A RESOLUTION OF THE PLANNING
COMMISSION OF THE CITY OF SEAL BEACH
RECOMMENDING TO THE CITY COUNCIL
APPROVAL OF ZONE CHANGE 96-1, CHANGING
THE ZONING TO DEPICT THE INCREASE OF
APPROXIMATELY 14.8 ACRES OF "MAIN
STREET SPECIFIC PLAN ZONE" LAND AND
APPROPRIATE DECREASES OF OTHER ZONING
CATEGORIES WITHIN THE CITY
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES
HEREBY RESOLVE:
Section 1. CIty staff has receIved direction from the CIty Council, pursuant
to Section 28-2602 of the Code of the CIty of Seal Beach, to prepare thIS matter for the
appropnate pubhc heanngs, in accordance With the provIsIons of State law and local ordmances
The purpose of the proposed Zone Change IS to rezone approximately 14 8 net acres wlthm the
"MalO Street SpecIfic Plan" area m conformance With the General Plan Land Use Element
revIsIons to malOtalO the reqUIred consIstency between the General Plan and Zomng Ordmance
of the CIty. Below IS a detatled breakout of the proposed zone changes bemg proposed:

SectIon 2. Pursuant to 14 Cahf Code of Regs ~ 15025(a) and ~~ II C and
III of the CIty IS Local CEQA GUldehnes, staff prepared an Imtlal Study and a Negative
Declaration, whIch were cIrculated for pubhc revIew and comment from January 30 to February
21, 1996, m comphance WIth the provIsIons of the Cali forma EnVironmental Quahty Act and
the CIty'S Local CEQA GUIdelines. The Planmng CommIssIon has adopted Negative
Declaration No. 96-1 through the approval of Resolutton No. 96-10, whIch IS mcorporated
herem by reference. SaId Negative Declaration represents the mdependentJudgement of the CIty
of Seal Beach.
Sectton 3 A duly noticed pubhc heanng was held before the Planmng
CommIssion on February 21, March 6, and March 20, 1996, to conSIder the proposed Zone
Change 96-1 and the vanous other ImplementlOg apphcatiOns, the Imtlal Study and the Negative
Declaration At the pubhc heanng, the Planmng Commission received both oral and wntten
testimony regardmg the matters under conSideratIOn

Section 4.
The record of the hearmg mdlcates the followmg.
(a) City staff has receIved direction from the CIty Counctl, pursuant

appropnate pubhc hearings, 10 accordance WIth the provIsIons of State law and local ordmances.
(b) The CIty of Seal Beach IS requesting to revIse the proVIsions of the
current "Main Street Specific Plan" to update thIs pohcy and Implementation document to more
accurately reflect the goals, pohcles, and Implementation strategies which the CIty WIll utlhze
10 ItS efforts to maIntam the character and Identity of MalO Street.
(c) In order to fully Implement the provIsions of the MaIn Street
SpecIfic Plan, mcluding the Implementing Land Use Element Amendments, and Zone Ordmance
Text Amendment, It IS proposed to rezone approximately 14 8 net acres wlthm the "MaIO Street
SpecIfic Plan" area 10 conformance with the General Plan Land Use Element revlSlons to
maInta10 the reqUIred consistency between the General Plan and Zomng Ordmance of the CIty,
relative to pnvately and pubhc1y owned property wlthlO the subJect area

(g) The zomng map lOdlcate the subJect area to be deSignated for and
zoned for "Service CommercIal", "General Commercial", and "Pubhc Land Use" The
proposed provIsIons of thIS ImplementlOg action, Zone Change 96-1, for the MalO Street SpecIfic
Plan would change those designatIons for the subJect areas to "MalO Street SpecIfic Plan Zone"

SessIon on February 8, 1995 to review the "Background Studies, MaIO Street SpecIfic Plan"
prepared by the CIty consultant
(k) The CIty CounCil and Planmng CommissIOn met 10 a JolOt Study
Session on August 9, 1995 to revIew the "Draft MaIO Street SpecIfic Plan" prepared by the CIty
consultant.

(1) Both bodIes provided mput and suggestions for additional Issue and
concerns to be addressed, based on testImony received from the pubhc and the Jomt study
sessions.
(m) The CIty Councti mstructed staff to proceed with the preparatIOn
of the appropnate envIronmental documentatIon and staff reports to present the recommended
amendments to the Planmng CommissIon and City Council for consideration at pubhc heanngs
(n) The staff and consultant team conducted numerous surveys and
1Otervlews, in-person and by mail, with residents and busmess owners 10 and around the area
affected by the proposed MalO Street Specific Plan The consultant team further conducted
studIes of existing land uses 10 the MaIO Street area, aesthetic evaluatIOns, and an mtensIVe
parlang utlhzation study The results of those studIes were compIled 10 the document entitled
"Background Studies - MalO Street SpecIfic Plan," which has been reviewed by the Planmng
COmmISSIOn, available for revIew and comment by the pubhc, and made a part of the record of
these heanngs.
(0) Numerous residents, busmess owners, and other 10terested parties have
provIded wntten and oral testimony With regard to all or parts of the proposed revISIons
(P) The proposed zone change area IS legally deSCrIbed 10 subsection
(d) above, and IS graphIcally represented on ExhIbIt A, mcorporated herem by reference
Section 5. Based upon the eVIdence 10 the record, mcludmg, WIthout
hmltabon, the facts stated 10 ~ 4 of thiS resolution, and 10 the envIronmental documentatIon
prepared in conJunction WIth thIS project, and pursuant to ~~ 28-2600 and 28-2602 of the CIty
s ~, the Planmng CommIssion hereby finds as follows
(a) The current zomng designations of "Service Commercial" , "General
CommercIal" and "Pubhc Land Use" are mappropnate, given the previously conSIdered General
Plan Amendments, SpecIfic Plan reVISion, and Zone OrdlOance Text Amendment The
deSIgnation of properties wlthm the boundanes of the "MaIO Street SpecIfic Plan" as "MaIn
Street SpecIfic Plan Zone" WIll prOVIde for consistency between the General Plan, the MalO
Street SpecIfic Plan, and the Zomng Ordmance and WIll also prOVIde mternal consIstency
between the Zomng Ordmance and the Zomng Map of the CIty.
(b) Zone Change 96-1 IS consistent With the provIsions of the Land Use
Element of the CIty's General Plan, as amended through General Plan Amendments 96-IA and
96-1B, whIch estabhshes a "MaIO Street SpeCific Plan Zone" deSIgnatIon for the subJect area
The proposed zone change IS also consIstent With the remammg element~ of the CIty's General
Plan as the pobcles of those elements are consistent WIth, and reflected 10, the Land Use
Element. Accordmgly, the proposed use IS consistent With the General Plan, and Will not be
detnmental to the short term or long term goals of the CIty of Seal Beach and are 10 the Interest
of the pubhc health, safety and welfare.
(c) Zone Change 96-1 IS consistent WIth ReVISion 96-1 of the MaIO
Street SpecIfic Plan, which estabhshes a "MaIO Street SpeCific Plan Zone" deSignatIOn for the
subject area. Accordmgly, the proposed zone change IS consistent With the MaIO Street Specllic
Plan, and WIll not be detnmental to the short term or long term goals of the City of Seal Beach
and are 10 the mterest of the pubhc health, safety and welfare
Section 6. Based on the foregomg, the Plannmg CommIssIon hereby
recommends approval of Zone Change 96-1 to the CIty Councti, as mdlcated graphIcally on
ExhibIt A, attached hereto and made a part hereof.
