RESOLUTION NUMBER 94-16 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING MINOR PLAN REVIEW 94-4, APPROVING ARCffiTECTURAL REVIEW OF THE PROPOSED CONSTRUCTION OF A NEW MIXED USE STRUCTURE AT 233 SEAL BEACH BOULEVARD THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY FIND AND RESOLVE Section I On Apn129, 1994, Frank E Pnor ("The Apphcant") filed an application for Minor Plan ReView 94-4 With the Department of Development SelVlces requestmg Arclutectural reVIew of the proposed construction ofa new mIxed use structure at 233 Seal Beach Boulevard, Seal Beach, as authonzed under SectIon 28-IIS8 of the Code of the CltV of Seal Beach, (Code) Section 2 Pursuant to 14 Calif Code of Regs ~ IS025(a) and ~ II B of the City'S Local CEQA GUIdelines, staff has determmed as follows The applicatIOn for MInor Plan ReView 94-4 IS categoncally exempt from reVIew pursuant to the California EnVIronmental Quality Act pursuant to 14 Calif Code of Regs 9 I 5303(a,c) (New ConstructIOn of Small Structures), because the single famtly dwelling IS not constructed In conJunctIOn With the constructIOn of two or more such structures and, because the commercial structure, In a commercial zone, In an urbanIzed area does not mvolve the use of slgmficant amounts of hazardous matenals, IS deslgtled for an occupant load ofless than 30 persons and IS not constructed m conJunctIon WIth the bUIlding offour or more such structures, pursuant to q 15305 (Minor AlteratIOns m Land Use LumtatlOns), because the proposal mvolves a minor alteration m a land use limItatIOn and does not mvolve eIther a property m excess of20% slope or a change m land use or denSity, and finally, pursuant to 9 IS061(b)(3), because It can be seen WIth cenalnty that there IS no pOSSibIlity that the approval may have a slgtllficant effect on the environment Section 3 A duly noticed hearing was held before the Planmng CommiSSion on May 18, 1994 to conSIder the applicatIOn for MInor Plan ReView 94-4 Section 4 The record of the heanng on May 18, 1994 mdlcates the followmg (a) On Apn129, 1994, Frank E Pnor ("The Applicant") filed an applicatIOn for Minor Plan ReVIew 94-4 With the Department of Development Services (b) The subject property, Orange County Assessor's parcel number 199-062-4, IS located m the Llnuted-Commerclal zone (L-C), on a 75' x 103 49' lot (7,762 sq ft) The property currently contams an anImal clinIC and a vacant lot (c) The apphcant IS proposing to add approximately 100 square foot to the eXlstmg liVIng room at the front of the dwelling (d) The applicant seeks archttectural review of the proposed construction of a new nuxed use structure at 233 Seal Beach Boulevard The proposed first floor of the structure would be 1,217 square foot to be used a commerCIal office, With a two-story 2,696 square foot slngle-famtly reSidence above The proposed structure would prOVide SIX (6) of the seven (7) reqUired parkmg spaces on sIte (e) The CIty has receIved no comments, wntten or other, responding to the notIces of the heanng on MPR 94-4 Section S Based upon the facts contained m the record, Includmg those stated In ~ 4 of thIs resolutIOn, and pursuant to ~9 28-IISO through 28-11S8 of the CIty's Code. the PlannIng CommiSSIon hereby finds as follows C\ \MPr\rIQ.... ace k. , P/annlnK CommllMon RevolutIOn No 9./-/6 May l8, /99./ (a) Minor Plan Review 94-4 IS consistent with the proVISIons of the Land Use Element of the CIty'S General Plan, whIch proVIdes a "hmlted commercIa!" desIgnatIOn for the subJect property and penmts single and multI-famIly reSIdentIal uses as well as first floor commercIal uses The use IS also consistent with the remam10g elements of the City's General Plan as the poliCIes of those elements are consistent WIth, and reflected 10, the Land Use Element Accordingly, the proposed use IS consistent WIth the General Plan (b) The building and property at 233 Seal Beach Boulevard are adequate 10 SIze, shape, topography and location to meet the needs of the proposed use of the property ( c) ReqUired adherence to applicable buIlding and fire codes ensure there WIll be adequate water supply and utIlIties for the proposed use (d) The proposed use wIll be compatIble WIth surround1Og uses and the community In general, because the style, height and bulk of the proposed additIon IS consIstent with surround1Og reSIdentIal uses ( e) The applicant wIll be reqUIred to subdIVIde the property 1Oto two 37 5 foot WIde lots pnor to Issuance of any permits for construction Each resulting lot and structure WIll meet all reqUIrements of the Code, 1Oclud1Og parkmg SectIOn 6 Based upon the foregomg, the Planmng CommIssion hereby approves Mmor Plan ReVIew 94-4, subJect to the follOWing conditIons MInor Plan ReView 94-4 IS approved for the constructIOn of a three story mixed use structure at 233 Sea! Beach Boulevard 2 A Fmal Parcel Map shall be approved and recorded subdlVld10g the subject property Into two 37 5 foot WIde lots pnor to submittal for bUlldmg plan check 3 Pnor to Issuance of any buIldmg permIt for constructIOn In conjunction With thIS proJect, the applicant shall pay a non-subdIVIsion parks and recreatIOn fee of$10,000 for the addItIon of one (1) new dwelling Unit to the CIty'S hOUSing stock pursuant to SectIOn 5-120 4 A mInimum of 199 square feet of landscaping shall be proVided on SIte, as well as an addItIonal 120 square feet oflandscaplng whIch shall be located Wlth10 the reqUired front setback ThIS reqUIrement shall apply to both newly created lots descnbed 10 #2 above 5 The proposed locatIOn of the mechanical eqUIpment shall be relocated to the rear Side of the third floor roof or, Iffeaslble, dIrectly above the garages 6 The eXlstmg anImal cliniC property shall proVide a minImum of SIX (6) on-sIte park10g spaces 7 All constructIon shall be In substantIal compliance WIth the plans approved through MInor Plan ReVIew 94-4 8 ThIS mmor plan revIew shall not become effectIVe for any purpose unless an "Acceptance of CondItIons" form has been SIgned by the applicant In the presence of the Director of Development SeMces, or notanzed and returned to the Planmng Department, and untIl the ten (10) day appeal penod has elapsed Page 2 1=1 IMPRlr.., see...
