HomeMy WebLinkAboutPC Res 96-34 - 1996-09-04 , RESOLUTION NO 96-34 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING MINOR PLAN REVIEW 96-5, PERMITTING A 287 SQUARE FOOT ADDlTlON TO A NONCONFORMING SINGLE FAMILY DWELLING AT 1203 SEAL WAY, SEAL BEACH THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE Section 1 On August 20, 1996, Peter and Susan White ("The Apphcant") submItted an appllcatton for Minor Plan ReVIew 96-5 With the Department of Development Services The applicants sought to add new balcomes to the first and second floors at a nonconforming duplex located at 1203 Seal Way, Seal Beach The subject property IS nonconforming due to Inadequate parkmg and denSity Section 2 Pursuant to 14 Cahf Code of Regs ~ 15025(a) and ~ II A of the CIty'S Local CEQA Guldehnes, staff has determined as follows The applicatIOn for Minor Plan ReView No 96-5 IS categoncally exempt from review pursuant to the Cahforma EnVironmental Quahty Act pursuant to 14 Calif Code of Regs ~ 15301(e) (Existing Facillttes), because It Involves an addItion to an eXlstmg reSIdential structure which Increases the floor area by less than 50% and IS less than 2,500 square feet In area, and, pursuant to ~ 15061(b)(3), because It can be seen WIth certainty that there IS no pOSSibility that the approval may have a slgmficant effect on the environment SectIon 3 A duly noticed heanng was held before the Planmng CommiSSIon on September 4, 1996 to conSider Minor Plan ReView 96-5 No pubhc testimony was proVIded regarding the proposed project SectIOn 4 The record of the heanng indicates the follOWing (a) On August 20, 1996, Peter and Susan WhIte submItted an apphcatlOn for Minor Plan ReVIew 96-5 (b) SpeCIfically, the applicants are seeking to add new balcomes to the first and second floors at a nonconforming duplex located at 1203 Seal Way, Seal Beach The subject property IS nonconforming due to Inadequate parking and denSity (c) The subject property IS legally deSCribed as Orange County Assessor's Parcel Number 199-075-2 and IS located In the ReSIdential HIgh DenSIty zone of Old Town (d) The subject property IS rectan~,'ular In shape WIth a lot area of 2, 700 square feet (e) The surroundmg land uses and zomng are as follows NORTH, EAST & WEST A mixture of Single family and multi-family reSIdentIal uses In the ReSidential High DenSIty zone (RHO) SOUTH The mumclpal beach and PaCIfic Ocean In the Public Land Use / Recreation zone (PLU/R) (f) Staff has received no wntten responses to ItS mailed notice regarding Minor Plan ReView 96-5 SectIon 5 Based upon the eVidence In the record, including the facts stated In ~ 4 of this resolution and pursuant to ~ 28-2407 of the CIty's Code, the Planmng CommiSSion hereby finds as follows C 'MY DOCUMENTS'MINOR PLAN REVlEWS'9&5 RESOLUTION DOC P/anmnl! Comn",.\wn Re.o/utlOn No 96-34 (a) Minor Plan Review 95-4 IS consistent with the provIsions of the Land Use Element of the City'S General Plan, which provides a "hIgh denSity residential" deSignation for the subject property and permits single- and multI-family resldenttal uses The use IS also consistent with the remaining elements of the CIty's General Plan as the pohcles of those elements are consistent with, and reflected In, the Land Use Element Accordingly, the proposed use IS consIstent WIth the General Plan (b) The proposed addition WIll meet all reqUired setbacks for the RHD zone SectIOn 6 Based on the foregOing, the Planmng CommISSIon hereby approves Minor Plan ReView 96-5, subject to the follOWing condItIOns 1 Mmor Plan ReView 96-5 IS approved for the addltton of first floor and second floor balcomes to a nonconforming duplex at 1203 Seal Way, Seal Beach 2 All construction shall be In substantial comphance With the plans approved through MPR 96-5 3 The follOWing repairs shall be completed In conjunction With this approval a The first floor water heater shall be strapped per Code b New heaters shall be Installed m each umt c The first and second floor water heaters shall be fitted WIth a pressure rehef valve to the outsIde d The second floor water heater shall be vented to the outside per Code e The second floor water heater shall be fitted WIth a proper base support per Code f First floor kitchen hood vent shall be Installed per Code g AJr gaps shall be Installed on the first and second floor kItchen Sinks h Smoke detectors shall be Installed In both umts per Code The garage roof shall not be used as a deck 4 ThiS Mmor Plan ReView shall not become effective for any purpose unless an "Acceptance of Conditions" form has been SIgned by the applicant In the presence of the Director of Development Servtces, or notanzed and returned to the Planmng Department, and until the ten (10) day appeal penod has elapsed PASSED, APPROVED AND ADOPTED by the Planmng CommiSSion of the City of Seal Beach at a meeting thereof held on the 4th day of September, 1996, by the follOWing vote AYES CommISSioners Hood, Law, Sharp, Yost NOES COmll1lSSl0ners ABSTAIN CommiSSIoners Brown Bna Brown, M Planning CommiSSIon P,lgc2
