A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
SEAL BEACH APPROVING HEIGHT V ARIA TION 93-2, A REQUEST TO
PERMIT AN EXISTING COVERED, ROOF-ACCESS STRUCTURE AT
705 SOUTHSHORE DRIVE, SEAL BEACH
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY FIND
AND RESOLVE
Section 1 On September 3, 1992, George D Henderson ("The Applicant")
med an application for Height Variation 93-2 with the Department of Development Services The
applicant seeks approval for an eXIsting covered roof access structure (CRAS) in conjunction with
a single family dwelling at 705 Southshore, Drive, Seal Beach
SectIon 2 Pursuant to 14 Calif Code of Regs ~ 15025(a) and ~ II B of the
CIty'S Local CEQA Guidelines, staff has determined as follows The application for Height
Variation 93-2 is categorically exempt from review pursuant to the California Environmental
Quality Act pursuant to 14 Calif Code of Regs. ~ 15301 (Existing Uses), because it involves the
negligible expansion of an existing use, pursuant to ~ 15305 (Minor Alterations in Land Use
Limitations), because the proposal involves a minor alteration in a land use limitation and does not
involve either a property in excess of 20% slope or a change in land use or density, and finally,
pursuant to ~ 15061(b)(3), because it can be seen with certainty that there is no pOSSibility that the
approval may have a significant effect on the environment
SectIon 3 A duly noticed public hearing was held before the Planning
Commission on April 7, 1993 to consider the application for Height Variation 93-2
Section 4
The record of the heanng on April 7, 1993 indicates the following.
(a) On September 3, 1992, George D Henderson filed and application for
Height Variation 93-2 with the Department of Development Services
(b) The apphcation requests after-the-fact approval ofa height variation for an
existing covered roof access structure (CRAS) at 705 Southshore Drive The existing CRAS has
an area of approximately 133 5 square feet
(c) This application was submitted to comply with the requirements of City
Ordinance 1322 which set forth new standards for the construction and maintenance ofCRAS's
Wlthln the City Ordinance 1322 requires that a property owner of an existing CRAS apply to the
City for a Height Variation if their existing CRAS does not conform to the new standards
(d) The existing CRAS at 705 Southshore Drive exceeds the maximum area of
62 25 square feet necessary to cover the rectangular stairwell
(e) The subject property is legally described as Orange County Assessor's
Parcel Number 199-161-01
(f) The subject property is surrounded on all sides by Single family reSidences
in the ReSIdential Low DenSIty zone (RLD)
(g) A duly noticed public hearing was held on April 7, 1993, to consider
Height Variation 93-1
(h) At the public hearing on Height Variation 93-2 evidence was presented for
the requested after-the-fact height variation

Section 5 Based upon the facts contained in the record, including those stated in
~ 4 of this resolution, and pursuant to ~~ 28-2407 and 28-701 of the City's Code. the Planning
Commission hereby finds as follows
(a) Height Variation 93-2 is consistent with the provisions of the Land Use
Element of the City's General Plan, which provides a "low density residential" designation for the
subject property and permits single family reSidential uses The use is also consistent with the
remaining elements of the City's General Plan as the policies of those elements are consistent with,
and reflected in, the Land Use Element Accordingly, the proposed use is consistent with the
General Plan
(b) The existing CRAS is architecturally in keeping with the remainder of the
structure, with the roofing materials and siding matching those of the remainder of the structure.
(c) The eXisting CRAS is in keeping with the character and Integrity of the
surrounding neighborhood
(d) The eXIsting CRAS was constructed in accordance with the plans approved
through Building Permit 1282, issued on May 17, 1989
(e) The eXisting CRAS exceeds the minimum horizontal dimensions necessary
to cover the stairwell, however, due to the configuration of the stairwell, no habitable living space
is provided within the structure
(f) Due to the relatively flat terrain in the Vlclmty of the proposed structure, It
does not significantly impair the primary view ofany property located within 300 feet of the
subject property
Section 6 Based upon the foregoing, the Planning Commission hereby
approves Height Variation 93-2, subject to the following conditions
1 Height Variation 93-2 is approved for an existing covered roof access structure at 705
Southshore Drive
2 The subject covered roof access structure may be maintained in its existing configuration,
but may not be expanded or modified Without Planning CommiSSIon approval
PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal Beach
at a meeting thereof held on the 7th day of Apn1, 1993 by the following vote
