RESOLUTION NO. 94-37
A RESOLUTION OF THE PLANNING
COMMISSION OF THE CITY OF SEAL BEACH
RECOMMENDING TO THE CITY COUNCIL
APPROVAL OF GENERAL PLAN AMENDMENT
94-1B, AMENDING TABLE 16 OF THE HOUSING
ELEMENT TO REPRESENT THE INCREASE OF
APPROXIMATELY 3 ,81 ACRES OF "RESIDENTIAL
LOW DENSITY" LAND AND AN INCREASE OF
APPROXIMATELY 0.51 ACRES OF "PUBLIC
LAND USE" LAND, AND A DECREASE OF 4 32
ACRES OF "OIL EXTRACTION" LAND WITHIN
THE CITY
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES
HEREBY RESOLVE:
SectIOn I City staff has receIved direction from the Planmng CommiSSion,
pursuant to Section 28-2602 of the Code of the CIty of Seal Beach, to prepare thIS matter for
the appropnate pubhe heanngs, m accordance With the provIsions of State law and local
ordmances The purpose of the proposed General Plan Amendments and Zone Change IS to
(1) Amend the Land Use and Housmg Elements of the General Plan to change the
land use deSIgnation from OIl Extraction (O-E) to Low DenSIty ReSidential (LOR) and
to change the zomng deSIgnation from 011 ExtractIOn (O-E) to ReSidential Low DenSity
(RLD) on those portions of the site currently utIhzed for onshore 011 separation faclhtles
by EXXON, and UNOCAL as lessee, and,
(2) Amend the Land Use and Housmg Elements of the General Plan to change the
land use deSignatIOn from 011 Extraction (O-E) to Public Land Use (PLU) and to change
the zomng deSignation from 011 ExtractIon (O-E) to Pubhc Land Use/Recreation
(PLU/R) on those portions of the SIte currently leased by the City of Seal Beach and
utIhzed for park and recreation purposes
Section 2. Pursuant to 14 CalIf Code of Regs ~ 15025(a) and ~~ II C and
III of the CIty IS Local CEQA GUldehnes, staff prepared an ImtIaI Study and a Negative
Declaration, whtch were Circulated for pubhc revtew and comment from March 3, 1994 to
March 25, 1994, m comphance With the provtslons of the Cahforma EnVironmental Quahty Act
and the City IS Local CEQA GUldelmes,
Section 3 A duly noticed pubhc heanng was ImtIally advertIsed for Apnl 20,
1994, and eontmued to June 22, 1994 WIthout receIVmg any pubhc testimony On June 22, the
Planmng CommIssIon continued the matter to September 7, agam WIthout recelvmg any public
testimony On September 7, 1994 a public heanng was held before the Planmng CommIssIon
to conSider the appheatlOn, the Imtlal Study and the Negative Declaration At the pubhc
heanng, the Planmng CommIssIon received both oral and wntten teStimony regardmg the matters
under conSideration

(b) The City of Seal Beach IS requestmg to change the General Plan
and zonIng deSignations of the eXisting propertIes from Oil Extraction (O-E) to RestdentIal Low
DenSity (RLD) and Public Land Use (PLU)
(c) The subJect property IS descnbed as Assessors Parcel 199-0II-1O
(d) The site IS located along the north side of Manna Dnve,
Immediately east of First Street The Site IS lltegular m shape, havmg approximately 910 feet
of frontage on Frrst Street and 80 feet of frontage on Manna Dnve. The site vanes m depth,
bemg approximately 240 feet deep along north property Ime, and approximately 80 feet deep
adJacent to Manna Dnve The site eompnses approximately 4.32 acres.
(e) City PlannIng records and bUlldmg permit records mdlcate the
subJect property, currently the site of both EXXON and UNOCAL onshore 011 separation
facilities which are now non-operatIOnal, had been utilized for those purposes for over twenty
(20) years In addition, the City leases the southerly 0,51 acres of the site and utIlizes the area
as an extenSIOn of Manna Park,
(f) The General Plan and the zonIng map mdlcate the subject area to
be deSignated for and zoned for "O-E", Oil Extraction
(g) The surroundmg General Plan Land Use deSignations, zOnIng
designations, and current land uses are as follows

received comments back from five (5) agencies, The City of Long Beach and the Southern
California Assoclalion of Governments expressed no concern With the proposal. The Department
of Conservalion - DIvISion of 011, Gas and Geothermal Resources provided comments regardmg
well and produelion facility abandonment procedures The County of Orange provided
comments regardmg water quality management plans and the use of best management practices
at the lime of a future abandonment, and the Coa~tal CommissIon discussed Coastal Act Issues,
Public Land issues and hazard abatement
(I) No new mformatlon was brought forward dunng the public
comment penod or at the public heanng with regard to potential environmental Impacts from
the proJect that was not addressed m the Imtlal environmental assessment.
(J) The proposed zone change IS enclosed as Attachment A and
mcorporated herem by reference
(k) The Planmng Commission has adopted Negative DeclaratIOn 94-1,
through the approval of Resolulion No. 94-35, which IS meorporated herem by reference Sllld
Negative Declaration represents the mdependent Judgement of the City of Seal Beach
SectIOn 5 Based upon the eVidence m the record, meludmg the facts stated
m ~ 4 of thiS resolution, and m the environmental documentation prepared m conJunction With
thiS proJect, and pursuant to ~~ 28-2600 and 28-2602 of the City s Code, the Planmng
Commlsston hereby finds as follows
(a) General Plan Amendment 94-1 A Will not be detnmental to the short
term or long term goals of the City of Seal Beach and are m the mterest of the pubhc health,
safety and welfare
(b) General Plan Amendment 94-lA will ehmmate the eontmued 011
extraction land use designation (crude oil processmg) from the subJect areas of Manna Dnve and
First Street through the change m designation from the more Intense land use "011 Extraction"
to the less Intense "Residential Low Density" and "Pubhc Land Use" designations on both the
General Plan and Zomng Map
(c) There IS no substantial eVidence In the record which would support
a flllr argument that approval of the application, With the reqUIred mitigatIOn measures, might
have a slgmficant environmental Impact.
(d) The proposed Housmg Element Amendment WIll result m an
Increase of 3 81 acres of Low DensIty Residential land, the Increase of 0.51 acres of Public
Land Use land wlthm the City, and a decrease of 432 acres of Oil Extraction land Within the
City
Section 6 Based on the foregoing, the Planmng Commission hereby
recommends approval of General Plan Amendment 94-18 to the City Council, subJect to the
follOWing condition,
Table 16 of the Housmg Element shall be amended to depict the
Increase of 3 81 acres of Low DensIty Resldenlialland and the
mcrease of 0 51 acres ofPubhc Land Use land wlthm the City and
a decrease of 4 32 acres of Oil ExtractIOn land wlthm the City
PASSED, APPROVED AND ADOPTED by the Planmng Commission of the City of
Seal Beach at a meeting thereof held on the S~ day of
