A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DENYING ZONING TEXT AMENDMENT 96-2B, A REQUEST TO AMEND THE CODE OF THE CITY OF SEAL BEACH TO PERMIT CERTAIN ROOF TREATMENTS TO EXCEED THE 25 FOOT HEIGHT LIMIT BY UP TO 2-J FEET, SUBJECT TO A DISCRETIONARY REVIEW BY THE PLANNING COMMISSION THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE Section I. In October 1995, the City of Seal Beach proposed Zoning text Amendment 96.2 Tlus amendment was proposed to amend the Code of the City of Seal Beach to prohibit new thtrd stories in the medium and lugh density zones of Old Town and place a blanket 25 foot height limit on these properties The proposal also considered pennittmg certam roof treatments to exceed the 25 foot height linut by up to 2.J feet, subject to a discretionary review by the Planning Commission The two facets of this request were subsequently spltt mto ZT A 96.2A and 96-2B for dIscussion purposes SectIOn 2 A duly noticed public hearing was held by the Planmng ComnusslOn on February 21,1996, continued to Apnl, 1996 and again to April 17, 1996, to consider Zone Text Amendment 96-2 Section J The record of the hearings on February 21, 1996, ApriIJ, 1996 and April 17, 1996 mdlcates the following (a) At said public hearing there was oral and written testimony and evidence received by the Planning ComnusslOn (b) In considering this matter the Planmng Commission split the two issues mto Zoning Text Amendment 96-2A and 96-2B for discussion purposes (c) ZT A 96-2A proposes to prohibit new third stories in the medium and high density zones of Old Town and place a blanket 25 foot height hmit on these properties (d) ZT A 96-2B proposes to allow certain roof treatments to exceed the 25 foot height limit by up to 2-J feet, subject to a discretionary review by the Planning Commission (e) The City received two (2) letters in support ofZTA 96-2 and five (5) letters m opposition to ZT A 96-2 The CIty also received one letter opposJng ZT A 96-2A and in favor of ZT A 96-2B D"\_~TllTAam ".\.ZBRDoumCIN 8C:ac: Planning CommISSIon ResolutIon No 96- 23 May 8, 1996 Section 4 Based upon the facts contamed In the record, including those stated in ~ of this resolution and pursuant to ~~ 28-2600 of the City'S ~ the Planmng COmImSSl0n makes the following findmgs <a) Proposed ZT A 96-2B, pennitting certain roof treatments to exceed the height by 2.3 feet, could result in the ridge of a roof exceeding the height limit by up to 3 feet for the enttre length ofa structure Such a case could result in degradation ofpnmary VIewS from roof decks on nearby properties Section 5 Based upon the foregoing, the Planning Commission hereby demes Zoning Text Amendment 96-2B and detennines to not to change the provisions of Section 28-2317 of the Code PASSED, APPROVED AND ADOPTED by the Planning Comnussion of the CIty of Seal Beach at a meeting thereof held on the 8th day of May 1996, by the following vote AYES Commissioners Campbell, Law, Sharp, ~rown NOES Commissioners ABSTAIN Comnus~oners A13SEi'olT' C0r.1ffilSS10ner Dahll.1an 'iJii6ld~j rl ~ Patricia E Campbell, ChairpersOn Planning Commission ~ .I ,(, , .
