TWO TANDEM PARKING SPACES TO CREATE A FOUR (4) CAR GARAGE AT A NONCONFORMING DUPLEX LOCATED AT 121 2ND STREET, SEAL BEACH THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY FIND AND RESOL VB SectIon 1 On November 13, 1997, Mark H Gole (the "Apphcant") filed an apphcatlon WIth the Department of Development Services for CondItional Use PeTffilt 97-13 and Mmor Plan ReVIew 97-6 Through these requests, the apphcant sought the following MPR 97-6 To add two (2) tandem parking spaces ID order to meet parking requirements CUP 97-13 To perform a major addItIon/remodel to a nonconfoTffilng duplex located at 121 2nd Street, Seal Beach The addition IDcludes the demohtlon and replacement of the one-story front unit The new front umt WIll be two-stones ID height WIth an area of2,334 square feet SectJon 2 Pursuantto 14 CalIf Code of Regs ~ l5025(a) and ~ II B of the CIty'S Local CEQA GuIdelines, staff has deteTffilDed as follows The apphcatlon for Plan Review 97-6 IS categoncally exempt from review pursuant to the California EnVlTonmental QUalIty Act pursuant to 14 CaiIf Code of Regs ~ 15301 (EXlStlDg Uses), because it involves the neghgtble expansion ofan existing use, pursuant to ~ 15305 (MInor Alterations ID Land Use LlffiltatlOns), because the proposallDvolves a ffilnor alteratIon In a land use hffiltatlon and does not involve eIther a property 10 excess of20"1o slope or a change ID land use or denSIty, and finally, pursuant to ~ l5061(b)(3), because it can be seen WIth certalDty that there IS no posslblhty that the approval may have a slgmficant effect on the environment Section 3 A duly noticed pubhc hearing was held before the Planmng CommisSIon on December 17, 1997 to consider the apphcatlon for MPR No 97-6 At the pubhc heaTIng the applicant spoke in favor of the request WIth no one speakmg ID oppoSItIOn Section 4 The record of the heanng on December 17, 1997 indicates the follOWIng (a) On November 13, 1997, Mark H Gole filed an application WIth IS also descnbed as Orange County Assessor's Parcel No 199-145- 14 (d) The subject property IS a rectangular lot WIth 25' x 117 5' dImenSIons (2,937 square feet) (e) The subject property IS located on the westerly SIde of 2nd Street approximately 180 feet southerly of the center of the intersectIon of2ad Street and Central Way (f) The subject property IS surrounded on all SIdes by a mixture of response, a letter 10 opposition to the proposed tandem parking from JIm GIbson of 12 I 3n1 Street, regardmg the maded and posted notIce for thIs request Section 5 Based upon the facts contamed 10 the record, includmg those stated in fi 4 oftlus resolution, and pursuant to fifi 28-2407, 28-2503 and 28-2504 ofthe City's Code. the Planmng COl1ll1llssion hereby finds as follows (a) The grantmg ofMmor Plan Review 97-6 IS consistent with the prOVISions of the General Plan which indicate the subject property IS to be used for high density reSidential purposes, which mcludes legally nonconfoTffilng duplexes (b) The budding and property at 121 2nd Street are adequate 10 SIZe, shape, topography and location to meet the needs of the proposed use of the property (c) ReqUIred adherence to apphcable buddlOg and fire codes ensure there will be adequate water supply and uuhtles for the proposed use (d) The proposed major remodeVaddluon will entad the removal ofa non-peTffiltted tlurd dwelling umt from the property Section 6 Based upon the foregomg, the Planning COl1ll1llSSl0n hereby approves Mmor Plan Review 97-6, subject to the follOWIng condItIons 1 Minor Plan ReVIew 97-6 is approved for the addition of a four-car garage which includes two tandem parking spaces at 121 2nd Street, Seal Beach 2 Any future rental agreements for the property shall mclude language indlcatmg each dwelhng unit IS entitled to the use of two parklOg spaces (one standard, one tandem) WItlun the four- car garage Language to this affect shall be mcluded in the land use covenant reqUired through CUP 97-13 3 The apphcant relJll\lns bound by all condItIons of CUP 97-13 4 All construction shall be in substantIal compliance WIth the plans approved through MPR 97-6 and CUP 97-13 5 This Minor Plan ReVIew shall not become effective for any purpose unless an "Acceptance of Conditions" fonn has been SIgned by the applicant 10 the presence of the DIrector of Development Services, or notarized and returned to the
