RESOLUTION NUMBER 94-17 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING MINOR PLAN REVIEW 94-S, PERMITTING A ONE-HUNDRED (100) SQUARE FOOT ADDITION TO THE LIVING ROOM OF A NON- CONFORMING SINGLE-FAMILY DWELLING AT 220 CENTRAL A VENUE, SEAL BEACH THE SUBJECT PROPERTY IS NONCONFORMING DUE TO INADEQUATE SIDE AND REAR SETBACKS FOR THE DETACHED GARAGE THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY FIND AND RESOLVE SectIOn I On May 3, 1994, Dave Bartlett on behalf of JIm and Pat Hagerty ("The Applicants") filed an applicatIOn for Minor Plan ReVIew 94-S WIth the Department of Development SeMces requesting to add approximately one-hundred (100) square foot addlt10n to the liVing room ofa non- conforming Single-family dwelling at 220 Central Avenue, Seal Beach, as authonzed under SectIon 28-2407 of the Code of the City of Seal Beach, (Code) Sectton 2 Pursuant to 14 CalIf Code of Regs ~ IS025(a) and ~ II B of the City's Local CEQA GUidelines, staff has detenmned as follows The application for Minor Plan ReVIew 94-S IS categoncally exempt from reVIew pursuant to tile Callforma EnVIronmental QualIty Act pursuant to 14 Calif Code of Regs ~ IS301 (Existing Uses), because It Involves the negligible expansIOn ofan eXisting use, pursuant to ~ 1530S (Minor AlteratIOns In Land Use LimItatIOns), because the proposal Involves a nunor alteratton In a land use IImltatton and does not Involve either a property In excess of20% slope or a change In land use or denSIty, and finally, pursuant to ~ lS061(b)(3), because It can be seen WIth certainty that there IS no pOSSibility that the approval may have a slgmficant effect on the environment Sectton 3 A duly noticed heanng was held before the Planmng CommiSSIOn on May 18, 1994 to conSider the applicatIOn for MInor Plan ReView 94-S Sectton 4 The record of the hearing on May 18, 1994 Indicates the follOWing (a) On May 3, 1994, Dave Bartlett on behalf of JIm and Pat Hagerty ("The Applicants") filed an application for Minor Plan ReVIew 94-S With the Department of Development Services (b) The subJect property, Orange County Assessor's parcel number 199-142-10, IS located In the Resldenttal HIgh DenSity zone (RHO), on a 25' X 100' lot (2,500 sq ft) The property contains a Single family dwelling (c) The subJect property IS legally nonconformIng due a detached garage located at the rear of the property whtch proVIdes Inadequate SIde and rear setbacks (d) The applicant IS proposing to add approximately 100 square foot to the eXIsting liVIng room at the front of the dwelling (e) The City has received no comments, written or other, responding to the notIces of the heanng on MPR 94-S SectIon 5 Based upon the facts contained In the record, including those stated In ~ 4 of thIs resolution, and pursuant to ~~ 28-2407,28-801 and 28-802 of the City's Code, the Planning Conumsslon hereby finds as follows (a) MInor Plan ReVIew 94-5 IS consistent WIth the proVISIons of the Land Use Element of the CIty'S General Plan, which proVIdes a "high denSIty reSIdentIal" deslgnatton for the subJect property and pernuts Single and multi-family reSidential uses The use IS also consistent 1=1 IMPw.>.., IlCC ~ ~ Planning CommmlOn ResolutIOn No 94-17 May 18, 199-1 . . with the remalmng elements of the CIty's General Plan as the policies of those elements are consistent wIth, and reflected 10, the Land Use Element Accordingly, the proposed use IS consistent WIth the General Plan (b) The bulld10g and property at 220 Central Avenue are adequate In SIze, shape, topography and location to meet the needs of the proposed use of the property (c) ReqUIred adherence to applicable bUIlding and fire codes ensure there will be adequate water supply and utilitIes for the proposed use (d) The proposed use WIll be compatible WIth surround1Og uses and the commuruty In general, because the style, heIght and bulk of the proposed addItIOn IS consIstent WIth surround1Og resIdentIal uses Section 6 Based upon the foregOing, the Planmng Conumsslon hereby approves Mmor Plan ReVIew 94-S, subject to the follow1Og LOndltlOns Mmor Plan Revtew 94-S IS approved for the addItIon of approxImately 100 square feet to the liv10g room ofa nonconform1Og s1Ogle-famlly dwelling at 220 Central Avenue, Seal Beach 2 All construction shall be In substantial compliance WIth the plans approved through MInor Plan ReVlew 94-S 3 ThIS MInor Plan ReView shall not become effective for any purpose unless an "Acceptance of CondItions" form has been slgtled by the applicant 10 the presence of the DIrector of Development Services, or notanzed and returned to the Planmng Department, and until the ten (10) day appeal penod has elapsed PASSED, APPROVED AND ADOPTED by the Planmng CommissIon of the City of Seal Beach at a meet10g thereof held on the 18th day of May, 1994 by the follow1Og vote A YES CommiSSIOners Dahlman.
