HomeMy WebLinkAboutPC Res 96-17 - 1996-04-17 RESOLUTION NUMBER 96-17 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH RECOMMENDING TO THE CITY COUNCIL APPROVAL OF ZONING TEXT AMENDMENT 95-1, AMENDING ARTICLE 18, SIGN PROVISIONS, TO ESTABLISH STANDARDS FOR THE DISPLAY OF TEMPORARY ADVERTISING BANNERS IN COMMERCIAL ZONES THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE Section 1 At Its meetmg of March 20, 1996, the Planning Commission conSIdered and approved ZOning text Amendment 95-1 ThiS amendment will amend Article 18 of Chapter 28 of the Code to estabhsh standards for the display of temporary advertlsmg banners m commercial zones wlthm the City of Seal Beach SectIon 2 Pursuant to 14 Cahf Code of Regs 9 15311 and ~ II B of the City's Local CEQA GUldehnes, staff has determined as follows The apphcatlon for ZOning Text Amendment 95-1 IS categoncally exempt from review pursuant to the Cahfornla EnVIronmental Quahty Act pursuant to 14 Cahf Code of Regs 9 15311 (Accessory Structures), because It consIsts of placement ofmmor structures accessory to eXlstmg commercial faClhtles, mcludmg on-premises SIgnS, and, pursuant to ~ 15061(b)(3), because It can be seen With certamty that there IS no pOSSibility that the apploval may have a Significant effect on the environment Section 3 A duly notIced pubhc heanng was held by the Planning CommiSSion on September 6, 1995, to conSider Zone Text Amendment 95-1 The CommissIOn continued the heaTIng to November 8, 1995, January 17, 1996, February 21, 1996 and finally to March 20, 1996 Section 4 The record of the heanngs hsted m Section 3 mdlcate the followmg (a) At said pubhc hearing thele was oral and wntten testimony and eVidence received by the Planning CommIssion (b) The proposed text amendment wllllevlse the City's zOning ordmance and enhance the ablhty of the City to ensure orderly and planned display of temporary advertlsmg banners m commercIal zones Section 5 Based upon the fact~ contamed m the record, mcludmg those stated m ~4 of this resolution and pursuant to ~~ 28-2600 oflhe City's Code, the Planning CommiSSIon makes the follOWIng findmgs (a) ZOning Text Amendment 95-1 IS consistent With the provIsions of the VaTIOUS elements of the City's General Plan Accordmgly, the proposed use IS consistent With the General Plan The proposed amendment IS administrative m nature and WIll not result m changes mconslstent with the eXlstmg prOVISIons of the General Plan (b) The proposed text amendment will allow Seal Beach merchants additional latItude to advertIse their busmesses SpeCifically, thIS amendment will allow temporary banners to be displayed by a busmess up to ninety (90) days per calendar year, where banners are currently prohibited (c) The proposed text amendment will not result m any Significant adverse Impacts SectIon 6 Based upon the foregoing, the Planning CommIssion hereby recommends approval of ZOning Text Amendment 95-1 to the City CounCil subJect to the following D \. Article 18 SectIon 28-279 5 TemDorarv Sign of Chapter 28 of The Code of the CIty of Seal Beach IS hereby added to read "A sign which IS mstalled for a limIted tIme and IS not constructed or mtended for long-term use" 3. Article 18 Section 28-1801(3) of Chapter 28 of The Code of the C'ltV of Seal Beach IS hereby renumbered to Section 28-1801(4) 4. ArtIcle 18 Section 28-1801(3) of Chapter 28 of The Code of the CltV of Seal Beach IS hereby added to read "28-1801(3) Temporary Banners Temporary banners are permitted m the Limited C'ommerclal (L-C), Commercial Office (C-O), ServIce CommercIal (C-I), MaIO Street SpecIfic Plan and General Commercial (C-2) zones as follows (a) A "Temporary Banner Permit" shall be obtamed from the Department of Development Services each time a banner(s) IS to be displayed A permIt for a banner will allow one (I) banner for each buildmg face of a busmess which fronts a street or parkmg area (b) The application fee for a permIt to display a banner shall be established by resolution of the City Council and set forth m the City's fee resolution (c) Banners shall be permItted for a penod not to exceed D1nety (90) days per calendar year Banners shall not be displayed longer than thirty (30) days 10 succeSSion, with a penod of not less than SIX (6) days between the times a banner IS dIsplayed by the same busmess (d) The size of a banner shall not exceed one (I) square foot per hneal foot ofbUlldmg frontage, or thirty (30) square feet maximum A banner for a busmess fi ontmg, or adjacent to, a street with a speed limit of thIrty-five (35) miles per hour or more shall be permitted an additional one-half square foot per lineal foot offrontage, not to exceed 45 square feet total for the bannel (e) A banner shall be used only as supplemental advertlsmg for a busmess and may not substitute for a permanent sIgn (f) A banner(s) shall be pelmltted only IfltS display does not obstruct the view of any adJ OImng bu~messes, or any signs, permanent or temporary, connected with adJOImng busmesses (g) Banners shall be permitted to be mounted on the faSCia or wall only Banners shall not be permItted on the roofs of bus messes or over a public nght-of-way, exceptmg on legally permitted overhangs of the public nght of way when the banner proVides a mlmmum head clearance of eight (8') feet Page 2 D' '-ZoNINGTEXrAMENDMENTS'\95-1 REsoWTlON Be ac Planning ('0011I11"'011 RelolullOn No 96-17 April 17, 1996 (h) Banners shall be tightly secured Torn or damaged banners shall either be replaced 01 removed entll ely (I) The apphcant shall bnng the banner to the City for reView 10 conJunction with the apphcatlon form The removal date shall be affixed/marked to the banner by the Department of Development Services If the removal date of a banner IS removed or otherwise tampered With the banner permit shall be deemed expired and Ihe banner shall be ImmedIately removed (J) Fees for temporary banner use shall apply to mdlvldual busmesses only A banner, on pnvate property, mtended for the promotion of a sale mvolvmg an entire shoppmg center, or for a pubhc purpose (I e a Red Cross blood dnve, etc ) shall be exempt from the apphcatlon and depOSit fees set forth above (k) This section shall not apply to City sponsored banners hung over pubhc nghts-of-way Temoorarv Banner Amortization Penod TempOlary banners which do not conform to this ordmance shall, wlthm 30 days, be removed or made to conform" Section 7 The PlanDlng Commission recommends the City Council direct staff to schedule a heanng before the Commission aftel SIX (6) months to review the effectiveness of the proposed text amendment PASSED, APPROVED AND ADOPTED by the Plannmg CommIssion of the City of Seal Beach at a meetmg thereof held on the 17th of Apnl, 1996, by the followmg vote AYES CommissIOners Brown, Campbell, Dahlman, Sharp NOES Commissioners ABSENT CommIssioners Law '-fJ~ Patncla E Campbell, Plannmg Commission (" Whittenberg, Secretary PlanDlng Conurusslon * * * * Page 3 D \. \.ZONINGITEXT AMENoMENrs\.95-1 REsoumoN BC Be
