RESOLUTION NUMBER 96-25 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DENYING ZONING TEXT AMENDMENT 96-5, A REQUEST TO AMEND THE CODE OF THE CITY OF SEAL BEACH TO AMEND THE SIDE SETBACK REQUIREMENTS FOR PROPERTIES WITH SIDE YARDS ABUTTING THE NORTH SIDE OF BOLSA AVENUE BETWEEN BALBOA DRIVE AND SEAL BEACH BOULEVARD THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE Section I Dunng late 1995 and early 1996 a group of local cItizens lobbied successfully to have Southern CalIfornia Edison Co (SCE) remove the 66kv power lines which traverse much of Old Town and the Manna Htll The power lines, seen proInlnently along 1st Street, Manna Dnve, Bolsa Avenue and Seal Beach Boulevard are currently being removed WIth the cooperation of SCE and Rockwell As the power lines are removed, SCE wtll abandon the 36 foot utlltty easement currently burdening the properties on the north SIde ofBolsa Avenue and a short stretch of Coastline Dnve Because of the presence of the 36 foot easement adjacent to Bolsa Avenue, there IS an attractIve landscaped VIew comdor created along Bolsa Avenue Whtle the maJonty of the affected Side yards are walled or fenced In, thIS view comdor sttll extsts due to a combmatlon of foliage VISIble above the walls and the general lack of two -story structures Wlthtn the easement area Zomng Text Amendment 96-5 was proposed to allow the City to conSIder potential aesthetic Impacts anslng from the abandonment of the easement and to potentIally take action to protect the extstlng VIew comdor Section 2 A duly nottced public heanng was held by the Planmng Commission on May 8, 1996, to consider Zone Text Amendment 96-5 Section 3 The record of the May 8, 1996 mdlcates the follOWIng (a) At saId public heanng there was oral and wntten testimony and eVIdence received by the Planmng COmImsslon SpecIfically, SIX (6) people spoke m OppOSition to the proposed text amendment, advocating constructIOn be allowed Wlthtn the former easement area (b) ZT A 96-5 proposes to take steps necessary to preserve all or some of the VIew comdor eXIsting along the northerly SIde of BoIs a Avenue between Balboa Dnve and Seal Beach Boulevard (c) In consldenng ZTA 96-5 the CommiSSIon conSidered three potential optIons 1) Recommend an Increase In the required Side setback to match the preVIous easement area 2) Recommend leaVIng the Side setback at ItS current 15% of lot WIdth but plaCing a one-story, 15 foot hetght limit Within the preVIous easement area 3) Take no actIon, recommend demal of the proposed text amendment ThiS action would permit two-story, 25 foot construction to be built to Wlthtn 10 feet of the side property line D '\MY DOCUME"""'\ZoNING TExT AMENDME"""'\96S RES0LU110N DOC Be BC " , Planmng CommISSIon ResolutIon No 96-25 May 22, 1996 (d) The City received two (2) letters m oppOSitIOn to ZTA 96-5 Section 4 Based upon the facts contamed in the record, mcludmg those stated m ~4 ofthts resolution and pursuant to ~~ 28-2600 of the City's Code. the Planmng COmImsslon makes the follOWIng findmgs (a) Proposed ZT A 96-5 does not serve to advance a pubhc mterest SectIOn 5 Based upon the foregomg, the Planmng CommiSSIOn hereby denies Zoning Text Amendment 96-5 and determines to not to change the proVIsions of Section 28-401 of the Code of the City of Seal Beach PASSED, APPROVED AND ADOPTED by the Planmng Commission of the CIty of Seal Beach at a meetmg thereof held on the 22nd day of May 1996, by the followmg vote AYES: COmImssloners Brown, Law, Sharp NOES COmImssloners ABSTAIN Commissioners Dahlman D~'~ Planmng Commission Whtttenberg, Secretary Planmng Comrrussion 7 **** Page 2 96-5 Resolubon
