A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH RECOMMENDING TO THE CITY COUNCIL APPROVAL OF A TRAILER SPACE ADJUSTMENT BETWEEN SPACE #46 AND SPACE #45 WITlllN THE SEAL BEACH TRAILER PARK THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY FIND AND RESOL VB Section I On July 16, 1993, Jack Battersby ("The Applicant") submitted an applicatIOn for Trailer Space Adjustment 93-1 to the Department of Development SeTVlces The applicant IS proposmg to perfonn a trader space adjustment wlthm the SeaJ Beach Trader Park SectIOn 2 Pursuant to 14 Calif Code of Regs ~ 15305 and ~ II B of the City's Local CEQA GUidelines, staff has detennmed as follows The applicatIOn for Trailer Space AdJustment 93-1 IS categoncally exempt from reVIew pursuant to the Callfonua EnVIronmental Quality Act pursuant to 14 Calif Code of Regs ~ 15305 (Mmor Alterations m Land Use Lnrutatlons), because It consists of mmor alteratIOns m land use limitatIOns m areas WIth an average slope ofless than 20%, which do not result In any changes m land use or denSIty, mcludmg , mmor lot lme adjustments, and, pursuant to ~ 15061(b)(3), because It can be seen WIth certamty that there IS no pOSSibIlity that the approvaJ may have a slgmficant effect on the enVIronment SectIOn 3 A duly notIced public heanng was held before the Planning COlIllTllSSlOn on August 18, 1993 to conSider the applicatIOn for Trader Space AdJustment 93-1 No wntten evIdence was submitted for or agamst the project At the public heanng the applicant and ~ people spoke m favor of the request and 3. people spoke m opposItion SectIon 4 The record of the heanng on August 18, 1993 mdlcates the followmg (a) On July 16, 1993 Jack Battersby submitted an application for Trader Space AdJustment 93-1 requestmg to perfonn a trader space adJustment WItlun the Seal Beach Trader Park (b) The proposed trader space adjustment wlll result m one space wlthm the trailer park (#46 RIVersea) gaInIng approximately 4 75 feet m Width from the adJacent space at #45 & #44 RIversea ( c) The proposed trader space adJustment IS the first such adJustment to be conSIdered by the City smce It began enforcmg trailer space lines m 1992 (d) The IS surrounding land uses and zOning are as follows North - South - East - West - the Oakwood Apartments located Ion the ReSidential High DenSity (RHO) zone, the RIverbeach Townhomes located m the RHD zone, the San Gabnel RIver located wlthm the CIty of Long Beach, and an oll separatIOn faCIlity located m the Od ExtractIOn (O-E) zone (e) The City has received no responses, wntten or other, to ItS malled notice regardmg Traller Space AdJustment 93-1 SectIOn 5 Based upon the facts contamed m the record, mcludmg those stated m ~ 4 of this resolution, and pursuant to Chapter 21 of the City's Code, the Planning CommISSion hereby finds as follows C\AMlPRO\DOCS\MISC\R1V11 BCCbc . . . , Plannmg ConunlSlllOD RC'lolutlOD No 93- 1.1'1.- (a) The proposed traIler space adJustment IS consistent with the applicable General Plan and zOning designations whIch designate the subject property as high densIty resIdential with a densIty of960 square feet per dwellmg Unit (b) The design of the trailer space adJustment IS not likely to cause public health problems because all utilities and services necessary to serve the sIte are currently m place (c) (Section 15305) The lot lme adJustment IS categoncally exempt from CEQA revIew (d) The lessee's of both affected spaces, as well as the owner of the traIler park, have consented to the proposed space adJustment SectIOn 6 Based upon the foregomg, the Planning Commission hereby recommends approval of TraIler Space AdJustment 93-1 to the City CouncIl, subJect to the followmg conditIons I TraIler Space AdJustment 93-1 IS approved for a traIler space adJustment wlthm the Seal Beach TraIler Park The proposed adJustment wIll result m one space (#46 Riversea Road) gammg approxImately 4 75 m Width from the adjacent double space (#44 & #45 RIversea Road), as Illustrated m ExhibIts A & B 2 Once all required City approvals have been obtamed, the applicant shall record the traIler space adJustment With the County Recorder PASSED, APPROVED AND ADOPTED by the Plannmg Commission of the CIty of Seal Beach at a meetmg thereof held on the 18th day of August, 1993 by the followmg vote AYES CommIssIoners \)Ao-\l,w\~ LA..v ~ >tAR.1' <;..... ~IA 1\ I J NOES CommIssioners ABSENT CommIssIoners L- ~d4~ Anton Dahlman, Chamnan Planning CommissIon ~e Wlnttenberg, Secretary Planning CommiSSIOn / C \AMIPRO\Df..)(,J,\MISC\RTh93 I BC..C be Page 2
