A RESOLUTION OF THE PLANNING
COMMISSION OF THE CITY OF SEAL BEACH
RECOMMENDING TO THE CITY COUNCIL
APPROVAL OF ZONE CHANGE 94-1, CHANGING
THE ZONING TO DEPICT THE INCREASE OF
APPROXIMATELY3.81 ACRES OF "RESIDENTIAL
LOW DENSITY" LAND AND AN INCREASE OF
APPROXIMATELY 0.51 ACRES OF "PUBliC
LAND USE/RECREATION" LAND, AND A
DECREASE OF 4.32 ACRES OF "OIL
EXTRACTION" LAND WITHIN THE CITY AT 99-
101 MARINA DRIVE
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES
HEREBY RESOLVE:
Sectton 1. City staff has recetved dlrectlon from the Planmng CommiSSion,
pursuant to Sectlon 28-2602 of the Code of the City of Seal Beach, to prepare thiS matter for
the appropnate pubhc heanngs, In accordance WIth the provlSlons of State Jaw and local
ordinances The purpose of the proposed General Plan Amendments and Zone Change IS to
(1) Amend the Land Use and HOUSing Elements of the General Plan to change the
land use deslgnatlon from 011 Extractton (O-E) to Low DenSIty Resldenttal (LOR) and
to change the zomng deslgnatton from Oil Extractlon (O-E) to Resldenttal Low DenSity
(RLD) on those portIons of the SIte currently utlhzed for onshore 011 separation faclhtles
by EXXON, and UNOCAL as lessee, and,
(2) Amend the Land Use and HOUSing Elements of the General Plan to change the
land use deslgnatlon from 011 Extractton (O-E) to Pubhe Land Use (PLU) and to change
the zomng deslgnatlon from 011 Extraetlon (O-E) to Pubhe Land UselRecreatlon
(PLU/R) on those portIons of the sIte currently leased by the CIty of Seal Beach and
utlhzed for park and recreatIon purposes
Sectton 2 Pursuant to 14 Cahf Code of Regs, ~ 15025(a) and ~~ II C and
III of the City IS Local CEQA GUIdelines, staff prepared an Imttal Study and a Negatlve
Declaratton, whIch were Circulated for pubhc review and comment from March 3, 1994 to
March 25, 1994, In comphance With the provlSlons of the Callforma EnVironmental QualIty Act
and the City IS Local CEQA GUIdehnes
SectIon 3 A duly notteed publIc heanng was Imtlally advertIsed for Apnl 20,
1994, and continued to June 22, 1994 WIthout receIving any pubhe testimony On June 22, the
Planmng CommIssIon continued the matter to September 7, again Without receiving any publIc
testimony On September 7, 1994 a publIc hearing was held before the Planmng CommISSIOn
to conSider the applIcation, the Imtlal Study and the NegatIve Declaratton At the pubhe
heanng, the Planmng CommISSion receIved both oral and wntten testlmony regarding the matters
under conslderatlon

The record of the heanng mdlcates the follOWing:

(b) The City of Seal Beach IS requesting to change the General Plan
and zonIng designations of the eXistIng properties from 011 ExtractIon (O-E) to Residential Low
DenSity (RLD) and Public Land Use (PLU)
(c) The subject property IS descnbed as Assessors Parcel 199-011-10.
(d) The Site IS located along the north side of Manna Dnve,
Immediately east of First Street. The Site IS Irregular In shape, haVing approximately 910 feet
of frontage on Ftrst Street and 80 feet of frontage on Manna Dnve The Site vanes In depth,
being approximately 240 feet deep along north property line, and approximately 80 feet deep
adjacent to Manna Dnve The site eompnses approximately 4 32 acres
(e) City PlannIng records and bUilding permit records indicate the
subJect property, currently the Site of both EXXON and UNOCAL onshore 011 separatIon
facilitIes which are now non-operatIOnal, had been utIlized for those purposes for over twenty
(20) years. In additIon, the City leases the southerly 0 51 acres of the Site and utIlizes the area
as an extensIOn of Manna Park,
(f) The General Plan and the zOnIng map indicate the subJect area to
be designated for and zoned for "O-E", 011 ExtractIon
(g) The surrounding General Plan Land Use desIgnations, zonIng
deSignations, and current land uses are as follows

received comments back from five (5) agencies The CIty of Long Beach and the Southern
CalifornIa Association of Governments expressed no concern wIth the proposal, The Department
of Conservation - DIVIsion of 011, Gas and Geothermal Resources provided comments regardmg
well and production facility abandonment procedures The County of Orange provided
comments regardmg water quality management plans and the use of best management practices
at the time of a future abandonment, and the Coastal Commission discussed Coastal Act Issues,
Public Land Issues and hazard abatement
(I) No new mformatIon was brought forward dunng the public
comment penod or at the public heanng with regard to potentIal environmental Impacts from
the proJect that was not addressed m the ImtIal environmental assessment.
(J) The proposed zone change IS enclosed as Attachment A and
mcorporated herem by reference
(k) The Planmng Commission has adopted Negative Declaration 94-1,
through the approval of Resolution No 94-35, whtch IS mcorporated herem by reference SlUd
Negative Declaration represents the mdependent Judgement of the City of Seal Beach
Section 5. Based upon the eVidence m the record, mcludmg the facts stated
m fi 4 of tins resolution, and m the envlfonmental documentation prepared m conJunction with
this proJect, and pursuant to ~fi 28-2600 and 28-2602 of the City s Code, the Planmng
Commission hereby finds as follows
(a) The current zomng deSignation of "011 Extraction" IS mappropnate,
gIVen the residentIal and recreatIonal land uses which now surround the subJect property
(b) Zone Change 94-1 IS consistent with the provlSlons ofthe Land Use
Element of the City's General Plan, as amended through General Plan Amendments 94-1 A and
94-1B, which provides "Low DenSIty ResIdentIal" and "Public Land Use/RecreatIon"
deSignatIOns for the subject property and permits smgle famIly residentIal uses on the residential
properties and vanous public land uses, mcludmg park facilitIes, on the public land
use/recreation properties The proposed use IS also consistent with the remlUmng elements of
the City'S General Plan as the policies of those elements are consistent with, and reflected m,
the Lnad Use Element Accordmgly, the proposed use IS consistent with the General Plan, and
will not be detnmental to the short term or long term goals of the City of Seal Beach and are
m the mterest of the public health, safety and welfare.
(c) Zone Change 94-1 will elImmate the contInued Oil extraction land
use deSignation (crude 011 processmg) from the subJect areas of Manna Dnve and FIrst Street
through the change In deSignation from the more mtense land use "011 Extraction" to the less
mtense "Residential Low DenSity" and "Public Land Use" deSignatIOns on both the General Plan
and Zomng Map,
(d) There IS no substantial eVidence m the record which would support
a flUr argument that approval of the proposed zone change, with the reqUired mitIgation
measures, might have a stgmficant environmental Impact
SectIOn 6 Based on the foregomg, the Planmng CommIssion hereby
recommends approval of Zone Change 94-1 to the City Council, as indIcated on Exhibit I,
attached hereto and made a part hereof.
PASSED, APPROVED AND ADOPTED by the Planmng CommissIon of the City of
