A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF SEAL BEACH RECOMMENDING TO THE CITY
COUNCIL APPROVAL OF ZONING TEXT AMENDMENT 96-6,
AMENDING SECTION 28-2313 TO PERMIT PLANT
SUPPORTING STRUCTURES TO BE LOCATED WITHIN THE
REQUIRED FRONT YARD SETBACK IN RESIDENTIAL
ZONES
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE
Sectton 1 At Its meettngs of July 17, 1996 and August 7, 1996, the Planmng
CormrusSlon conSIdered and approved Zoning text Amendment 96-6 The proposed amendment would
penmt the constructton of Itnuted Size plant supporting structures Wlthtn the reqUired front yard
setback m reSldenttal zones, subject to Planmng CormrusslOn approval
Sectton 2 Pursuant to 14 Calif Code of Regs '15305 and I II B of the City'S
Local CEQA Guldehnes, staff has detenmned as follows The appllcatton for Zomng Text
Amendment 96-6 IS categorically exempt from revtew pursuant to the Callforma EnVlromnental Quality
Act pursuant to 14 Calif Code of Regs '15305 (Minor Alterations In Land Use LlIIl1tattons), because
It COnsIstS of nunor a1terattons In land use llmitattons m average slope of less than 20"10 and does not
result in any changes m land use or denSIty, and, pursuant to I 15061(b)(3), because It can be seen WIth
certainty that there IS no poSSIbility that the approval may have a Slgmficant effect on the enVIronment

July 17,1996 and continued to August 7,1996, to conSider Zone Text Amendment 96-6

SectIon 5 Based upon the facts contamed m the record, including those stated In
'4 ofthts resolution and pursuant to. 28-2600 of the CIty'S Code, the Planmng Cormrusslon makes the
follOWIng findmgs
a Zomng Text Amendment 96-6 IS consistent WIth the proVISIons of the vanous
elements of the CIty'S General Plan, m that the proposed amendment WIll not mtenslfY any land use m
the reSldenttal zones of the CIty, but WIll permit property owners to enhance the aesthetics of thetr
reSIdences
b The proposed text amendment WIll revise the CIty'S zomng ordinance and enhance
the ability of the City to ensure orderly and planned development In the City through an amendment of
the zoning requirements Specifically, the City will have a mechanism for reviewtng and permitting

SectIon 6 Based upon the foregOing, the Planmng Commtsslon hereby
recommends that the City Council approve Zomng Text Amendment 96-6, m the follOWIng form
Article 23 Paragraph (C) of SectIOn 28-2313 of Chapter 28 of The Code of the CIty of Seal
Beach IS hereby added to read
"(C) Subject to Planning CommtSSlon approval through a consent
calendar plan revtew, plant supporttng structures such as arbors,
arches, tre1ltses and simIlar structures are permttted WIthin the reqUIred
front yard setback to the property Itne except as proVIded m Section
28-2306 ofthts chapter Such structures shall not exceed eight (8) feet
In overall height or eighteen (18) square feet In area
Such structures exlsttng pnor to the effective date ofthts ordinance
shaII be made conformtng and obtam reqUired approvals or be removed
within 120 days of the effecttve date ofthts ordinance "

meettng thereof held on the 7th day of August, 1996, by the follOWIng vote
