RESOLUTION NO 96-18 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH APPROVING MINOR PLAN REVIEW 94-5, PERMITTING INTERIOR / EXTERIOR REMODEL, INCLUDING REDUCTION IN UNITS FROM FOUR TO THREE, AT 1101 SEAL WAY, SEAL BEACH THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE Section 1 On September 27, 195, Renee and Fanny Bollen ("The Applicants") submItted an application for Mmor Plan ReVIew 94-5 with the Department of Development Services The applicants sought to remodel the second floor of an eXlstmg apartment structure resultmg m a reduction from four (4) to three (3) umts, new rooflme which Will mcrease the height of the front portion of the structure by approximately IWO (2) feet to 25 feet m height, extenor remodel and a reconfigured stairwell access to the second floor Section 2 Pursuant to 14 Cahf Code of Regs ~ 15025(a) and ~ II A of the CIty's Local CEQA GUldehnes, staff has detelmmed as follows The apphcatlon for Mmor Plan ReVIew No 94-5 is categoncally exempt from revIew pursuant to the Cahforma EnVIronmental QUalIty Act pursuant to 14 Cahf Code of Regs ~ 15301(a)&(e) (Exlstmg Faclhtles), because the application IS for mtenor and extenor remodel of an eXlstmg reSidential structure, and, pursuant to ~ I5061(b)(3), because It can be seen With certamty that there IS no POSSlblhty that the approval may have a SIgnificant effect on the environment Section 3 A duly noticed hearmg was held before the PlannIng CommIssion on ApnIl7, 1996 to consider Mmor Plan ReView 94-5 No public testimony was provided regardmg the proposed proJect Section 4 The record of the hearmg mdlcates the followmg (a) On September 27, 1995, Renee and Fanny Bollen submitted an application for Mmor Plan ReView 95-4 The application was subsequently tabled pendmg the outcome ofa text amendment to allow certam roof treatments to exceed the 25 foot height limIt The applicants have determmed to proceed With the plans altered to provide a roof not to exceed 25 feet (b) Specifically, the apphcant are seekmg to remodel the second floor of an eXlstmg apartment structure resultmg m a reduction from four (4) to three (3) umts, new roofhne which WIll mcrease the heIght of the front portion of the structure by approxImately two (2) feet to 25 feet m height, exterior remodel and a reconfigured stairwell access to the second floor (c) The subject property IS legally descllbed as Olange County Assessor's Parcel Number 199-071-1 and IS located m the ReSidential Low DenSity zone of Old ToWll (d) square feet (37 48' x 90') The subject property IS rectangular m shape With a lot area of3,373 (e) The surroundmg land uses and zomng are as follows SOUTH The mumclpal beach and the PaCific Ocean located m the Pubhc Land Use / Recreation zone (PLUIR) NORTH, EAST & WEST A mixture ofsmgle-famtly and multi-family reSIdential dwellings located m the ResidentIal HIgh Density zone (RHO) of Old Town o \My DOCUMENTS\MINOR PLAN REVlEWS\954 RESOLUTION DOC '.' Planmng rOmnllS.lOn Re.olul1on No 96-18 (f) MInor Plan ReVIew 95-4 Staff received no written responses to Its mailed notIce regardmg Section 5 Based upon the eVidence 10 the record, mcludmg the facts stated 10 ~ 4 of this resolution and pursuant to ~ 28-2407 of the City's Code, the Planning Commission hereby finds as follows (a) Mmor Plan ReView 95-4 IS consIstent with the provIsions of the Land Use Element of the City's General Plan, which provIdes a "hIgh denSIty resIdential" deSIgnation for the subJect property and permits multi-family reSidential uses The use IS also consistent with the remammg elements of the City's General Plan as the pohcles of those elements are consistent with, and reflected 10, the Land Use Element Accordmgly, the proposed use IS consIstent with the General Plan (b) The proposed proJect WIll result 10 a reduction 10 the number of dwelling umts on the subJect property while not add 109 any floor area (c) ThIS proposal Will bring the property closer mto conformity with the requirements of the Code both for denSity and parkmg Section 6 Based on the foregomg, the Planning Commission hereby approves Mmor Plan Review 94-5, subject to the followmg conditions 1 Minor Plan Review 95-4 IS approved for mterlor and exterior remodel, mcludmg the reduction in dwelhng Units from four to three at 110 I Seal Way, Seal Beach 2 All construction shall be 10 substantial comphance wIth the plans approved through MPR 95-4 3 The followmg repairs shall be completed 10 conJunction with thiS approval a Patch holes 10 garage walls and replace celhng 10 back gal age b Replace kItchen exhaust covers 10 Unit B and upstairs c Repair electriC heater 10 rear bedroom of Unit A 4 ThiS Minor Plan ReView shall not become effective for any purpose unless an "Acceptance of CondItions" form has been SIgned by the apphcant 10 the presence of the DIrector of Development ServIces, or notarized and returned to the Planning Department, and until the ten (10) day appeal period has elapsed PASSED, APPROVED AND ADOPTED by the Plannmg CommissIon of the CIty of Seal Beach at a meetmg thereof held on the 17th day of April, 1996, by the followmg vote AYES Commissioners Brown, Campbell, Dahlman, Sharp NOES CommiSSIoners ABSENT Commissioners Law \jJt1iJUP;aJ i f~ Patricia E Campbell, Chairman Planning CommISSIOn Whittenberg, Secretary Planning Comnusslon P,lgc2
