HomeMy WebLinkAboutPC Res 94-36 - 1994-10-05 , RESOLUTION NO, 94-36 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH RECOMMENDING TO THE CITY COUNCIL APPROVAL OF GENERAL PLAN AMENDMENT 94-1A, AMENDING THE "SUMMARY TABLE OF EXISTING AND PROPOSED LAND USES IN ACRES" OF THE LAND USE ELEMENT TO DEPICT THE INCREASE OF APPROXIMATELY 3.81 ACRES OF "RESIDENTIAL LOW DENSITY" LAND AND AN INCREASE OF APPROXIMATELY 0.51 ACRES OF "PUBLIC LAND USE" LAND, AND A DECREASE OF 4,32 ACRES OF "OIL EXTRACTION" LAND WITHIN THE CITY THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: Sectton 1. City staff has receIved dlrectton from the Planning CommIssIon, pursuant to Sectton 28-2602 of the Code of the CIty of Seal Beach, to prepare thIS matter for the appropnate publIc heanngs, In accordance WIth the proVISIons of State law and local ordInances The purpose of the proposed General Plan Amendments and Zone Change IS to (1) Amend the Land Use and Housmg Elements of the General Plan to change the land use deslgnatton from 011 Extraetton (O-E) to Low DenSIty Resldenttal (LOR) and to change the zOning deslgnatton from 011 Extraetton (O-E) to Resldenttal Low DenSity (RLD) on those portions of the sIte currently utilIzed for onshore 011 separatton faCIlIties by EXXON, and UNOCAL as lessee; and, (2) Amend the Land Use and HOUSIng Elements of the General Plan to change the land use deSIgnation from 011 Extractton (O-E) to PublIc Land Use (PLU) and to change the zoning deSIgnation from 011 Extraetton (O-E) to PublIc Land Use/Recreation (PLU/R) on those porttons of the sIte currently leased by the CIty of Seal Beach and uttlIzed for park and recreatton purposes SectIon 2 Pursuant to 14 CalIf Code of Regs fi 15025(a) and fifi II C and III of the City IS Loca1 CEQA GmdelInes, staff prepared an InItial Study and a Negative Declaratton, whIch were Circulated for publIc revIew and comment from March 3, 1994 to March 25, 1994, In complIance WIth the provISIons of the CalIfornia EnVIronmental QualIty Act and the CIty IS Local CEQA GmdelInes Sectton 3 A duly notIced publIc heanng was InitIally advertIsed for Apnl 20, 1994, and contInued to June 22, 1994 WIthout receIVIng any publIc testtmony On June 22, the Planning CommIssIon contInued the matter to September 7, agaIn WIthout receIvIng any publIc testImony On September 7, 1994 a publIc heanng was held before the Planning CommIssIon to conSIder the applIcation, the Imttal Study and the Negattve Declaratton At the publIc heanng, the PlannIng CommIssIon received both oral and wntten testtmony regardIng the matters under conslderatton. The Site compnses approXimately 4 32 acres (e) City Planmng records and buildIng permit records mdlcate the subject property, currently the site of both EXXON and UNOCAL onshore 011 separatIon facilitIes which are now non-operational, had been utIlized for those purposes for over twenty (20) years In addition, the City leases the southerly 0 51 acres of the SIte and utIlizes the area as an extensIOn of Manna Park. D IWP5I\RI.80IOPA94-1A PCRILWl08-29-94 2 PlanlUnl( Comm"slOn ResolutIOn 94-36 S~ptember 7, 1994 (h) Staff has prepared an ImtIaI enVIronmental assessment and proposed NegatIve DeclaratIon as reqUIred by the California EnVironmental Quality Act (CEQA) Staff received comments back from five (5) agencies The City of Long Beach and the Southern California ASSOCiatIon of Governments expressed no concern With the proposal The Department of Conservatlon - Dlvlston of 011, Gas and Geothermal Resources provided comments regardIng well and productIon facIlity abandonment procedures, The County of Orange provided comments regardIng water qualtty management plans and the use of best management practIces at the Ume of a future abandonment, and the Coastal Commission diSCussed Coastal Act Issues, Public Land Issues and hazard abatement (I) No new InfOrmatIOn was brought forward dunng the publIc comment penod or at the publIc heanng With regard to potentIal environmental Impacts from the proJect that was not addressed In the ImtIaI environmental assessment (j) The proposed zone change IS enclosed as Attachment A and Incorporated hereIn by reference (k) The Planmng Commission has adopted NegatIve Declaration 94-1, through the approval of ResolutIon No, 94-35, which IS Incorporated hereIn by reference SaId Negative Declaration represents the Independent Judgement of the City of Seal Beach SectIon 5 Based upon the eVidence In the record, Includmg the facts stated In ~ 4 of thiS resolutIon, and In the environmental documentatIon prepared In conJunctIon With thiS proJect, and pursuant to ~~ 28-2600 and 28-2602 of the City s Code, the Planmng Commission hereby finds as follows, (a) General Plan Amendment 94-1A Will not be detnmentai to the short term or long term goals of the City of Seal Beach and are In the Interest of the publIc health, safety and welfare, (b) General Plan Amendment 94-lA wIll elImInate the contInued 011 extractIon land use deSIgnatIon (crude 011 processIng) from the subJect areas of Manna Dnve and First Street through the change In deSIgnatIon from the more Intense land use "011 ExtractIon" to the less Intense "ReSIdentIal Low DenSity" and "PublIc Land Use" deSignations on both the General Plan and Zomng Map (c) There IS no substantial eVidence In the record which would support a faIr argument that approval of the applIcatIon, With the reqUIred mitIgation measures, might have a slgmficant enVironmental Impact.
