Minutes Agenda Item 6 Seal Beach, California March 09, 2009 The City Council of the City of Seal Beach met in regular session at 7:00 p.m. with Mayor Shanks calling the meeting to order with Councilman Antos leading the Salute to the Flag. AYES: Antos, Levitt, Miller, Shanks, Sloan NOES: None Motion carried PRESENTATIONS/RECOGNITIONS ty Coping with the Urban Coyote - AlertOC After-Action Report (Chief Kirkpatrick) Chief Kirkpatrick's presentation is shown on SBTV3. The Chief thanked everyone for their participation in the annual Polar Plunge - it was very successful. ORAL COMMUNICATIONS Mayor Shanks declared Oral Communications to be open. Speakers: Bill Ayres, Seal Beach 5K/10K Run Committee, reminder everyone the event is April 4th and proceeds are given as grants in the area of physical fitness and wellness; Seth Eaker, Seal Beach Chamber/13th Street, encouraged council to discuss the future economic development of Seal Beach; Eldon Alexander, 8th Street, spoke on item "H" -police recruitment/retention and the Housing Element should include assistance to teachers, fire and police; Robert Goldberg, Clipper Way, commented on item "H" -liked the idea that the City would pay for the academy for young recruits and suggested the City offer low/mod housing for employees; Joyce Parque, 6th Street, stated that receiving federal and state funds usually has draws backs, the Ciry needs to know what their budget is before spending, and suggested that the employee salaries be posted on the website. There were no other speakers; Mayor Shanks declared Oral Communications closed. CITY ATTORNEY REPORT Quinn M. Barrow, Esq., City Attorney No report given. CITY MANAGER REPORT David N. Carmany, City Manager No report given. Page 2 -City Council 03/09/09 COUNCIL COMMENTS Councilman Levitt -spoke about the fire that occurred in Leisure World and how the City and Golden Rain Foundation are cooperating to expedite the rebuilding of the units -would like to see the City have a policy for anyone in the City that would need the same assistance; Councilman Miller -indicated that it would be helpful if: 1) staff summarize the key points in the agreements/contracts; 2) provide redline versions; and 3) detail in the budget what is pulled out and what is added -also inquired about the status of the summer programs and the trees being planted along the freeway; Councilman Antos -announced the restoration of Seal Beach Red Car is almost completed; Mayor Shanks -announced that the streets in the Bridgeport area will be slurred and the residents should watch for the signs indicating when their streets will be done -liked the idea of offering low/mod housing to employees. COUNCIL ITEM ITEM "A" /CITY FINANCIAL CONTROL PROCEDURES /TRAVEL POLICY REIMBURSEMENT (Miller) Councilman Miller stated that the travel reimbursement policy should reflect the practice -should either use actual miles traveled or map quest. The City Manager presented the staff report giving the background for the changes in the City Financial Control Procedures. Councilman Miller said he has no problems with the procedures but believes there are inconsistencies in the practice of mileage reimbursement. Mayor Shanks commented that this appears to be only a concern for one councilmember and asked for a motion to receive and file the report. Sloan moved, second by Levitt, to receive and file the staff report as presented. AYES: Antos, Levitt, Miller, Shanks, Sloan NOES: None Motion carried CONSENT CALENDAR Sloan moved, second by Levitt, to approve recommended actions for the items on the Consent Calendar as presented. F. Adopted Resolution No. 5844 entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH AWARDING THE BID FOR 2009 ANNUAL SLURRY SEAL PROJECT NO. ST0911". Adopted Resolution No. 5845 entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDED PROFESSIONAL SERVICES AGREEMENT WITH CIVICSTONE, INC., TO IMPLEMENT THE COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM WITHIN LEISURE WORLD". (CDBG -amend effective date -July 1, 2008) ITEMS REMOVED FROM THE CONSENT CALENDAR No items were removed. PUBLIC HEARING No items at this time. UNFINISHED BUSINESS ITEM "H" /POLICE RECRUITING INCENTIVES /RETENTION ISSUES The Police Chief gave the staff report going over the background of the City's current struggle to recruit and retain qualified officers and indicated that he was asking Council to authorize the City Manager to pursue non-traditional recruiting and retention strategies to attract qualified recruits to the department and to retain those employees and police officers in good standing. Amore detailed report will be presented to the Council for final approval. After brief comments from Council -Antos moved, second by Levitt, to receive and file the staff report and approve the staff's recommendation to pursue the possibility of the use of non-traditional strategies in recruiting and retaining employees and officers in good standing in the Seal Beach Police Department. With no objections Mayor Shanks recessed the Council meeting at 8:55 p.m. and reconvened the meeting at 9:06 p.m. JOINT STUDY SESSION /HOUSING ELEMENT /INFORMATIONAL Present: Mayor Shanks, Councilmembers: Antos, Levitt, Miller, Sloan; Planning Commissioners: Erin Bello and John Larson. The Director of Development Services indicated that there was not a quorum for the Planning Commission and those Commissioners not present would listen to the audio tape of the study session and review the staff report and the presentation hand-out. Mayor Shanks announced that the study session is the beginning of a long process and there will be several more meetings for the community to provide their input -this is an informational session for Council and the Planning Commission. The Director of Development Services introduced Mr. John Douglas, consultant from Conexus, who gave an overview of the steps that the City will go through (5 year cycle) to adopt a Housing Element including the general requirements of State law and the anticipated meetings during the preparation -community workshops, Council and Commission review draft, submit draft for State review, public hearings, Council adopt the Housing Element, and submit the adopted Housing Element for State certification (Department of Housing and Community Development - HCD). Mr. Douglas gave an update on recent changes in the Housing Element law: AB 2348 (2004) - Establishes a bench mark for default density of 20 units per acre for lower- income housing (must demonstrate adequate sites); AB 2634 (2006) -Requires Housing Elements to consider the needs of extremely low income households (new income category -county median $27,900); SB 2 (2007) -Stronger planning and zoning requirements for year round emergency (homeless) shelters and transitional and supportive housing (not yet tested in court) -identify at least one zone where permanent emergency shelters are allowed by right and treat Page 4 -City Council 03/09/09 transitional/supportive housing (non-profit agencies) the same as other residential uses of the same type in the same zone; SB 375 (2008) -Address land use and transportation effects on greenhouse gas emissions (future issue) links regional housing needs with transportation planning. Critical aspect is Regional Housing Needs Assessment (RHNA): Mandated by state law and prepared by So. Calif. Association of Governments (SCAG - 6 counties) -Each jurisdiction must accommodate its fair share of the region's housing growth need based on growth trends and local plans; estimated new housing need for each jurisdiction in the income categories and affordable housing costs (rent and home sales) -Seal Beach allocation is 57 new housing units for the 2006-2014 planning cycle. If a jurisdiction cannot demonstrate adequate sites, a program to make additional sites available is required. This is typically accomplished through the rezoning of non-residential land to allow high-density residential use, or through up-zoning of lower-density residential land. The Housing Element will include an analysis of potential sites for housing development that satisfy these criteria, and if necessary, identify options for making adequate sites available commensurate with the City's RHNA allocation. It is important to note that "accommodate" does not require that cities achieve the RHNA allocations for new construction. The law recognizes that cities do not build housing, and those economic conditions, available resources, and developer interest will strongly affect housing production. In recognition of these considerations, the Housing Element focuses on the things local governments have control over, such as zoning, development standards, permit procedures, fees, and programs to encourage housing production. Council and Commission comments: Leisure World should be allowed in meeting the number of low/mod housing; state housing needs should not require all cities and counties to meet the same housing needs; local coastal plan should be done before the housing element; AB 375 should be challenged in the courts; emergency shelters will attract homeless into Seal Beach; SCAG region population and income categories vary in all the cities; Seal Beach does not have a lot of land available; should not let the parks be rezoned for low/mod housing; this is a valid concern for Seal Beach; and can the city jail be designated an emergency shelter. Mayor Shanks stated that Commissioner Larson was excused to leave. The joint study session was adjourned and the Council meeting was reconvened. ADJOURNMENT It was the order of the Chair, with consent of the Council, to adjourn the City Council meeting at 10:33 p.m. to March 23, 2009 at 6:30 p.m. to meet in closed session, if deemed necessary.
