COVERED ROOF ACCESS STRUCTURE IN CONJUNCTION WITH THE CONSTRUCTION OF A NEW SINGLE FAMILY DWELLING AT C-19 SURFSIDE THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE SectIOn I On February 15,1995, Jane S Clement ("The Applicant") subrmtted an apphcatlOn for Height Vanatlon 95-1 WIth the Department of Development SefVIces The apphcant IS proposing to construct a covered roof access structure (CRAS) In excess of the heIght hmlt m conJunctIOn WIth the constructIOn ofa new smgle famIly dwelhng at C-19 Surfside SectIOn 2 Pursuant to 14 Calif Code of Regs ~ 15025(a) and ~ II A of the City'S Local CEQA GUldehnes, staff has determtned as follows The applicatIOn for Height Vanatlon No 95-1 IS categoncally exempt from revtew pursuant to the CalIfornIa EnVironmental QualIty Act pursuant to 14 Calif Code of Regs ~ 15303(a) (New Construction of Small Structures), because the apphcatlon IS for the constructIOn of three (3) or less SIngle family dwelhngs m an urbwnzed area, ~ 15305 (MInor AlteratIOns In Land Use LlmttatlOns) because the request IS for a mtnor alteration In land use hmttatlOns m an area WIth an average slope ofless than 20% and no changes m land use or denSIty are Involved, and, pursuantto ~ 15061(b)(3), because It can be seen WIth certamty that there IS no possIbilIty that the approval may have a slgmficant effect on the enVIronment Section 3 A duly notIced pubhc heanng was held before the Plannmg Commtsslon on March 8, 1995 to consider Height Vanatlon 95-1 At the pubhc heanng, the apphcant spoke m favor of the request With no one speakIng In oppOSItIOn SectIon 4 The record of the heanng Indicates the follOWIng (a) for HeIght VanatlOn 95-1 On February 16, 1995, Jane S Clement subrmtted an apphcatlOn (b) The apphcant IS requestIng to construct a CRAS m excess of the reSIdential heIght hmtt m conJunction WIth the constructIOn of a new sIngle fwnlly dwelhng located at C-19 Surf sIde (c) The subJect property IS legally descnbed as Orange County Assessor's Parcel Number 178-461-26 and IS located wltlnn the pnvate community of Surf side (d) The subJect property IS nearly rectangular m shape WIth a lot area of 875 square feet (25' x 35') (e) The surroundmg land uses and zOning are as follows NORTH Open space located wlthm the Seal Beach Naval Weapons Station In the Pubhc Land UselRecreatlOn zone (pLUIR) WIth PaCIfic Coast Highway located approxtmately 200 feet north of the subJect property SOUTH, EAST & WEST Smgle famtly dwelhngs located m the ReSIdential Low DenSity zone (RLD) of Surf sIde 1'\ \I..I\I\R.-, ace~ Plannmg CommISSIOn Resoluhon No 95-6 March 8, 1995 (g) Staff has received no wntten responses to Its mailed notice regardIng Height Vanatlon 95-1 Section 5 Based upon the evidence in the record, includIng the facts stated In ~ 4 of tins resolution and pursuant to ~ 28-2317(4) of the CIty'S Code. the Planmng CommissIon hereby finds as follows (a) Hc~lght VanatlOn 95-1 IS consIstent WIth the provISIons of the Land Use Element of the City'S General Plan, winch proVIdes a "low density resIdential" designation for the subject property and permtts sIngle famtly residential uses The use IS also consistent WIth the rematmng elements of the CIty'S General Plan as the pohcles of those elements are consistent WIth, and reflected tn, the Land Use Element Accordmgly, the proposed use IS consistent with the General Plan (b) The proposed CRAS is arclntecturally In keepmg with the remamder of the structure, WIth the roofing matenals and siding matchIng those of the rematnder of the structure (c) The proposed CRAS IS appropnate for the character and Integnty of the surroundIng neighborhood where a number of Similar structures are located WithIn the Immediate VICInity (d) No habItable hVlng space IS proVIded wlthm the structure ( e) Due to the relatively flat terram m the Vlclmty of the proposed structure, It does not slgmficantly impair the pnmary VIew of any property located WIthIn 300 feet of the subJect property (t) The proposed CRAS qualifies as meetIng the City's policy for maximum eRAS sIZes as It IS deSigned In a manner winch mtmmlzes Impacts caused by the CRAS Spectfically, the CRAS WIll be constructed WIth a sloped rooffor over one-half the length of the CRAS which WIll result In an overall bulk no greater than a umform height CRAS meetIng the pohcy statement's maximum dImenSions Further, thiS proposal results m a shorter than normal full-heIght length for the CRAS SectIOn 6 Based on the foregOIng, the Planmng Commtsslon hereby approves Height Variation 95-1, subJect to the follOWIng COnditions I CUP 95-1 IS approved for the constructIOn ofa covered roof access structure (CRAS) In excess of the height IImtt In conJunction WIth the constructIOn of new a smgle famIly dwel1tng at C-19 Surf side, Seal Beach 2 All constructIon shall be m substantial comphance WIth the plans approved through HV 95-1 3 There shall be no habItable space permitted WIthin the covered roof access structure 4 Tins Height VanatIon shall not become effective for any purpose unless an "Acceptance of ConditIOns" form has been SIgned by the apphcant m the presence of the Drrector of Development Services, or notanzed and returned to the Planmng Department, and until the ten (10) day appeal penod has elapsed PASSED, APPROVED AND ADOPTED by the
