HomeMy WebLinkAboutPC Res 95-01 - 1995-01-18 J ~ . , RESOLUTION NUMBER 95-1 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING MINOR PLAN REVIEW 94-8, PERMITTING THE ADDITION OF AN OPEN ROOF DECK OVER THE SECOND STORY OF A NONCONFORMING MULTIPLE UNIT STRUCTURE LOCATED AT 1524 MARINE AVENUE, SEAL BEACH THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY FIND AND RESOLVE SectIon I On December 27, 1994, Steve Cooper ("The Appltcant") filed an appltcatlOn for MInor Plan ReVIew 94-8 WIth the Department of Development SefVIces requestIng to add an open roof deck over the second story of a nonconformIng multiple umt structure located at 1524 MarIne Avenue, Seal Beach, as authonzed under Section 28-2407 ofthe Code of the CIty of Seal Beach. (Code) SectIon 2 Pursuant to 14 Calif Code of Regs ~ 15025(a) and ~ II B of the City's Local CEQA GUldeltnes, statfhas determmed as follows The application for Minor Plan ReVIew 94-8 IS categoncally exempt from reVIew pursuant to the Caltfomla EnVlromnental Quality Act pursuant to 14 Caltf Code of Regs ~ 15301 (EXlstmg Uses), because It Involves the negligible expansIon of an extstlng use, pursuant to ~ 15305 (MInor AlteratIOns m Land Use Lumtatlons), because the proposal mvolves a mtnor alteratIOn m a land use Itmttatlon and does not Involve eIther a property m excess of 20% slope or a change m land use or denSity, and finally, pursuant to ~ 15061(b)(3), because It can be seen With certamty that there IS no posslblltty that the approval may have a S1gmficant effect on the enVIronment SectIon 3 A duly noticed heanng was held before the Planmng CommIssion on January 18, 1995 to conSider the appltcatlOn for Mmor Plan ReVIew 94-8 SectIOn 4 The record of the heanng on January 18, 1995 mdlcates the follOWIng (a) On December 27, 1994, Steve Cooper ("The Applicant") filed an appltcatlon for MInor Plan Revtew 94-8 With the Department of Development SefVIces (b) The subject property, Orange County Assessor's parcel number 199-084-10, IS located m the ReSIdentIal High DenSIty zone (RHO), on a 25' x 100' rectangular shaped lot (2,500 sq ft) The property contams a three (3) umt apartment (c) The subject property IS legally nonconformtng due to denSity, madequate on-site parkmg and setbacks (d) of the structure The appltcant IS proposing to add an open roof deck over the second floor (e) The CIty has received no comments, wntten or other, respondmg to the notices of the heanng on MPR 94-8 SectIOn 5 Based upon the facts contained In the record, mcludmg those stated In ~ 4 oftlns resolution, and pursuant to ~~ 28-2407, 28-801 and 28-802 ofthe CIty'S Code, the Planmng COmmtsslon hereby finds as follows (a) Mmor Plan ReView 94-8 IS consistent WIth the provIsions of the Land Use Element of the CIty'S General Plan, winch prOVIdes a "hIgh denSity reSidential" deSignatIOn for the subject property and permtts single and multI-family reSidentIal uses The use IS also consistent WIth the rematmng elements of the CIty's General Plan as the poltcles of those elements are 1'\ IMPR\Roo.a aco.. ~ r , .
