangular shaped parcel and, as shown m the sIte plan submItted, contams approxImately 29,000 square feet m land area With approximately 125 feet offrontage on Seal Beach Boulevard and approximately 173 feet offrontage on St Cloud Dnve contammg three (3) lube bays and three (3) pump Islands (e) The surroundmg land use and zoning are as Planmng COmmIssIOn approved V AR 4-72, penruttlng a second pole SIgn on the property (g) The appbcant IS not requestmg to establish a "mini-mart" In conjunction WIth tlus request The applicant IS proposing to sell only mCldental motonst services and supplies WIth the maJonty of the expanded area bemg used as a waIting area for service customers (h) The subject service station does not operate between the hours of2 00 a m and 6 00 am, nor IS It proposing an extensIOn of operating hours at thIs time (I) The City received no wntten comments respondmg to the notIces of the heanng on CUP No 93-11 Section 5 Based upon the facts contained In the record, mcludlng those stated In ~ 4 oftlus resolutIOn, and pursuant to ~~ 28-2503 and 28-2504 of the City's Code, the Planning CommISSion hereby finds as follows (a) Conditional Use Permit 93-11 IS consIstent WIth the prOVISIons of the Land Use Element of the City's General Plan, whIch provides a "general commercIal" deSignation for the subject property and permits automobile seTVIce statIons The use IS also consistent With the remammg elements of the City'S General Plan as the poliCies of those elements are consistent With, and reflected m, the Land Use Element Accordmgly, the proposed use IS consistent With the General Plan (b) Staffmspected the subject property on August 4, 1993, and found that the service station meets all requIrements of the Code (c) The building and property at 12541 Seal Beach Boulevard are adequate m Size, shape, topography and locatIon to meet the needs of the proposed use of the property (d) ReqUIred adherence to applicable bUilding and fire codes ensure there Will be adequate water supply and utilities for the proposed use (e) The subJect service statIon has been operating on the subject property for over 20 years With no history of extraordinary demands for police services or of nUisance complamts from nelghbonng reSidents SectIOn 6 Based upon the foregOing, the Planning CommIssion hereby approves CondItIOnal Use Permit 93-11, subJect to the follOWing condItIons I ConditIonal Use Permit 93-11 IS approved for the remodel of an eXisting automobile service station at 12541 Seal Beach Boulevard, Seal Beach The proposed remodel Will consIst of relocatIon of eXIsting sales area to the mtenor and replacement of slgnage The applicant IS proposing to add approxImately 170 square feet to the eXlstmg structure 2 That all development be m substantIal accordance WIth the plans submitted 3 The sales area adJacent to the cashIer area shall be utilized solely for the supply of goods and seTVIces generally required In operation and maintenance of automobile vehicles and fulfillIng of motonst automotIve needs and other of inCidental motonst services and products as requIred m shall subnut a landscapmg plan for approval to the Department of Development SeTVlces pnor to finaJ approval of the proJect Included m the plan shall be addltlonallandscapmg along the northerly sIde of the structure as mdlcated m Exhibit A 6 The applicant shall submit a slgnage plan for approval to the Department of Development Services pnor to final approval of the project 7 The landscaped area located at the southeasterly corner of the property shall cleaned and replmted m accordance WIth ~28-2318(1O) of the Code 8 All lIghtmg shall be dIrected away from nelghbonng propertIes and confined to the subject property Llghtmg plan shall be reviewed and approved by Development Services Department 9 DIsplays of merchandIse shall not be located further than five (5') feet from the service station buIlding 10 The sIte shall be mamtamed m a litter-free state as mandated by Section 28-2318(10)(f) of the Code of The CltV of Seal Beach II The service station shall not operate between the hours of 2 00 a m and 6 00 a m 12 ThIS conditIOnal use penmt shall not become effective for any purpose unless an "acceptance of conditions" form has been sIgned by the applIcant and property owner, notanzed or sIgned before a City staff member subJect to proper Identification, and returned to the Department of Development Services, and until the ten (10) day appeal penod has elapsed 13 The Planning ComnusslOn reserves the nght to revoke thiS conditIOnal use penmt If any VIolation of these conditIOns or the Code of the CltV of Seal Beach occurs 14 A new CondItional Use PermIt shall be obtlllned when any of the followmg occur (a) proposed expanSIOn of use on the premises, (b) remodeling or reconstruction of the eXlstmg facIlities (c) proposal to operate between the hours of2 00 a m and 6 00 a m 15 The parkmg area shall be stnped to prOVIde a mInimum of eight (8) standard parkmg spaces PASSED, APPROVED AND ADOPTED by the Planning CommissIon of the CIty of Seal Beach at a meetmg
