' .. , ' RESOLUTION NUMBER 96-~ A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DENYING ZONING TEXT AMENDMENT 96-2A, A REQUEST TO AMEND THE CODE OF THE CITY OF SEAL BEACH TO PROHIBIT NEW THIRD STORIES IN THE MEDIUM AND HIGH DENSITY ZONES OF OLD TOWN AND PLACE A BLANKET 25 FOOT HEIGHT LIMIT ON THESE PROPERTIES THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE Section 1 In October 1995, the City of Seal Beach proposed Zomng text Amendment 96-2 This amendment was proposed to amend the Code ofthe CIty of Seal Beach to prohtblt new thtrd stones in the medium and htgh denSIty zones of Old Town and place a blanket 25 foot hetght limtt on these properties The proposal also conSidered permtttmg certam roof treatments to exceed the 25 foot heIght Iirmt by up to 2-3 feet, subject to a dlscrettonary reVIew by the Planmng Commission The two facets of this request were subsequently spht Into ZT A 96-2A and 96-2B for diSCUSSIon purposes SectIOn 2 A duly notIced pubhc heanng was held by the Planmng CommissIon on February 21, 1996, contmued to Apnl, 1996 and again to Apnl 17, 1996, to conSIder Zone Text Amendment 96-2 Section 3 The record of the heanngs on February 21, 1996, Apnl3, 1996 and April 17, 1996 mdicates the followmg (a) At said pubhc heanng there was oral and wntten testimony and evtdence received by the Planmng ComrmsslOn (b) In consldenng thiS matter the Planmng CommissIon spht the two Issues Into Zomng Text Amendment 96-2A and 96-2B for dISCUSSIon purposes (c) ZTA 96-2A proposes to prohtblt new third stones m the medIUm and htgh denSIty zones of Old Town and place a blanket 25 foot height IiInlt on these propertIes (d) ZTA 96-2B proposes to allow certain roof treatments to exceed the 25 foot hetght hmlt by up to 2-3 feet, subject to a discretionary reVIew by the Planmng COmImsslon (e) The CIty recetved two (2) letters In support ofZTA 96-2 and five (5) letters m oppoSItIOn to ZT A 96-2 The CIty also receIved one letter opposing ZT A 96-2A and In favor ofZTA 96-2B Section 4 Based upon the facts contained In the record, mcludlng those stated In ~4 ofthls resolutIon and pursuant to ~~ 28-2600 of the City's Code. the Planmng COmImsslon makes the following findings (a) Proposed ZT A 96-2A, prohtbltlng new thtrd stones, would adversely affect the property values of 454 propertIes m Old Town (b) There IS an extensive precedent set for the constructIOn of thtrd stones on the rear half of WIder lots, WIth 60 such structures currently extstlng SectIOn 5 Based upon the foregoing, the Planmng ComrmsslOn hereby demes Zomng Text Amendment 96-2A and determines to not to change the provIsions of Sections 28-701,28-801 of the Code D'\ \ZONINCiITExT AMEtIJMiHT8\9&2A RB&OW1'ICN BC Be Planmng CommISSIon ResolutIon No 96-2A.
