HomeMy WebLinkAboutPC Res 94-15- 1994-05-18 I RESOLUTION NUMBER 94-1S A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING MINOR PLAN REVIEW 94-3, PERMITTING THE ADDITION OF NEW 6' X 10' EXTERIOR BALCONY AND SLIDING GLASS DOOR TO A SECOND FLOOR UNIT AT A NONCONFORMING SEVEN-UNIT APARTMENT LOCATED AT 200/202 ISTH STREET THE PROPOSED ADDITION IS IN CONJUNCTION WITH INTERIOR AND EXTERIOR PROPERTY MAINTENANCE OF THE SUBJECT PROPERTY THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY FIND AND RESOLVE SectIOn 1 On Apn120, 1994, Mark Osborn, Archttect on behalf of Charles and Deborah DIckinson ("The Applicants") filed an applicatIOn for Minor Plan ReView 94-3 With the Department of Development SeMces requesting to add a new 6' x 10' extenor balcony and shdlng glass door to a second floor umt at a nonconforming seven-umt apartment located at 200/202 15th Street, Seal Beach, as authonzed under Sectton 28-2407 of the Code of the CltV of Seal Beach. (Code) Section 2 Pursuant to 14 Calif Code of Regs ~ IS02S(a) and ~ 11 B of the CIty'S Local CEQA GUIdelines, staffhas determined as follows The appllcatton for Mmor Plan ReView 94-3 IS categoncally exempt from revIew pursuant to the Callforma EnVIronmental Quality Act pursuant to 14 Calif Code of Regs ~ 15301 (EXIsting Uses), because It Involves the negligible expansion ofan eXisting use, pursuant to ~ 15305 (Minor Alterattons In Land Use LimItatIOns). because the proposal Involves a minor alteratIOn In a land use limitatIOn and does not Involve either a property In excess of20% slope or a change In land use or denSity, and finally, pursuant to ~ IS061 (b )(3), because It can be seen With certainty that there IS no POSSibility that the approval may have a slgmficant effect on the environment SectIOn 3 A duly nottced heanng was held before the Planmng CommiSSion on May 18, 1994 to conSIder the applicatIOn for Minor Plan ReView 94-3 SectIOn 4 The record of the heanng on May 18, 1994 indicates the follOWing (a) On Apn120, 1994, Mark Osborn, Architect on behalf of Charles and Deborah Dickinson ("The Applicants") filed an applicatIOn for Minor Plan ReView 94-3 With the Department of Development SeMces (b) The subJect property, Orange County Assessor's parcel number 199-066-18, IS located In the Resldenttal High DenSIty zone (RHO), on an Irregularly shaped lot (9,600 sq ft) The property contains a seven umt apartment (c) The subJect property IS legally nonconforming due a detached garage located at the rear ofthe property whtch proVides Inadequate SIde and rear setbacks (d) The City has receIVed no comments, wntten or other, responding to the nottces of the heanng on MPR 94-3 SectIOn 5 Based upon the facts contained In the record, including those stated In 94 of this resolutton, and pursuant to 99 28-2407, 28-801 and 28-802 of the City's Code, the Planmng CommISSion hereby finds as follows (a) Minor Plan ReVIew 94-3 IS consIstent With the proVISions of the Land Use Element of the CIty's General Plan, which proVIdes a "high denSIty reSIdentIal" deSignatIOn for the subJect property and permits Single and multI-family reSidentIal uses The use IS also consistent WIth the remaining elements of the City's General Plan as the poliCIes of those elements are .J:\ \MPP\P94~ oce\- . Planning CommISSIOn ResolutlOlI No 9-1-15 May l8, 199.J consistent wIth, and reflected In, the Land Use Element Accordingly, the proposed use IS consistent wIth the General Plan (b) The building and property at 200/202 ISth Street are adequate In Size, shape, topography and location to meet the needs of the proposed use of the property (c) ReqUIred adherence to applicable bUIlding and fire codes ensure there will be adequate water supply and utilities for the proposed use (d) The proposed use will be compatible With surrounding uses and the commumty m general, because the style, height and bulk of the proposed addItion IS consistent With surrounding reSIdential uses SectIon 6 Based upon the foregoing, the Planmng CommISSIon hereby approves Mmor Plan Review 94-3, subJect to the follOWing condItIons 1 Mmor Plan ReView 94-3 IS approved for a new second story balcony In conJunctIOn WIth the rehabIlitatIon of a seven umt apartment at 200 and 202 15th Street, Seal Beach 2 The applicant shall obtain the necessary City permits for all work undertaken In conJunctIOn WIth the proposed rehabIlItatIon 3 All constructIOn shall be In substantial compliance With the plans approved through Minor Plan ReVIew 94-3 4 Thts MInor Plan ReView shall not become effective for any purpose unless an "Acceptance of CondItions" form has been SIgned by the applicant In the presence of the Director of Development Servtces, or notanzed and returned to the Plannmg Department, and until the ten (10) day appeal penod has elapsed PASSED, APPROVED AND ADOPTED by the Planmng CommiSSion of the City of Seal Beach at a meeting thereof held on the 18th day of May, 1994 by the follOWing vote AYES CommiSSioners Dahlman.
