A RESOLUTION OF THE PLANNING
COMMISSION OF THE CITY OF SEAL BEACH
RECOMMENDING TO THE CITY COUNCIL
APPROVAL OF ZONING TEXT AMENDMENT 96-
3, CREATING THE "MAIN STREET SPECIFIC
PLAN ZONE" (SECTIONS 28-1250 THROUGH 28-
1257) AND AMENDING SECTIONS 28-1804.3 AND
28-2408.C TO MAINTAIN INTERNAL
CONSISTENCY OF CHAPTER 28 OF THE CODE
OF THE CITY OF SEAL BEACH
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES
HEREBY RESOLVE:
SectIon I. The CIty IS proposmg to revise the provlSJons of the current" Main
Street Specific Plan" to update thIs pohcy and nnplementatlon document to more accurately
reflect the goals, pohcles, and ImplementatIOn strategies which the CIty WIll utlhze 10 ItS efforts
to mamtain the character and Identity of MaIO Street In order to fully Implement the provIsIons
of the MalO Street SpecIfic Plan It IS proposed to estabhsh the "Mam Street Specific Plan Zone",
whIch WIll10clude the followmg maJor sections 10 order to fully Implement the provlSJons of the
"Main Street Specific Plan" relative to pnvately owned property wlthm the subJect area

. Uses SubJect to Issuance of a Conditional Use PermIt (Section 28-1250 B)
. LImItations on PermItted Uses (SectIOn 28-1251)

In addition, amendments are proposed to the follow1Og sections of
the Zoning Ordmance to maIntam mternal consistency between the proposed proVIsIons of the
"Main Street Specific Plan" and the Zomng Ordmance
. Permitted SIgns (Section 28-1804 3), adds the "Mam Street Specific Plan Zone"
to the hstlng of vanous commerCial zones Wlth10 the CIty, and adds specIfic
provIsIons for the proposed "Mam Street Specific Plan Zone"
. Nonconformmg Nonresidential BlIIldmgs and Uses (Section 28-2408.C, adds
prOVIsions relative to nonconformmg bUlldmgs and uses wlthm the proposed
"Main Street Specific Plan Zone" .
Section 2. Pursuant to 14 Cahf Code of Regs ~ 15025(a) and ~ II C and III
of the CIty'S Local CEQA GUldehnes, staff prepared an Imtlal Study and Negative DeclaratIOn,
whIch were cuculated for pubhc revIew and comment from January 30 to February 21, 1996,
10 comphance WIth the provIsIons of the Callforma Envlromnental Quahty Act and the CIty's
Local CEQA GUIdelines The Planmng CommissIOn has adopted Negative Declaration No 96-1
through the approval of Resolution No 96-10, which IS mcorporated herem by reference SaId
Negative Declaration represents the mdependent Judgement of the City of Seal Beach

Section 3. A duly noticed pubhc heaTing was held before the Planmng
CommIssIon on February 21, March 6, and March 20, 1996, to consider the proposed Zone
Text Amendment 96-1 and the vanous other Implementmg apphcatlOns, the Imtlal Study and the
Negative Declaration At the pubhc heaTing, the Planmng CommIssIon receIved both oral and
wntten testimony regardmg the matters under consideration
Section 4.
The record of the hearmg mdlcates the followmg:
(a) CIty staff has receIved dIrection from the City Council, pursuant
to Section 28-2602 of the Code of the City of Seal Beach, to prepare this matter for the
appropnate pubhc heanngs, 10 accordance wIth the provIsions of State law and local ordmances.
(b) The City of Seal Beach IS requestmg to revIse the provIsIons of the
current "Main Street Specific Plan" to update thIs pohcy and nnplementatlon document to more
accurately reflect the goals, pohcles, and Implementation strategIes which the CIty WIll utlhze
10 ItS efforts to maintaIn the character and Identity of MaIO Street.
(c) In order to fully Implement the proVIsions of the MaIO Street
SpecIfic Plan It IS proposed to estabhsh the "Main Street Specific Plan Zone", whIch WIll mc1ude
proposed development standards 10 order to fully Implement the provlSlons of the "Main Street
Specific Plan" relative to pnvately owned property wlthm the subJect area

(e) The Ma10 Street SpecIfic Plan area IS located along both sIdes of
MaIn Street, between Pacific Coast HIghway and Ocean Avenue, mc1uding EIsenhower Park and
the 8th and 10th Street pubhc beach parlang lots. The subJect area IS lTTegular 10 shape, and
compnses approXImately 14.8 net acres, and approxImately 21 gross acres, mcludmg pubhc
roadways and alleys.
(f) The subJect area IS the location of the hlstonc commerCIal area of
Seal Beach and compnses pnmanly commercIal uses along MalO Street, wIth pubhc recreation
uses provIded at EIsenhower Park and the beach Pubhc uses along 8th Street whIch are
mcluded in the MaIO Street SpecIfic Plan area mclude CIty Hall, FIre Station 44, and vanous
pubhc parking lots.
(g) The General Plan and the zomng map mdlcate the subJect area to
be designated for and zoned for "ServIce CommercIal", "General CommercIal", and "Pubhc
Land Use". The proposed provIsIons of the Implementmg actIOns for the MaIO Street Specific
Plan would change those deSIgnations for the subJect areas to "MaIO Street SpecIfic Plan Zone"
(h) The surroundmg General Plan Land Use deMgnatlOns, zomng
designations, and current land uses are as follows.

(j) The City Council and Planmng Commission met 10 a Jomt Study
SessIOn on February 8, 1995 to revIew the "Background Studies, MaIO Street SpecIfic Plan"
prepared by the CIty consultant.
(k) The City Counctl and Planmng CommIssion met 10 a Jomt Study
Session on August 9, 1995 to review the "Draft MalO Street SpecIfic Plan" prepared by the CIty
consultant.
(1) Both bodies proVIded mput and suggestiOns for addItional Issue and
concerns to be addressed, based on testimony received from the pubhc and the Jomt study
sessIOns.
(m) The CIty Councd m~tructed staff to proceed WIth the preparation
of the appropnate envuonmental documentation and staff reports to present the recommended
amendments to the Planmng Commission and CIty Council for consideration at pubhc heanngs
(n) The staff and consultant team conducted numerous surveys and
inteTVlews, in-person and by maIl, With reSIdents and bus10ess owners 10 and around the area
affected by the proposed MaIO Street Specific Plan The consultant team further conducted
studies of existing land uses in the Ma10 Street area, aesthetIC evaluations, and an mtenslve
parkIng utlhzatlon study. The results of those studies were compiled 10 the document entitled
"Background Studies - Mam Street Specific Plan," whIch has been reviewed by the Planmng
CommIssIOn, available for revIew and comment by the pubhc, and made a part of the record of
these hearings.
(0) Numerous reSIdents, busmess owners, and other 10terested parties have
proVIded wntten and oral testimony WIth regard to all or parts of the proposed revISJons
SectIon 5. Based upon the eVidence 10 the record, mcludmg, WIthout
lImItation, the facts stated 10 ~ 4 of thIS resolutIOn, and 10 the environmental documentation
prepared In conJunction wIth thIS proJect, and pursuant to ~~ 28-2950 through 28-2953 of the
CIty'S ~, The Planmng CommiSSIon hereby finds as follows'
(a) Zone Ordmance Text Amendment 96-3,10 the form attached hereto
as ExhIbIts" A" and "B", WIll not be detrImental to the short term or long term goals of the City
of Seal Beach and are In the mterest of the public health, safety and welfare
(b) Zone Ordmance Text Amendment 96-3,10 the form attached hereto
as Exhibits "A" and "B", Will not directly cause any mcremental development. However,
mdividual propertIes and theIr related uses may change at the discretiOn of the property owners
or busmesses; and these changes Will have to conform to the adopted proVISions of the zone
ordmance text amendment The proVISions of proposed Zone Ordmance Text Amendment 96-3
will allow for commercial development potential to a level of mtenslty more m keepmg WIth the
deSlTes of the cItizens of the City of Seal Beach, while still allowmg for reasonable use of the
property, and still 10 keeping With the mtent of the General Plan and the MaIO Street SpeCIfic
Plan.

Section 6. Based on the foregomg, the Planmng CommissIon hereby
recommends that the CIty Council approve Zone Ordmance Text Amendment 96-3 10 the form
attached hereto as ExhIbits "A" and "B" and mcorporated herem by thIs reference.
