RESOLUTION NUMBER 94-6 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING MINOR PLAN REVIEW 94-1, PERMITTING THE ADDITION OF A NEW EXTERIOR DOOR TO THE FRONT UNIT OF A NONCONFORMING DUPLEX AT 213 7TH STREET, SEAL BEACH THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY FIND AND RESOLVE Section 1 On May 5, 1993, Sherrl Mokhtanan ("The Apphcant") filed an apphcatlOn for Minor Plan ReView 93-5 With the Department of Development Services The apphcant then requested her proposal be continued to allow her to amend the proposed plans The reVIsed plans were submitted to the City In nud-January 1994 With the request being renumbered to Minor Plan ReView 94-1 Specifically, the apphcant IS propOSing to add a new extenor door at the front of the front Unit ofa nonconforming duplex at 213 7th Street, Seal Beach The apphcant IS requestIng approval of a minor structural alteratIOn to a legal nonconforming property as authonzed under Section, as authonzed under Section 28-2407 of the Code of the City of Seal Beach, (Code) Section 2 Pursuant to 14 Cahf Code of Regs ~ 15025(a) and ~ II B of the City's Local CEQA GUldehnes, staff has determined as follows The apphcatlon for Minor Plan ReVIew 94-1 IS categoncally exempt from reVIew pursuant to the California EnVIronmental Quahty Act pursuant to 14 Calif Code of Regs ~ 15301 (EXIsting Uses), because It Involves the neghglble expansion of an eXisting use, pursuant to ~ 15305 (Minor AlteratIOns In Land Use Limitations), because the proposal Involves a minor alteration In a land use hmltatlOn and doe~ not Involve either a property In excess of20% slope or a change In land use or denSity, and finally, pursuant to ~ 15061 (b )(3), because It can be seen With certainty that there IS no POSSlblhty that the approval may have a Significant effect on the environment Section 3 A duly noticed heanng was held before the Planning ComnusslOn on February 9, 1994 to conSider the apphcatlon for Minor Plan ReView 94-1 Section 4 The record of the heanng on February 9, 1994 indicates the follOWing (a) On May 5, 1993, Sherrl Mokhtanan ("The Apphcant") filed an apphcatlOn for Minor Plan ReVIew 93-5 With the Department of Development SerVIces The apphcant then requested her proposal be continued to allow her to amend the proposed plans The reVised plans were submitted to the City In mid-January 1994 With the request being renumbered to Minor Plan ReView 94-1 (b) The subJect property IS located on the westerly Side of 7th Street, between Central Avenue and Electnc Avenue, IS rectangular In shape and compnses approXimately 2,937 5 square feet (c) The property contains two (2) dwelling Units, a one-story, detached umt In the front With the rear Unit being located above a four (4) car tandem garage (d) The subject property IS legally descnbed as Lot 13, In Block 106 of Bay City, as per map recorded In Book 3, Page 19, Miscellaneous Maps, In the Office of the County Recorder of said County (e) The subject property IS surrounded on all Sides by a mixture of single-family and multlple-fanuly reSidences In the ReSidential High DenSity (RHD) Zone 1:\ \MDr\rQ41 BCC '- , Planmng ('oll/II//mon Re,olul/On No 94-6 February 9, /994 (1) Staff analysIs indIcates the subJect property IS a legal nonconforming property due to density, substandard Unit sIze and the provIsIon of permItted tandem parking (g) subJect property Under the current zOning, only one (I) dwelling Units could be bUilt on the (h) The apphcant IS proposing to add a new extenor door to the front Unit Specdically, the apphcant IS proposing to add a set of French doors Into a former window opening In the Unit's front extenor wall (I) City has reCeived no comments, wntten or other, responding to the notices of the heanng on MPR 94-1 Section 5 Based upon the facts contained In the record, including those stated In 94 of this resolution, and pursuant to ~~ 28-2407,28-801 and 28-802 of the City's Code, the Planning ComnusslOn hereby finds as follows (a) Mmor Plan ReView 94-1 IS consistent with the provISIons ofthe Land Use Element of the City's General Plan, which proVIdes a "hIgh denSity reSidential" deSignation for the subJect property and pemuts single and multi-family reSIdential uses The use IS also consistent with the remaining elements of the City's General Plan as the pohcles of those elements are consistent With, and reflected In, the Land Use Element Accordingly, the proposed use IS consistent with the General Plan (b) The bUilding and property at 213 7th Street are adequate In Size, shape, topography and location to meet the needs of the proposed use of the property (c) ReqUIred adherence to appllcable budding and fire codes ensUle there will be adequate water supply and utlhtles for the proposed use (d) The proposed use will be compatible WIth surrounding uses and the community In general, because the style, height and bulk of the proposed French doors are consistent With surrounding reSidential uses (e) Through the prOVISIon offour (4) tandem parlong spaces, the site meets ItS parking reqUIrement Section 6 Based upon the foregOing, the Planning CommISSIOn hereby approves Minor Plan ReVIew 94-1, subJect to the follOWing conditIOns Minor Plan ReView 93-5 IS approved for the addItion of a new extenor door to the front Unit ofa nonconforming duplex located at 213 Seventh Street, Seal Beach SpeCifically, the apphcant IS permitted to add a set of French doors Into a former WIndow opening In the umt's front extenor wall 2 All construction shall be In substantIal comphance WIth the plans approved through Minor Plan Review 93-5 3 ThiS Minor Plan ReVIew shall not become effective for any purpose unless an "Acceptance of CondItIOns" form has been SIgned by the
