RESOLUTION NO 96-35
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF SEAL BEACH APPROVING MINOR PLAN REVIEW
96-6, PERMITTING THE CONVERSION OF A FLAT ROOF
TO AN OPEN ROOF DECK AT 1500 MARINE AVENUE,
SEAL BEACH
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE
Section 1 On September 17, ] 996, Glona R Hjelm ("The Apphcant")
subnutted an apphcatlOn for Mmor Plan Review 96-6 WIth the Department of Development
Services The applicant sought to resurface an existing roof over a Single story garage structure
for use as a deck The proposed conversion from a flat roof to an open deck Will Include the
prOVISIon of a required guard rat! The subject property IS nonconformtng due to Inadequate
parking, denSIty and front and Side yard setbacks
Section 2 Pursuant to 14 Calif Code of Regs ~ ]5025(a) and ~ II A of the
City's Local CEQA Guldehnes, staffhas determtned as follows The apphcatlon for Minor Plan
ReVIew No 96-6 IS categoncally exempt from revtew pursuant to the Callforma Enviromnental
Quality Act pursuant to 14 Cahf Code of Regs ~ 15301(e) (Existing Fact!ltles), because It
Involves an addition to an existing reSidential structure whtch mcreases the floor area by less than
50"10 and IS less than 2,500 square feet m area, and, pursuant to ~ 15061(b)(3), because it can be
seen WIth certainty that there IS no POSSlblhty that the approval may have a slgmficant effect on
the enviromnent
Section 3 A duly noticed heanng was held before the Planning CommiSSion
on October 9, 1996 to conSider Minor Plan ReView 96-6 No pubhc testimony was prOVided
regarding the proposed project

The record of the heanng mdlcates the follOWIng
(a) On September ]7, ]996, Glona R Hjelm subnutted an apphcatlon for
Minor Plan ReVIew 96-6
(b) SpeCifically, the apphcant IS seeking to resurface an eXisting roof over a
Single story garage structure for use as a deck The proposed conversion from a flat roofto an
open deck wt!1 Include the prOVISion of a reqUired guard rail
(c) The subject property IS legally descnbed as Orange County Assessor's
. Parcel Number 199-084-1 and is located In the ReSidential HIgh DenSity zone of Old Town
(d) The subject property IS irregular In shape WIth a lot area of roughly
4,250 square feet
(e) The subject property is surrounded on all Sides by a mixture of slngle-
and multi-family reSidential uses in the Residential High Density zone (RHO)
(f) As of October 2, 1996, staff has received no wntten responses to ItS
mat!ed notice regarding Mmor Plan ReView 96-6
Section 5 Based upon the eVidence In the record, including the facts stated In
~ 4 of this resolution and pursuant to ~ 28-2407 of the City's Code, the Planning ComInlSSlon
hereby finds as follows
(a) Minor Plan ReView 96-6 IS consistent WIth the prOVISions of the Land
Use Element of the CIty's General Plan, wluch prOVIdes a "high denSity reSidential" deSignatIOn
for the subject property and permits slngle- and multi-family reSidential uses The use IS also
consistent With the remalmng elements of the Clty's General Plan as the pohcles of those elements
are consistent with, and reflected in, the Land Use Element Accordingly, the proposed use IS
consistent with the General Plan

(b) The proposed roof deck will not Increase any nonconforming
conditions on the subject property
(c) Flat roofs level wIth eXIsting floor levels and walkways are frequently
used as de facto decks WIthout the proVISIon of safety ratls or proper floonng to support Increased
loads This request will address this potential Situation
Section 6 Based on the foregoing, the Planmng CommissIon hereby approves
Minor Plan ReVIew 96-6, subject to the follOWing conditions
1 Minor Plan ReVIew 96-6 IS approved for the conversion of a flat roof over a one-story garage
to an open roof deck at 1500 Manne Avenue, Seal Beach
2 All construction shall be In substantial compliance With the plans approved through MPR
96-6
3 Thts Mmor Plan ReVIew shall not become effective for any purpose unless an "Acceptance of
CondItions" form has been Signed by the applicant m the presence of the DIrector of
Development Services, or notanzed and returned to the Planmng Department, and unttl the
ten (10) day appeal period has elapsed
PASSED, APPROVED AND ADOPTED by the Planmng Conurusslon of the CIty of Seal Beach
at a meetmg thereof held on the 9th day of October, 1996, by the follOWing vote
