RESOLUTION NUMBER 95-13 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH RECOMMENDING TO THE CITY COUNCIL THE ADEQUACY OF THE FINAL ENVIRONMENTAL IMPACT REPORT FOR THE BIXBY OLD RANCH GOLF COURSE DEVELOPMENT PLAN THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY FIND AND RESOLVE: Section 1. Bixby Ranch Company has submItted a development apphcatlon for the Bixby Old Ranch Golf Course and adJOImng propertIes wIth the development proposals set forth below: . A request to amend the General Plan and change the zomng deSIgnation to reconfigure the eXIsting BIxby Old Ranch Golf Course, develop 98 fatrway- onented smgle family homes, 100-125 multiple-famIly umts for low-moderate mcome persons, and develop a 1356 acre parcel at Lampson/Seal Beach Boulevard for a maxImum development of . 180 room Hotel . 30,000 square feet of restaurant space . 30,000 square feet of retaIl space . 35,500 square feet of office space Section 2. Chapter 17 of the Code of the CIty of Seal Beach, estabhshes the Plannmg COmmISSIon and sets forth Its powers and duties The Planmng CommISSIon has been delegated the responSIbIlIty to review EIR documents for proposed developments WIthin the CIty and to make a recommendatIOn of adequacy of the subJect document to the CIty CouncIl. Section 3 Pursuant to 14 Calif Code of Regs ~ 15025(a) and ~ II C and III of the CIty'S Local CEQA GUldehnes, staff prepared an Imtlal Study and a Draft EnvIronmental Impact Report (DEIR) which was Circulated for publIc review and comment from November 9, 1994 to December 27, 1994, m comphance WIth the provIsIons of the Callforma EnVironmental QualIty Act and the CIty's Local CEQA GUldelmes. Upon completion of the publIc reVIew penod, a Fmal EnvIronmental Impact Report (FEIR) was revIewed by the Planmng CommISSIon at publIc heanngs held on June 7, 14,21, and 28, 1995 Section 4 The CIty selected EIP ASSOCiates to prepare the reqUired DEIR and FEIR, both of whIch have been submItted to the CIty Section 5. The Planmng CommiSSion conducted pubhc heanngs on June 7, 14, 21, and 28, 1995, and receIved publIc comments, both wntten and oral, regardmg the FEIR, and provided addItional comments to EIP ASSOCIates m relation to the FEIR. Section 6. The Planning CommISSion conSidered the FEIR, the staff report, addItional oral and wntten comments, and the proposed Conditions of Approval and Proposed Mitigation Measures prepared by EIP ASSOCIates, at the above referenced pubhc heanngs. Based upon Its revIew of the above mentioned reports, the Planmng Commission recommends to the CIty Counctl that the BIxby Old Ranch Golf Course Development Plan EIR, mcludmg the DEIR and FEIR, represents the mdependent Judgment of the CIty of Seal Beach, and that the FEIR IS mlmmally legally adequate m terms of compltance WIth the CEQA and the CIty's Local CEQA GUIdelines PASSED, APPROVED AND ADOPTED by the Planmng COmmission of the CIty of Seal Beach at a meeting thereof held on the 19th day of July, 1995 by the followmg vote.
