A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING CONDITIONAL USE PERMIT 95-2, PERMITTING THE CONTINUED OPERATION OF A CHURCH AT 13900 CHURCH PLACE, SEAL BEACH (HOLY FAMILY CHURCH) THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY FIND AND RESOLVE Section I On March 20, 1995, John Ahem, Arclntect and agent for Holy Farmly Church ("the Apphcants") filed an apphcatlon for CUP 95-2 With the Department of Development SeMces Through CUP 95-2, the apphcants seek approval to contmue to operate a church at 13900 Church Place, Seal Beach Tins applicatIon has been filed m response to Ordmance 1348 SectIOn 2 Pursuant to 14 Caltf Code of Regs ~ 15025(a) and ~ II B of the City's Local CEQA GUldeltnes, staff has determmed as follows The appltcatlon for CUP No 95-2 IS categoncally exempt from reVIew pursuant to the Cahforma EnVironmental Quality Act pursuant to 14 Caltf Code of Regs ~ 15301 (EXlstmg Uses), because It mvolves no expansion of an eXlstmg use, pursuant to ~ 15305 (Mmor AlteratIOns m Land Use LImitations), because the proposal mvolves a rmnor alteration m a land use hmltatlOn and does not mvolve either a property m excess of20% slope or a change m land use or denSity, and finally, pursuant to ~ 15061(b)(3), because It can be seen WIth certamty that there IS no pOSSIbilIty that the approval may have a slgmficant effect on the enVIronment SectIOn 3 A duly noticed pubhc heanng was held before the Planmng ComrmsslOn on Apn119, 1995 to conSIder the apphcatlOn for Conditional Use PerInlt 95-2 At the pubhc heanng the applicants' agent spoke m favor of the request WIth no one speakIng m oppoSItion SectIOn 4 The record of the heanng on Apn119, 1995 mdlcates the follOWIng (a) On March 20, 1995, John Ahem, Arclntect filed an apphcatlon on behalf of Holy Farmly Church for CUP 95-2 WIth the Department of Development Services (b) The applicant IS requestmg to continue to operate a church m the SeMce Commercial zone (C-l) wlthm LeIsure World ThiS application has been filed m response to CIty Ordmance 1348 winch reqUired all eXlstmg busmesses which are lackIng a required use penmt to apply to the CIty for such a use permit wlthm SIX (6) months of approval of satd ordmance (c) The subject property is legally descnbed as Orange County Assessor's Parcel Number 095-641-29 (d) The subject property contams approXImately 33,008 square feet and IS located at the southeast comer of Church Place and St Andrews Dnve Wlthm Leisure World (e) The subject property has approxImately 238 feet of frontage on Church Place (f) The subject property currently contams a Cathohc church conSIsting ofa chapel (8,933 sf) and a rectory (4,075 sf+ 646 sf proposed) (g) The subject chapel has an occupancy load of 500 (h) The sIte has approxImately 6,600 sfoflandscapmg (20% of site) 1=\ IQJPIR.., 1lCCL.. . " Planmng CommISSIOn ResolutIOn No 95-10 April 19, 1995 (I) The subject property proVIdes a total often (10) parkIng spaces on site, two (2) of which are located within garages AddItionally, there are an additional 56 marked spaces on Church Place and St Andrews Dnve directly adJacent to the subJect property which appear to be shared by Holy Family Church and Community Church next door (J) The subJect church does not meet current parkIng reqUirements which require approXImately 100 parking spaces for the subJect church However, the church was constructed In conJunction WIth the master-planned community of Let sure World and It was deterrmned there was adequate parkIng for the subJect church based on the IIkehhood of transIt, ride shanng, and walkIng to church (k) The surrounding land use and zOning are as follows NORTH & WEST MultIple farmly reSidential uses Within the pnvate commumty of Leisure World In the ReSidentIal High DenSity (planned Umt Development) zone (RHD-PD) SOUTH A church located within the pnvate community of LeIsure World In the SeMce CommercIal zone, (C-l) EAST A rmxture of commercIal uses located Within the Leisure World Shopping Center In the Service Commercial zone, (C-l) (I) The church has been In continuous operation for approxImately 32 years WIth no record of complaints or police-related problems (m) The CIty receIved no responses, wntten or other, to its mailed notice for CUP 95-2 SectIon 5 Based upon the facts contamed m the record, meludlng those stated m ~ 4 of this resolution, and pursuant to ~~ 24-1300, 28-2405, 28-2503 and 28-2504 of the CIty's Code. the Planning CommISSion hereby finds as follows (a) Staff Inspected the subJect property on April 12, 1995, and found the church m comphance With all aspects of the MUniCipal Code, except a stnct apphcatlOn of the parkIng reqUirements (b) CondItIOnal Use Perrmt 95-2 IS consIstent WIth the prOVISIons of the Land Use Element of the CIty's General Plan winch perrmts seMce commerCial uses, Ineludmg churches, of the subJect property The use IS also consIstent WIth the remaining elements of the CIty'S General Plan as the pohcles of those elements are consIstent WIth, and reflected m, the Land Use Element Accordmgly, the proposed use IS consIstent WIth the General Plan (c) WIth the Planning Commission's conditions of approval m place, the proposed use of the property WIll be compatible WIth surrounding uses and will not be detnmental to the surrounding neIghborhood (d) The style, height and bulk ofthe eXlstmg structure IS consIstent WIth surroundmg reSIdential and commercial uses (e) The building and property at 13900 Church Place are adequate In size, shape, topography and location to meet the needs of the eXisting use of the property (f) ReqUired adherence to apphcable bUilding and fire codes ensure there WIll be adequate water supply and utilities for the eXisting use SectIOn 6 Based upon the foregomg, the Planning Comrmsslon hereby approves CondItIOnal Use Permit 95-2, subJect to the follOWIng conditions Page 2 1=\ I(lJJ>oRq,., IlCC L.. , , Plannmg CommISSIon ResolutIon No 95-/0 April 19, 1995 1 CUP 95-2 is approved for an eXisting church and rectory located at 13900 Church Place (Holy Farmly Church) 2 A modtficatlon of tins Conditional Use Permit shall be obtained when (a) The estabhshment proposes to modtfy any of ItS current conditions of approval (b) There is a substantial change In the mode or character of operations of the estabhshment 3 The configuratIon of the subJect church and rectory shall be as presented through the site plan subrmtted m conJunctIOn WIth the apphcatlon for CUP 95-2, meludlng the addItIon of 646 square feet to the rectory 4 Tins CondItional Use Perrmt shall not become effective for any purpose unless an "Acceptance ofCondltJons" form has been sIgned by the apphcant m the presence of the DIrector of Development Servtces, or notanzed and returned to the Planmng Departlnent, and until the ten (10) day appeal penod has elapsed PASSED, APPROVED AND ADOPTED by the Planning CommiSSIon of the CIty of Seal Beach at a meetmg thereof held on the 19th day of Apnl, 1995 by the follOWIng vote AYES ComrmsSloners ~~h:!, dL/---.-, /~ ~...,.J~ NOES Comrmsmoners ABSENT ComrmsslOners / / --< /'f.A7" An~Y - Planning ComrmsslOn Wluttenberg, Secretary Planmng Commission Page 3 1=\ 'OJPIR.., IlCCI..
