HomeMy WebLinkAboutPC Res 93-01 - 1993-01-06 , ," RESOLUTION NUMBER 93-1 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING MINOR PLAN REVIEW 92-48, PERMITTING THE CONSTRUCTION OF A COVERED ROOF ACCESS STRUCTURE IN CONJUNCTION WITH A MAJOR REMODEU ADDITION TO THE FRONT UNIT OF A DUPLEX LOCATED AT 215'12 TENTH STREET THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY FIND AND RESOLVE' Section] On December 4, 1992, James and Gladys Funk ("The Applicants") filed an application for Minor Plan Review 92-48 with the Department of Development Services The applicant seeks approval of a height variation for construction of a covered roof access structure (CRAS) in conjunction with a remodeVaddition to the front unit of a duplex located at 2]5 and 215'12 Tenth Street Section 2 Pursuant to ]4 Calif. Code of Regs ~ ]5025(a) and ~ II B ofthe City's Local CEQA Guidelines, staff has determined as follows The application for Minor Plan Review 92-48 is categorically exempt from review pursuant to the California Environmental Quality Act pursuant to ]4 Calif Code of Regs ~ ]530] (Existing Uses), because it involves the negligible expansion of an existing use; pursuant to ~ ]5305 (Minor Alterations in Land Use Limitations), because the proposal involves a minor alteration in a land use limitation and does not involve either a property in excess of20% slope or a change in land use or denSIty, and finally, pursuant to ~ ] 506] (b )(3), because it can be seen with certainty that there is no possibility that the approval may have a significant effect on the environment Section 3 A duly noticed public hearing was held before the Planning Commission on January 6, ]992 to consider the application for Minor Plan Review 92-48 Section 4. The record of the heanng on January 6, ]992 mdicates the following (a) On December 4, ] 992, James and Gladys Funk filed and application for Minor Plan Review 92-48 with the Department of Development Services (b) The applicants are requesting approval ofa height variation for construction of a covered roof access structure (CRAS) in conjunction with a remodel/addition to the front unit of a duplex located at 2] 5 and 2] 5'12 Tenth Street (c) The surrounding land use and zoning classifications are as follows NORTH, SOUTH AND EAST A mixture of single family and multi-family dwellings located in the Residential High Density zone, (RHO) WEST A mixture of commercial uses located in the Service Commercial zone (C-]) (d) City has received no written comments responding to the notices of the hearing on MPR 92-48. Section 5 Based upon the facts contained in the record, including those stated in ~ 4 of this resolution, and pursuant to ~~ 28-2407 and 28-70] of the City's Code, the Planning Commission hereby finds as follows (a) Minor Plan Review 92-48 is consistent with the provisions ofthe Land Use Element of the City's General Plan, which provides a "high density residential" designation for the subject property and permits single and multi-family residential uses. Plannmg ComrmSSlon Res.olubon No 93-1 consistent with, and reflected in, the Land Use Element Accordingly, the proposed use is consistent with the General Plan (b) The building and property at 2]5 and 2]5'12 Tenth Street are adequate in size, shape, topography and location to meet the needs created by the proposed use of the property (c) ReqUired adherence to applicable building and fire codes ensures there will be adequate water supply and utilities for the proposed use (d) The proposed CRAS is architecturally in keeping with the remainder of the structure, in keeping with the character and integrity of the surrounding neighborhood, is limited to the minimum vertical size necessary to cover the staircase and, the horizontal dimension, due to the pitch of its roof and location in the middle structure, will have less impact on surrounding land uses than a full height 48 square foot "L" shaped CRAS, and due to the flat terrain in the vicinity of the proposed structure, does not significantly impair the primary view of any property located within 300 feet of the subject property Section 6 Based upon the foregoing, the Planning Commission hereby approves Minor Plan Review 92-48, subject to the following conditions' ] Height Variation 92-48 is approved for construction of a covered roof-access structure in excess of the height limit at 2]5'12 Tenth Street, Seal Beach 2 Triangular windows shall be installed on both the east and west sides of the CRAS The hypotenuse of the triangular windows shall parallel the pitch of the roof of the CRAS Said windows shall be of glass block to match the proposed rectangular window on the east side of the CRAS 3. The landing at the top ofthe CRAS shall be reduced to the minimum size required by the Uniform Building Code In order to reduce the size of the upper landing, the CRAS door shall be reversed to open outward 4 All construction shall be 10 substantial compliance with the plans approved through Height Variation 92-48 PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Seal Beach at a meeting thereof held on the 6th day of January, ] 992 by the following vote AYES' Commissioners Fife.
