HomeMy WebLinkAboutPC Res 94-01 - 1994-01-19 RESOLUTION NUMBER 94-1 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING MINOR PLAN REVIEW 93-8, PERMITTING THE ADDITION OF A SIXTY (60) SQUARE FOOT LAUNDRY ROOM AT A NONCONFORMING FOUR-UNIT APARTMENT LOCATED AT 1113 OCEAN AVENUE, SEAL BEACH THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY FIND AND RESOLVE Section 1 On November 23, 1993, Rene Bollen ("The Applicant") filed an application for Mmor Plan Review 93-8 with the Department of Development ServIceS requesting to add a detached laundry room at the rear ofa nonconfornung four (4) umt apartment building located at 1113 Ocean Avenue, Seal Beach SpecIfically, the applicant's request IS to add a sixty (60) square foot, common laundry facility at the rear of the property for use by hiS tenants, as authonzed under Section 28-2407 of the Code of the City of Seal Beach. (Code) Section 2 Pursuant to 14 Calif Code of Regs ~ 15025(a) and ~ II B of the City'S Local CEQA GUidelines, staffhas determined as follows The applicatIOn for MInor Plan ReVIew 93-8 IS categoncally exempt from reVIew pursuant to the Callforma EnVIronmental Quabty Act pursuant to 14 Calif Code of Regs ~ 15301 (Existing Uses), because It Involves the negb81ble expansion ofan existing use, pursuant to ~ 15305 (MInor Alterations in Land Use Limitations), because the proposal Involves a mInor alteration In a land use limitatIOn and does not Involve either a property In excess of20% slope or a change In land use or denSity, and finally, pursuant to ~ 15061(b)(3), because it can be seen with certainty that there IS no pOSSIbility that the approval may have a significant effect on the environment Section 3 A duly noticed heanng was held before the Planmng Comrmssion on January 5, 1994 to conSider the application for Minor Plan Review 93-8 Section 4 The record of the heanng on January 5, 1994 indicates the followmg (a) On November 23, 1993, Rene Bollen ("The Applicant") filed an appbcatlon for Minor Plan ReVIew 93-8 with the Department of Development SerVIces (b) The subject property, Orange County Assessor's parcel number 199-072-5, IS located In the Residential HIgh Density zone (RHO), on a 50' x 110' lot (5,500 sq ft) The property contlUns a four-Unit apartment building located toward the front of the property With ten (10) uncovered parkmg spaces located off of the alley at the rear of the property (c) The subject property IS legally nonconforming due to madequate denSity, lack of covered parlong and madequate SIde setback on the easterly SIde of the building (d) The applicant IS proposing to add a sixty (60') square foot, detached laundry room at the rear of the structure The proposed laundry room will be approximately nine (9') feet In height and will be Sided With Tl-ll SIding to match the rear of the existing apartment structure (e) City has received no comments, wntten or other, responding to the notices of the hearing on MPR 93-8 Section 5 Based upon the facts contained In the record, including those stated In ~ 4 of this resolution, and pursuant to ~~ 28-2407, 28-801 and 28-802 of the City's Code. the Planning Comrmssion hereby finds as follows (a) Minor Plan RevIew 93-8 IS consistent with the proVIsions of the Land Use Element of the City's General Plan, winch prOVIdes a "htgh denSity reSidential" deSignation for the 1=\ 'MPRIR... BCCL.. , PlanmDg ConumSSlon Resoluhon No 94-1 January 19, 1994 subject property and permits single and multi-farmly residential uses The use is also consistent With the remaining elements of the City's General Plan as the pobcies ofthose elements are consIstent With, and reflected In, the Land Use Element Accordingly, the proposed use IS consistent With the General Plan (b) The building and property at 1113 Ocean Avenue are adequate In Size, shape, topography and location to meet the needs of the proposed use of the property (c) Required adherence to applicable budding and fire codes ensure there Will be adequate water supply and utilities for the proposed use (d) The proposed use will be compatible with surrounding uses and the community In general, because the style, height and bulk of the proposed laundry room IS consistent With surrounding residential uses (e) Through the prOVISion often (10) uncovered parking spaces, the site meets ItS parking requirement A requirement to provide covered parlong is not In keepIng With the minor nature ofthts request Additionally, providing covered parlong spaces Will result In a reduction of available spaces from ten (10) to four (4) due to setback constraInts for a garage or carport structure Section 6 Based upon the foregOing, the Planning Comrmssion hereby approves MInor Plan Review 93-8, subject to the following conditions I MInor Plan Review 93-8 is approved for an addition of a sixty (60) square foot, detached laundry room at the rear ofa nonconforming four (4) Unit apartment at 1113 Ocean Avenue, Seal Beach 2 All construction shall be In substantial compliance With the plans approved through MInor Plan Review 93-8 3 The laundry room shall be equipped with roofing and stucco to match the existIng apartment Additionally, the laundry room shall be pmnted to match the apartment structure PASSED, APPROVED AND ADOPTED by the Planmng Comrmsslon of the City of Seal Beach at a meeting thereof held on the 19th day ofJanuary, 1994 by the follOWing vote AYES Comrmssioners Sharp, Law, Dahlman, Campbell NOES Comrmssloners ABSENT Comrmssioners ABSTAIN.
