RESOLUTION NUMBER 95-15 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING MINOR PLAN REVIEW 95-2, PERMITTING THE ADDITION OF A NEW SECOND STORY OF APPROXIMATELY 285 SQUARE FEET TO THE FRONT UNIT OF A NONCONFORMING TWO-UNIT PROPERTY LOCATED AT 324 8TH STREET, SEAL BEACH THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY FIND AND RESOLVE Section 1 On July 5, 1995, Byco Builders on behalf ofMr and Mrs Sam Amenta ("The Applicants") filed an applicatIOn for Minor Plan Review 95-2 With the Department of Development SeMces requesting to add a new second story of approxImately 285 square feet to the front umt ofa nonconformIng two-umt property located at 324 8th Street, Seal Beach, as authonzed under SectIOn 28-2407 of the Code of the City of Seal Beach, (Code) SectIOn 2 Pursuant to 14 Calif Code of Regs ~ 15025(a) and ~ II B of the City'S Local CEQA GUidelines, staff has detennlned as follows The application for MInor Plan ReVIew 95-2 is categoncally exempt from reVIew pursuant to the Callforma EnVironmental Quahty Act pursuant to 14 Calif Code of Regs ~ 15301 (EXIsting Uses), because It Involves the negligible expansion ofan eXIsting use, pursuant to ~ 15305 (Minor AlteratIOns In Land Use Llrmtatlons), because the proposal Involves a minor alteration In a land use limitation and does not Involve eIther a property In excess of20% slope or a change In land use or denSIty, and finally, pursuant to ~ 15061(b)(3), because It can be seen With certainty that there IS no POSSibility that the approval may have a slgmficant effect on the environment Section 3 A duly noticed hearing was held before the Planning Commission on July 19, 1995 to conSider the application for Minor Plan ReView 95-2 Section 4 The record of the heanng on July 19, 1995 indicates the follOWIng (a) On July 5, 1995, Byco Builders on behalf ofMr and Mrs Sam Amenta ("The Applicants") filed an application for Minor Plan ReView 95-2 With the Department of Development SeMces (b) The subJect property, Orange County Assessor's parcel number 043-112-08, IS located In the ReSIdential High DenSity zone (RHO), on a 25' x 117 5' rectangular shaped lot (2,937 5 sq ft) The property contains a one-story umt In the front and a Unit above a detached garage In the rear (c) The subJect property IS legally nonconforming due to denSity and Inadequate on-sIte parkIng (d) The applicants are proposing to add a new second floor consIsting ofa master bedroom and bath (285 square feet total addition) to the front umt (e) The City has received no comments, wntten or other, responding to the notIces of the heanng on MPR 95-2 Section 5 Based upon the facts contained In the record, including those stated In ~ 4 of tins resolution, and pursuant to !l~ 28-2407, 28-801 and 28-802 of the CIty's Code. the Planning Comrmsslon hereby finds as follows (a) MInor Plan ReView 95-2 IS consistent With the proVISions of the Land Use Element of the CIty's General Plan, whIch prOVides a "high denSity reSidential" designatIOn for the subJect property and permits Single and multi-family reSidential uses The use IS also consIstent WIth the remalmng elements of the City's General Plan as the poliCies of those elements are 1=1 IMPRIRoo> 1lCCL.. Planmng CommISSIOn ResolutIon No 95-15 July 19, 1995 ~ consistent WIth, and reflected m, the Land Use Element Accordmgly, the proposed use is consistent with the General Plan (b) The bUlldmg and property at 324 8th Street are adequate m Size, shape, topography and location to meet the needs of the proposed use of the property (c) ReqUired adherence to apphcable buddmg and fire codes ensure there Will be adequate water supply and utilities for the proposed use (d) The proposed use wdl be compatible with surroundmg uses and the community in general, because the style, height and bulk of the proposed second story additIOn IS consistent with surroundmg reSidential uses SectIOn 6 Based upon the foregomg, the Planmng CommISSion hereby approves Minor Plan ReView 95-2, subJect to the followmg conditions 1 MInor Plan ReView 95-2 IS approved for the addition of a new second story of approXImately 285 square feet to the front umt ofa nonconformmg two-umt property located at 324 8th Street, Seal Beach 2 All constructIOn shall be m substantial compliance With the plans approved through Mmor Plan ReVIew 95-2 3 The applicants shall comply With all conditions placed on this request by the Seal Beach Buddmg Department and Orange County Fire Authonty 4 This Mmor Plan ReView shall not become effective for any purpose unless an "Acceptance of ConditIons" form has been SIgned by the applicant m the presence of the Director of Development SeMces, or notanzed and returned to the Planmng Department, and until the ten (10) day appeal period has elapsed PASSED, APPROVED AND ADOPTED by the Plannmg CommISSIOn of the City of Seal Beach at a meetmg thereof held on the 19th day of July, 1995 by the followmg vote AYES CommissIOners Campbell, Dahlman, Law, Sharp NOES ComrmsslOners ABSENT CommiSSIoners Brown '/J~ Patncla E Campbell, Chal Plannmg CommiSSion Page 2 1=1 11'1_ 1lCCL..
