A RESOLUTION OF THE PLANNING
COMMISSION OF THE CITY OF SEAL BEACH
RECOMMENDING ADOPTION OF NEGATIVE
DECLARATION NO. 96-1, RELATING TO
REVISION 96-1 OF THE MAIN STREET SPECIFIC
PLAN
THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES
HEREBY FIND AND RESOLVE:
SectIOn 1. The City IS proposmg to revise the provIsions of the current "Main
Street Specific Plan" to update thIS pohcy and ImplementatiOn document to more accurately
reflect the goals, pohcles, and Implementation strategIes which the City Will utlhze 10 ItS efforts
to ma10tain the character and Identity of MaIO Street
Section 2. Pursuant to 14 Cahf Code of Regs. ~ 15025(a) and ~ II C and III
of the CIty'S Local CEQA GUldehnes, staff prepared an Imtlal Study and Negative Declaration,
whIch were circulated for pubhc revIew and comment from January 30 to February 21, 1996,
10 comphance WIth the provIsions of the Cahforma Envlromnental Quality Act and the CIty's
Local CEQA GUldehnes
SectiOn 3 A duly noticed pubhc heaTing was held before the Planmng
CommiSSIOn on February 21, March 6, and March 20, 1996 to con~lder the proposed revISIons
to the MalO Street SpecIfic Plan, accompanymg unplementmg actIOns, the Imtlal Study and the
Negative Declaration. At the pubhc hearmg the Planmng Commission receIved testimony from
the pubhc regardmg the proposed reVISIonS, the lmtlal Study and Negative DeclaratIOn, both 10
favor and in opposItion

The record of the heanng mdlcates as follows'
(a) CIty staff has receIved dIrectIon from the CIty Council to
prepare thIS matter, proposed reVlSlons to the MaIO Street SpecIfic Plan as recommended by the
CIty Council and Planmng CommissIon after conducting two Jomt study sessIOns 10 February
and August, 1995, for the appropnate pubhc heanngs, 10 accordance With the prOVIsions of State
law and local ordinances.
(b) The City of Seal Beach IS requestmg to amend provIsIons
of the Ma10 Street SpecIfic Plan as more fully set forth 10 the "MaIO Street Specific Plan", dated
January 17, 1996, and as generally descnbed 10 SectIOn I, above

Park and the 8th and 10th Street pubhc beach parkmg lots The subJect area IS Irregular 10
shape, and compnses approxImately 14 8 net acres, and approximately 21 gross acres, mcludmg
publIc roadways and alleys.
(e) The subJect area IS the location of the hlstonc commercIal
area of Seal Beach and compnses pTlmanly commercial uses along MaIO Street, WIth pubhc
recreation uses proVIded at EIsenhower Park and the beach Pubhc uses along 8th Street whIch
are included 10 the Main Street SpecIfic Plan area mclude CIty Hall, Fue StatiOn 44, and vanous
public parking lots.
(f) The General Plan and the zonmg map mdlcate the subJect
area to be deSIgnated for and zoned for "Service Commercial", "General CommercIal", and
"PublIc Land Use". The proposed prOVIsions of the Ilnplementmg actions for the MaIO Street
SpecIfic Plan would change those designatiOns for the subJect area~ to "MaIO Street Specific Plan
Zone"

(h) Staff has prepared an mltJal envIronmental assessment and
proposed Negative DeclaratIon as requIred by the Cahforma EnVIronmental QualIty Act
(CEQA). Staff receIved comments from five (5) agencies relatIve to the proposed Negative
Declaration. The City of Garden Grove and Caltrans Dlstnct Offices 7 and 12 expressed no
concern WIth the proposal The County of Orange dlscu~sed Issues relatmg to absorption rates,
dra10age patterns and surface runoff The Coastal Commission discussed local- and vlsltor-
servlOg Issues and requested copIes of certam document~ Staff prepared a memorandum to the
Planmng CommiSSIOn whIch discussed the vanous Issues and proVided a staff response, dated
March 1, 1996
(I) At the conclUSIOn of the Pubhc Hearmg, the Planmng
CommIssion determined to recommend the followmg addltJonal amendments to the MalO Street
SpecIfic Plan ReVISIon 96-1, Zone Text Amendment 96-3 and the AB 1600 Report.
. Reduce the allowable size of desert shops, coffee houses, and other SImilar
estabhshments to prOVide seatmg for no more than 10 customers and the gross
square footage of the estabhshment shall not exceed 1,000 square feet,"
. ReqUIre a conditional u~e permit for desert shops, coffee houses, and other
slmtlar estabhshments whIch Wish to proVide seatmg for more than 10 customers
and the gross square footage of the estabhshment exceeds 1,000 square feet,"..
. ReqUires gas statJons located on a maJor artenal to comply With the provIsIons of
Section 28-2318, Service statiOn standards.
. Places a numencal cap on the number of off-premIse alcohol sale estabhshments
and sets standard operat1Og hours for those e~tabhshments
. Sets standard operatmg hours for new restaurants estabhshed wlthm the MalO
Street Specific Plan area.
. Proposes a parkmg reqll1rement of I space per 250 square feet of floor area for
desert shops, coffee houses, and SImilar estabhshments
. Proposes ehminatlOn of the e~tabhshment of a Busmess Improvement Dlstnct

. ProvIdes for the possible acqUISItion of an additional surface parkIng lot 10 the
general area of MaIO Street and Central Avenue
. Provides for modIficatIon to the parlang m-Iteu fees and AB 1600 Parkmg Impact
Fees from $100/space/year to $350/space/year and from $3,614 14/space to
$5, 197.62/space.
These addItional revISIons are not of a slgmficant nature to
require the recIrculation of the Imtlal Study and proposed NegatIve DeclaratIOn 95-5 for the
following reasons:
. The Imtlal Study was Circulated based on proposed revIsIons to the current MaIO
Street SpecIfic Plan and the e~tabhshment of a MalO Street Specific Plan Zone.
The amendments to these proposals as set forth above are mmor 10 nature and
have no substantial impact upon the envIronmental Issues discussed 10 the Imtial
Study and Negative Declaration 96-1
. The Imtlal Study was clTculated WIth proposals for amendments to the General
Plan, a complete reVISion to the MalO Street Specific Plan, the estabhshment of
zomng ordmance provIsions for the e~tabhshment of the MaIO Street SpecIfic Plan
Zone, and the estabhshment of an AB 1600 parkmg fee for the MaIO Street
SpecIfic Plan area, and the proposed revIsions are 10 general concurrence WIth the
reVISIons dIscussed 10 the Imtlal Study.
. The proposed revIsIons set forth above are of a mlOor nature, and would not
change any of the envlTonmentallmpacts dIscussed 10 the Imtlal Study relatmg to
the revISIon of the MaIO Street Specific Plan and other IInplementmg actions
(j) No new mformation was brought forward dunng the pubhc
comment period or that the pubhc hearings With regard to potential environmental Impacts from
the proJect that was not addressed 10 the mltial environmental assessment
SectIon 5. The Planmng CommIssion affirms that It mdependently revIewed
and analyzed proposed Negative Declaration No 96-1 pnor to actmg on the accompanymg
apphcatlons and hereby finds as follows
(a) Negative DeclaratIon No 96-1 was prepared by CIty Staff
and therefore reflects the mdependent Judgement of the CIty of Seal Beach, and
(b) There IS no substantml eVIdence 10 the record which would
support a fair argument that approval of the proJect Imght have a slgmficant environmental
Impact; and
(c) No new mformatlOn was brought forward dunng the pubhc
comment period or at the pubhc heanng With regard to potential envIronmental Impacts from
the proJect that was not addressed 10 the Imtial environmental assessment
(d) Approval of thiS proJect Will create no potential for adverse
effect, eIther mdlvldually or cumulatively, on wtldhfe resources and WIll not have an adverse
Impact on fish and wlldhfe and the Planmng Commission hereby directs the Director of
Development Services to file the appropnate De Mmlmus Impact Fmdmg for the CalifornIa
Department of FIsh and Game CertIficate of Fee ExemptIOn, and

(e) Proposed RevIsion 96-1 of the MalO Street SpecIfic Plan wIll
establish future commercIal development potential and standards to a level of lOtensity more 10
keeplOg WIth the deSlTes of the cItizens of the CIty of Seal Beach, whIle still allowlOg for
reasonable use of the propertIes wlthm the boundaries of the proposed MaIO Street Specific Plan
Zone, still 10 keep10g WIth the mtent of the Ma10 Street SpecIfic Plan and ItS Implementing
documents.
SectIOn 6. Based on the foregomg, the Planmng CommISSion hereby
recommends adoption of Negative Declaration No. 96-1, 10 compliance WIth the CahfornIa
EnVIronmental QualIty Act and the City's Local CEQA GlIIdehnes
PASSED, APPROVED AND ADOPTED by the Plannmg CommIssIon of the CIty of
Seal Beach at a meetmg thereof held on the 17th day of Apo! , 1996,
by the following vote
