'"fc ' RESOLUTION NUMBER 94-5 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING HEIGHT VARIATION 94-1, A REQUEST TO CONSTRUCT A COVERED ROOF- ACCESS STRUCTURE IN CONJUNCTION WITH THE CONSTRUCTION OF A NEW SINGLE-FAMILY DWELLING AT 254 SIXTH STREET, SEAL BEACH THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY FIND AND RESOLVE Section 1 On December 15, 1993, Ericksen Construction ("The Applicant") filed an applicatIOn for Height Vanatlon 94-1 With the Department of Development Services The applIcant seeks to construct a covered roof access structure (CRAS) in excess of the height lImit In conjunction With the construction ofa new single family dwe1bng at 254 Sixth Street, Seal Beach Section 2 Pursuant to 14 Calif Code of Regs ~ 15025(a) and ~ II B of the City'S Local CEQA Guidelines, staff has determIned as follows The application for Height Vanatlon 94-1 IS categoncally exempt from reVIew pursuant to the Callforma EnVIronmental Quality Act pursuant to 14 Calif Code of Regs ~ 15301 (EXIsting Uses), because it Involves the neglIgible expansion of an existing use, pursuant to ~ 15305 (MInor Alterations In Land Use LimitatIOns), because the proposal involves a minor alteration In a land use ImntatlOn and does not Involve either a property in excess of20% slope or a change In land use or density, and finally, pursuant to ~ 15061(b)(3), because it can be seen With certlUnty that there IS no POSSlblhty that the approval may have a Significant effect on the environment Section 3 A duly noticed pubhc heJ.lnng was held before the Planmng ConumsSlon on January 19, 1994 to conSIder the application for Height Vanation 94-1 Section 4 The record of the hearing on January 19, 1994 indicates the follOWIng (a) On December 15, 1994, Ericksen ConstructIon filed and application for Height Vanation 94-1 With the Department of Development ServIces (b) The application requests to construct a covered roof access structure (CRAS) In excess of the height hnut in conJunction With the construction ofa new single fanuly dwellIng at 254 Sixth Street, Seal Beach (c) The proposed structure Will have an interior covered area of 4225 square feet whtch IS In keeping With the Planmng Conumssion's maXImum covered arell for a circular stair access of 42 25 square feet (d) The proposed structure will exceed the height Imnt by five (5') feet whtch IS In keeping With the prOVISions of~28-2317(4) of the Code of the City of Seal Beach (e) The subJect property IS legally described as Orange County Assessor's Parcel Number 199-051-01 (1) The subject property IS surrounded on the south, east and west by a nuxture of single- and multi-fanuly uses in the ReSidential HIgh DenSity zone (RHO) and to the north by a retlUl shopping center and hotel In the GEneral Commercial zone (C-2) (g) A duly noticed public hearing was held on January 19, 1994, to conSIder Height VariatIOn 94-1 (h) The City received one written comment In oppOSition to this request responding to the notices of the hearing on Height Variation 94-1 1=\ \I-fW:l9'l1 BCCL... ..... Planmng CommIssIon ResolutIon 94-5 January 19, 1994 Section 5 Based upon the facts contained in the record, including those stated In ~ 4 ofthts resolution, and pursuant to ~~ 28-2407 and 28-801 of the City'S Code. the Planmng Conumssion hereby finds as follows (a) Height Variation 94-1 is consistent with the provisions of the Land Use Element of the City'S General Plan, whtch provides a "htgh density residential" designation for the subJect property and permits single fanuly residential uses The use is also consistent With the remlUmng elements of the City's General Plan as the poliCies of those elements are conSistent With, and reflected In, the Land Use Element AccordIngly, the proposed use IS consistent With the General Plan (b) The proposed CRAS is arclntecturalJy In keeping With the remmnder ofthe structure, With the roofing materials and SIding matchtng those of the remainder of the structure (c) The proposed CRAS IS In keeping with the character and mtegnty of the surrounding neighborhood where a number of simiJar structures are located Wlthtn the immediate VICInity (d) No habitable living space is prOVIded Within the structure ( e) Due to the relatively flat teITlUn in the VICInity of the proposed structure, It does not si811lficantly ImplUr the primary view of any property located witlnn 300 feet of the subJect property SectIon 6 Based upon the foregOing, the Planmng CommiSSion hereby approves Height Vanation 94-1, subJect to the follOWing conditions 1 CUP 94-1 IS approved for the construction of a covered roof access structure (CRAS) In excess of the height linut m conJullctlon With the construction of a new Single fanuly dwe1bng at 254 Sixth Street, Seal Beach 2 All constructIOn shall be In substantial compliance With the plans approved through HV 94-1. 3 There shall be habitable space permitted withtn the covered roof access structure PASSED, APPROVED AND ADOPTED by the Planning ConumsSlon of the City of Seal Beach at a meeting thereof held on the 19th day of January, 1994 by the following vote AYES Commissioners CamDbelL Dahlman.
