HomeMy WebLinkAboutPC Res 96-32 - 1996-08-07 4 RESOLUTION NO 96-32 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING MINOR PLAN REVIEW 96-4, PERMITTING A 287 SQUARE FOOT ADDITION TO A NONCONFORMING SINGLE FAMILY DWELLING AT 306 CENTRAL AVENUE, SEAL BEACH THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE Section 1 On July 24, 1996, Eva Ktlger ("The Applicant") submitted an apphcatlon for Mmor Plan ReVIew 96-4 WIth the Department of Development Services The applicants sought to add a bedroom and deck of approXImately 279 square feet above a detached garage at a nonconformtng single famtly dwelling located at 306 Central Avenue, Seal Beach The subject property IS nonconformtng due to Inadequate Side and rear setback for the detached garage SectIon 2 Pursuant to 14 Calif Code of Regs ~ 15025(a) and ~ II A of the CIty'S Local CEQA Guidelines, staff has determined as follows The apphcatlon for Minor Plan ReVIew No 96-4 IS categoncally exempt from review pursuant to the Cahforma Envlromnental Qualtty Act pursuant to 14 Calif Code of Regs ~ 15301(e) (EXIsting Faclhtles), because It mvolves an addition to an eXlstmg residential structure which Increases the floor area by less than 50% and IS less than 2,500 square feet In area, and, pursuant to ~ 15061(b)(3), because It can be seen WIth certamty that there IS no pOSSibIlity that the approval may have a slgmficant effect on the enVIronment Section 3 A duly noticed heanng was held before the Planmng COmImsslon on August 7, 1996 to conSider Minor Plan ReVIew 96-4 No public testimony was prOVided regarding the proposed project SectIon 4 The record of the hearing indicates the follOWing ReVIew 96-4 (a) On July 24, 1996, Eva Ktlger submItted an application for Minor Plan , (b) SpeCifically, the applicant IS seeking to add a bedroom and deck of approxtmately 279 square feet above a detached garage at a nonconforming Single famtly dwelling located at 306 Central Avenue, Seal Beach The subject property IS nonconforming due to madequate SIde and rear setback for the detached garage (c) The subject property IS legally descnbed as Orange County Assessor's Parcel Number 199-143-3 and IS located In the ReSidential High DenSity zone of Old Town (d) The subject property is a parallelogram With a lot area of2,500 square feet (e) The subject property IS surrounded on all sides by a mixture of single famtlyand multl-faInlly reSIdential uses m the ReSidential High DenSity zone (RHO) \ (f) Staff has receIved no wntten responses to ItS matled notice regarding MInor Plan Review 96-4 SectIon 5 Based upon the eVIdence In the record, including the facts stated In ~ 4 ofthts resolutIOn and pursuant to ~ 28-2407 of the City's Code, the Planmng CommiSSIon hereby finds as follows (a) Minor Plan ReView 95-4 is consIstent With the proVISions of the Land Use Element of the City's General Plan, which prOVides a "high denSity reSidential" designation for the subject property and permits single- and multl-famtly reSidential uses The use is also consistent with the remaining elements of the City's General Plan as the policies of those C 'My DOCUMENTS'M'NOR Pu\N REVlEWS'9&4 RES0LlIT10N DOC Plannmg CammlMlOn Re~alullon Na 96-32 elements are consistent WIth, and reflected In, the Land Use Element Accordingly, the proposed use IS consIstent with the General Plan (b) The proposed addition will meet all required setbacks for the RHO zone Section 6 Based on the foregOing, the Planmng ComnusslOn hereby approves MInor Plan ReVIew 96-4, subject to the following conditions 1 MInor Plan Revtew 96-4 IS approved for the addition of a 287 square foot bedroom above the detached garage ofa nonconformtng Single family dwelling at 306 Central Avenue, Seal Beach 2 All construction shall be In substantial comphance WIth the plans approved through MPR 96-4 3 The folloWIng repairs shall be completed In conjUnctIOn With thiS approval a The water heater shall be strapped per Code b The water heater shall be fitted With a pressure rehef valve to the outSide c The electrical service must be upgraded d The apphcant should contact an SCE service planner to consider relocation of the eXisting electrical serVIce 4 Pnor to Issuance ofa bUilding permit, the apphcant shall record a covenant on the TItle of the property mdlcatmg It IS compnsed of a Single family dwelhng With a bedroom over the detached garage 5 Thts Minor Plan Review shall not become effective for any purpose unless an "Acceptance of ConditIOns" form has been Signed by the apphcant In the presence of the DIrector of Development Services, or notanzed and returned to the Planmng Department, and until the ten (10) day appeal period has elapsed PASSED, APPROVED AND ADOPTED by the Planmng Commission of the City of Seal Beach at a meeting thereof held on the 7th day of August, 1996, by the follOWing vote AYES COmImssloners Brown, Hood, Law, Sharp NOES COmImssloners ABSENT CommiSSioners B$::!:::M~ Planmng Commission Page 2
